AGREEMENT FOR LET-OUT/RENTING OF RESIDENTIAL PROPERTY

This Agreement is made on 27th day December 2017, at Noida, between

Ms Chandra Mamtani d/o Late C.H. Mamtani r/o D-16, Lajpat Nagar III, New Delhi,
Mobile No. 9818007005 (hereinafter referred to as the “First Party” on the First Part)
and

Mr.Saurabh Singh Tomar S/o Shri Rajendra Singh Tomar R/o H.No , H-243,
Aadharshila Wast Block ,Barkheda Pathani ,Huzur , Bhopal (MP)462022 &Ms
Pallabi Roy D/o shri Dharma Kanta Roy R/o H.No, 309-B Room No -8 1st Floor
Munirka Vill ,Delhi 110067 Mobile No.9910017742 hereinafter referred to as
“Second Party” on the Second Part).

Both the First Party and Second Party are referred to in this as agreement as “Party”
or “Parties” which over the context so requires.

PREAMBLE

Whereas the First Party is the absolute owner for Flat No. A-804, Alexandra, Tower
A Omaxe Grand Sector 93 B Noida Expressway (hereinafter referred to as “the
Flat”) Omaxe Grand hereinafter referred to as “SOCIETY” and desires to let out the
same for residential purposes. Whereas the Second Party desires to hire the “Flat” for
his stay and use as residential accommodation for his use. The Parties agree on the
following terms and conditions:-
1) The agreement is valid for a period of 11th months w.e.f.15th January 2018 To
9th November 2018, unless terminated as per provisions of this agreement and
may be extended for a further period of 11 months with 10% increase in
rent(with mutual consensus), other terms and conditions remaining same. The
monthly rent and maintenance charges are to be paid in advance by 5th of each
month.

2) The Second Party shall pay the First Party rent and other charges in advance
as per following details:

i) A rent of Rs 25000/- (Rupees Twenty five thousand only) per month.

ii) Maintenance charges to be paid directly to Facility Plus Management


Pvt. Ltd. or any other Company in charge of maintenance in future. The
maintenance charges are inclusive of water, electricity, etc. for common
areas.

iii) An interest free security deposit of Rs 50000/- (Rupees fifty thousand


only).

3) The rent referred to in 2(i) above shall be paid by the Second Party through
post-dated cheques to the First Party.

4) The Second Party shall bear the maintenance charges of the Flat as charged
by the Society. In the event of increase in the maintenance charges by the
Society, the Second Party shall bear the extra amount over and above to the
mutually decided rent.

5) Any delay in payment of the rent, charges and other dues by the Second Party
to the first Party (that is due in terms of this agreement) shall attract interest @
24% per annum on the outstanding dues from the due date to the date of actual
payment and shall be compounded annually.

6) The security deposit, as mentioned at 2(iii) above, shall be transferred by the


Second Party to the First Party’s Account before the signing of the Agreement.
In the event any money remains outstanding or unpaid by the Second Party on
account of maintenance charges and/or any other charges, damages to the Flat
beyond normal wear and tear, the First Party shall be entitled to adjust the same
against the said deposit at the time of peaceful vacation of the flat or termination
of this agreement. The Security deposit will under no circumstances be
adjusted against the rent payment.

7) The Second Party shall also be responsible for timely payment of the following
charges:-
i) The electricity and water bills received for the flat from the respective
Boards/Maintenance Company.

ii) Club and related facilities charges including swimming pool usage
charges as fixed by the Society/Management Committee of Club from
time to time, if permitted/used.

iii) Maintenance bills towards consumables etc. as charged by the


maintenance company for day to day repairs in the flat.

iv) Monthly cable T.V. charges from the time the same is installed. The
cable TV installation charges shall be borne by the Second Party.

v) Any other charges that may become applicable to the flat from time to
time and as modified by the Society or any other relevant authority.

The Second Party shall hand over the original bills along with payment receipts
in respect of all the above regularly to the first Party.

8) The Second Party may have a land line phone installed at the flat at its own
cost and expense and shall be responsible for clearing all dues related thereto
before vacating the flat.

9) The woodwork, electrical fittings including electric chimney etc has been
provided in the Flat by the First Party.

10) The Second Party shall use the flat for residential purposes only and shall not
use the same for commercial purposes and the Second Party will not sublet the
Flat.

11) The Second Party shall not make any alterations or changes without the
specific approval of the First Party. In case the Second Party makes any minor
alterations for the purpose of fitting of the air conditioners, water purifier or any
other minor electric and non-electric fittings, the Second Party undertakes to
hand over the flat to the First Party in the same condition as it is at the time of
occupation and any charges for such restoration will be made by the Second
Party.

12) The Second Party shall maintain the flat in good condition and shall abide by
the rules of the Society.

13) That the Second Party shall not store any inflammable or explosive material in
the said tenanted/leased Flat or do or permit to do any act which causes
nuisance or annoyance and or to violation of any applicable rules and law of
civil /concerned local authority/Society including laws framed for protection
against fire.

14) The First Party or her authorized representative shall have the right to inspect
the flat

15) This Agreement can be terminated:

i) By either Party giving one month’s notice. However, such termination


shall not be allowed unless at least six months have elapsed from the
date of this agreement.

ii) By the First Party, at its discretion, due to default in making timely
payment of all amounts payable by the Second Party in the terms of this
agreement and such default is not corrected within 7 days from the date
of notice by the First Party.

iii) By First Party at any time, at its discretion, if there is a breach of other
terms and conditions by the Second Party.

In the event of termination in situation as stated in Para 15(ii) above, the Second
Party shall vacate the Flat within fourteen (14) days from date of notice of
termination and hand over the Flat to the First Party. If the Second Party fails
to vacate after the said period of 14 days, the Second Party would pay a penalty
of Rs.1500/- (Rupees One thousand five hundred) per day from the date on
which the flat was to be vacated till the actual date of vacation in addition to the
monthly rent and maintenance charges, as applicable, along with the interest
thereof. Second Party has read and understood guidelines issued by the
Society and undertake to abide all conditions in letter and spirit.

16) The First Party shall not be liable for any damage or injury to any person,
whatsoever, or to any property, whatsoever by earthquake, fire, theft, militant
attack, rain, leakage breakages or bursting of water pipes or electricity in the
said premises or giving way of any portion of the flooring, walls, roof or any
other part of flat from any cause whatsoever.

17) The Second Party is responsible for proper upkeep and regular maintenance
of the Flat and in that all minor repairs like: bulb/tubelight change are to be
carried out by the Second Party.

18) The terms of this agreement shall not be altered or added to nor shall anything
be omitted there from except by means of a supplementary Deed in writing duly
signed by the parties hereto.
19) Delhi Courts will settle all disputes of difference amongst the parties that may
arise out of or in connection with or in relation to this agreement only.

20) Notice to any Party to the other shall be to the address of the Parties referred
above.

21) The First Party has provided the fixtures and accessories as per the list
attached as Annexure A.
