MUTUAL RESCISSION OF CONTRACT

KNOW ALL MEN BY THESE PRESENTS:

This agreement of mutual rescission of contract made and entered

into this 15th day of January 2019 by and between:

The PROVINCIAL GOVERNMENT OF QUIRINO with business

address at Capitol Hills, Cabarroguis, Quirino represented herein by its
Governor, HON. JUNIE E. CUA, hereinafter referred to as the FIRST
PARTY; and

KMD BUILDERS AND CONSTRUCTION SUPPLY with business

address at Cauayan City, represented herein by its General Manager,
KRISTEL MAY D. DY, hereinafter referred to as the SECOND PARTY;

The parties hereby mutually acknowledge and agree that:

1. On various dates, the FIRST PARTY signed individual Purchase
Requests and Purchase Orders of crushed aggregates for Farm-to-
Market Roads in different barangays;

2. As a requisite, said procurements were posted in the PHILGEPS and

the SECOND PARTY submitted its Request for Quotation;

3. While the parties may have already agreed, there are other
requirements under the Procurement Law that need to be complied
with hence, the parties mutually agree to rescind the individually
signed Purchase Request and Purchase Order inorder to comply with
some procedural and documentary requirements;
Therefore, in consideration of the mutual covenants of the parties, the
parties hereby rescind ALL the signed Purchase Requests and Purchase
Orders and all documents related thereto effective as of the date written
above.
This agreement of mutual rescission shall be binding upon the parties,
their successors, assigns and personal representatives. Neither party shall
have any further rights or duties thereunder.
 IN WITNESS WHEREOF, we have set our hand this __day of January
2019 at Cabarroguis, Quirino.

ACKNOWLEDGMENT

BEFORE ME, Notary Public, personally appeared the PARTIES with

their competent proof of identity written below their names, both known to
me to be the same persons who executed the foregoing agreement and
that they both acknowledged to me that same is their free and voluntary
deed.

This document consists of two (2) pages including this page where
the acknowledgment is written and signed by the parties and their
instrumental witnesses.

Calamba, Laguna represented herein by its President, LYLE CHRISTIAN
R. HERBOSA, hereinafter referred to as the SECOND PARTY;

The parties hereby mutually acknowledge and agree that:

1. On December 17, 2018, the Province of Quirino was declared under
a State of Calamity Due to Dengue Outbreak by virtue of SP
Resolution No. 184, Series of 2018;

2. As such, on December 11, 2018 the FIRST PARTY signed a

Purchase Request of 300 bags LARVICIDE (Calcium Hydroxide 25
kgs.) and all other requirements were signed respectively including
the Purchase Order dated December 28, 2018;

3. While the parties may have already agreed, there are other
requirements under the Procurement Law that need to be complied
with hence, the parties mutually agree to rescind the individually
signed Purchase Request and Purchase Order inorder to comply with
some procedural and documentary requirements;

Therefore, in consideration of the mutual covenants of the parties, the

parties hereby rescind the signed Purchase Request and Purchase Order
and all documents related thereto effective as of the date written above.
This agreement of mutual rescission shall be binding upon the parties,
their successors, assigns and personal representatives. Neither party shall
have any further rights or duties thereunder.
 IN WITNESS WHEREOF, we have set our hand this __day of
