Foye, MTA Chairman and CEO Metropolitan Transportation Authority 2 Broadway New York, NY 10004-2207 Dear Chairman Foye: In light of recent media reports and resulting decisions from the Agency to utilize MTA Police Officers to oversee and monitor attendance practices for LIRR employees, I am raising serious concems of safety and security for both our employees and our customers. First, the decision to use highly qualified MTA Police Officers to observe employee attendance practices in an effort to control overtime is insulting and irresponsible to the riding public. These Officers belong out in public fighting crime, combating fare evasion and serving the riding public, not going through the motions of observing employee attendance behaviors of MTA workers, including asking for time cards that no longer exist from people they work with on a daily basis. They are tasked with observing the use of a reliable Kronos Biometric finger touch identification system. This is a waste of police resources and puts our entire system at risk, not to mention the extreme insult to our employees who do nothing but work when asked to by management. Knowing the demands of the MTA Police force, while not sacrificing patrols will you be using police overtime to combat operational overtime? Second, the clear and driven accusatory actions by MTA Leadership toward MTA employees on alleged overtime abuse has created a distraction in our daily operations that is incredibly concerning to their safety and the safety of all connected to the countless projecis ongoing. Workers are afraid to accept overtime assignments. Managers are at a loss as to how to maintain the aggressive schedules and goals put forth with the strained headcounts in some of our departments. Workers connected to work performed on and near live track are anxious and distracted due to the lack of support they are receiving in the field and being demonstrated as they are being treated like criminals. Page | 1 All year long at countless Board and Committee meetings the Agency boasted about aggressive goals, job completions, LIRR Forward achievements, etc. The LIRR has offered work in staggering volume to our membership knowing the costs associated and without concern of the same. They motivated Union leadership to get people to work due to Agency leadership’s relentless desire to deliver. Our workers worked when called upon. As inquiries continue, and things are learned, I remind you to ask yourself two key points: Where was management if we did not plan on spending all of this overtime? Who is responsible for the safety concerns due to an unsettled and undervalued workforce? Please accept this as a formal and clear concern for the safety of our members and the riding public due to the course of actions taken by the Agency that has created a lack of focus within our ranks. We ask the Agency to take responsibility where necessary and support the workers who do the physical work that moves our region. We urge you to utilize the MTA Police force as intended, to protect and serve our system.
