Re: Engagement Agreement for the filing

of Civil Action for Partition with
Recovery of ownership and Sum of
Money

Dear Mr. Jonathan:

Thank you for choosing my services to assist you on your legal

concerns.

This letter is to confirm our engagement and to set forth our

understanding of the legal services to be performed by me and
the basis upon which I will be paid for those services.

You have engaged me to perform the following on your behalf:

1. To appear as your Counsel/Lawyer in your case before

the Regional Trial Court;
2. To prepare and file the Complaint and the Affidavits of
Witnesses;
3. To prepare and present witnesses for trial;
4. To prepare and file all such pleadings, motions, and
memoranda that may be required in the course of the
proceedings; and
5. To do such other acts that shall be necessary to protect
your interest in the course of the proceedings.

It is understood, however, that this agreement shall be limited
to proceedings and processes before the Regional Trial Court of
Manila, Philippines. Should it be necessary to litigate the matter
to higher tribunals or appellate courts, same shall be subject to
a separate agreement.

In relation to the handling of your case, charges are as follows:

1. Acceptance Fee: __________________________ Pesos (Php

__________________) which shall be payable upon the
signing of this Agreement;

2. Appearance Fee: __________________________ Pesos (Php

__________________)for every conference or hearing
attended in connection with the case;

3. Pleadings: __________________________ Pesos (Php

__________________) for every pleading filed (to include
filing, mailing and photocopying of documents) except on
Petitions for Review which shall be charged separately.

4. Contingent Fee: An additional amount of twenty-five

percent (25%) percent of the gross amount of all money
collected or received by virtue of a judgment or by virtue of
an amicable settlement or compromise agreement,
whichever is higher;

Note: Fees on appearances for hearings or consultations

and pleadings shall be paid/ deposited at least two (2)
days before due dates of filing/ hearing.

Communication
Two-way communication will be very important in our
relationship. If you ever need clarification of what we are doing,
please call, email or make an appointment for a meeting. If you
have any information that might help me to handle your matter,
please let me know. I will report to you from time to time by
letter, telephone, or email and send you copies of
correspondence I send or receive and documents I prepare. If
you need further explanation of a document or correspondence
you receive from me, please feel free to notify me, as soon as
possible. It is your responsibility to keep me informed of any
change in your mailing or email address or phone number.

Privilege and confidentiality

Certain communications between attorney and client are
confidential. This confidentiality is known as the “attorney-

client privilege”. You can provide me all the facts relevant to
your matter without fear that those facts will become public.

Terminating legal services

You may terminate this engagement by providing me a written
notice at any time. I may withdraw with your consent or for good
cause. Good cause includes breach of this Agreement, refusal
to cooperate or to follow my advice on a material matter or any
other fact or circumstance that would render my continuing
representation unlawful or unethical.

Disclaimer of guarantee
Nothing in this agreement and nothing in any of my statements
to you will be construed as a promise or guarantee about the
outcome of matter. There are no promises or guarantees as to
the favourable result.

Should the foregoing terms and conditions be acceptable to you,

please indicate your conformity by signing on the space
provided below and immediately transmitting one copy to me for
my file. We look forward to a mutually beneficial relationship
and should you have any questions regarding the foregoing,
please do not hesitate to call.

To handle your legal matter promptly and effectively, I hope you

will let me know if there is any way I can possibly improve the
service I provide.

If you have understood the terms and conditions above, please

sign and return the enclosed copy. I will start from the time I
have received the signed letter.
