Speech and the Electoral Process (Article III Section 4)

FACTS
A senatorial candidate in the May 1992 elections, Blo Umpar Adiong assails COMELEC
Resolution No. 2347 issued on January 13, 1992. Section 21(f) of the said Resolution provides
that it is unlawful:

To draw, paint, inscribe, post, display or publicly exhibit any election propaganda in any
place, whether public or private, mobile or stationary, except in the COMELEC common
posted areas and/or billboards, at the campaign headquarters of the candidate or political
party, organization or coalition, or at the candidate's own residential house or one of his
residential houses, if he has more than one: Provided, that such posters or election
propaganda shall not exceed two (2) feet by three (3) feet in size. (Emphasis supplied)

He states that the prohibition of the posting of decals and stickers in “mobile” places like
cars and other vehicles is violative of Section 82 of the Omnibus Election Code and Section
11(a) of RA 6646.

As there is a ban on radio, television and print advertisements, and being a neophyte in politics,
Adiong states that he will be affected by the prohibition as the posting of decals and stickers
would be his last medium to inform the public of his candidacy.

ISSUE
1) Whether or not the COMELEC may prohibit the posting of decals and stickers on "mobile"
places, public or private, and limit their location or publication to the authorized posting areas
that it fixes.

HELD
1) No

The prohibition by COMELEC is censorship and is null and void based on Constitutional
grounds.

The Court held that the prohibition infringes on the citizen’s fundamental right of free speech as
there is no substantial public interest present to warrant the restriction in this case. The
posting of decals and stickers in mobile places poses no danger to government interest and does
not threaten public interest.

Also, where freedom to speak by a candidate or party and freedom to know on the part of the
electorate are invoked against actions intended for maintaining clean and free elections, the
police, local officials and COMELEC, should lean in favor of freedom.
