REFUND POLICY
1. Overview

Wentworth Institute of Higher Education Pty Ltd (“Wentworth Institute”) fully complies with the Education Services for
Overseas Students Act 2000 (ESOS Act) and its legislative framework including the Tuition Protection Service (TPS).

Under Sections 47D and 47E of the ESOS Act , the written agreement with the student outlines the various circumstances
under which a refund can be made and the amount due.

Circumstances when a refund will NOT be made are as follows:


1. There is no refund of the enrolment fee.
2. There is no refund of any deposit paid; that is, an amount paid which is less than one full semester’s tuition fee; for
example $4,500 deposit (except in the case of visa refusal – see below).
3. There is no refund if the student defaults under any of the following circumstances:
 Not starting on the agreed day and location (and has not previously withdrawn).
 Breaching a condition of his/her visa.
 Cancellation or suspension of enrolment following a finding of misconduct.

2. Refunds

All refund applications will incur a $200 administration fee.


1. If a student’s visa is refused prior to the commencement date, Wentworth Institute will refund course fees paid minus
the lesser of:
a. 5% of the amount of course fees received by Wentworth Institute in respect of the student before the default
day;
b. $500.
2. If a student’s visa is refused after course commencement, Wentworth Institute will refund the unused tuition fee.
3. In the event of a student withdrawing from a course or study period and the student has paid at least one full
semester’s tuition fee, an application for a refund must be made in writing to Wentworth Institute.
a. If the notice is received by Wentworth Institute at least 28 days before the course or study period starts,
Wentworth Institute will refund 80% of tuition fees paid for the course or study period.
b. If the notice is received by Wentworth Institute prior to, but less than 28 days before the course or study
period starts, Wentworth Institute will refund 50% of tuition fees paid for the course or study period.
c. If the notice is received by Wentworth Institute on or after the course or study period starting date, no refund
will be made.
If an exceptional circumstance exists, Wentworth Institute may consider an application for a refund on a case by case
basis.
4. Refunds will be paid:
a. within 4 weeks after the day of default in the case of visa refusal (or where Wentworth Institute has not
entered into a written agreement with the student) or
b. within 4 weeks from when Wentworth Institute receives a written claim from the student.
5. Refunds must be paid either to the student or the person specified in the agreement between Wentworth Institute
and the student.
6. In the event of Wentworth Institute defaulting*, Wentworth Institute will advise the student in writing of their default
and how they intend to fulfil their obligations under the ESOS Act. Within 14 days of the day of default, the:
a. total unexpended tuition fee may be refunded to the student; OR
b. Wentworth Institute may offer an alternative (replacement) course or part of a course in accordance with
subsection 46D(4). The student must advise in writing within fourteen days whether he or she accepts this
arrangement.
In circumstances where a default has occurred and Wentworth Institute cannot satisfy their obligations, the TPS
Director will be advised. The TPS Director will then invite relevant providers to participate in a placement round.
* If a provider ceases to offer a course or courses before the student has finished the course, this is ‘provider default’
under the Education Services for Overseas Students Act 2000. The default date is the date Wentworth Institute
stopped providing the course. Provider defaults can include the course not starting on the agreed starting day; the
course ceasing before it is completed, or the course not being provided in full to the student, and the student having
not withdrawn before the default day.

3. General

This fees refund policy does not remove students’ rights to take further action under Australian Consumer Protection laws.

Education Program Agreement

2. Refund Policy

I. Overview

Wentworth Institute of Higher Education (“Wentworth Institute”) fully complies with the Education Services for Overseas Students

4. Processes for claiming a refund

• Fill in a “Request for Refund Form”. This can be emailed to the student on request or collected from Reception.

5. Deferral of studies by international students

This may be permitted only in compassionate or compelling circumstances such as serious illness, death in the family or for
some other such reason. Students will be required to provide evidence of the compassionate or compelling circumstances.
You may only defer your course to the next available intake and fees apply. If the deferral request is received before the start
of the course, student must pay a $200 deferral fee. If the deferral request is received during the first semester, but before the
start of the second semester, the student must pay $600. If the deferral request is received after the second semester, the
tuition fee for one semester will be charged as the deferral fee.

Deferral and suspension of enrolment can have an effect on a student’s visa as a result of changes to enrolment status.
Please contact the Department of Immigration and Border Protection (DIBP) on 131 881 to see if this will affect you.

Students who have not yet commenced their studies will also need to contact DIBP in case there is any effect on their student
visa as a result of changes to enrolment or CoE status.

6. Code of Behaviour

While you remain a student at Wentworth Institute, it is your responsibility:

• To conduct yourself in a safe and healthy manner


• To refrain from smoking anywhere in the Institute building
• To attend class regularly and punctually
• To ensure no discriminatory, harassing or bullying behaviour to other students, staff or visitors to the institute.
• To refrain from unacceptable behaviour, including the use of bad language, alcohol and drugs
• To refrain from the use of devices which may disrupt classes e.g. mobile phones
• To not uphold the Code of Behaviour will result in the cancellation of enrolment. Erratic attendance and erratic
progress will identify as a non bona-fide student and are grounds for the cancellation of your enrolment (Standard 13,
National Code).
• To understand that no certificate or transcript will be issued if there are any monies owing
• To not provide false or misleading information to receive a student visa. If you do, you will be reported to the Department
of Immigration and Border Protection as a non-genuine student.

7. Course content may vary from that advertised, without further notice.

8. Statement of Privacy

It is an Australian Government requirement that WIN keep records of each student's current residential address (as supplied
by the student), the student's full name, date of birth, nationality, the start and completion day of the student's course,
attendance and academic performance records, details of payments received, information on International student health
cover, level of English language proficiency and the student’s passport and visa numbers. These records are confidential and
available to you on written request. Your personal information may be made available to Commonwealth and State Agencies.

take further action under Australia's Consumer Protection laws.
