II. OFFER

This Judicial Affidavit of QUEENCEL MAE MASAOY-CHUA,


who is the mother of Jurielle Dhave Chua, is executed to serve
her direct testimony in the instant case.

This Judicial Affidavit is being offered to prove and testify


the following:

A.) All the allegations in the complaint including all annexes


appended thereto and which were already marked as
exhibits in the case;

B.) That the Spouses Chua incurred expenses for the funeral
and cremation of their son;

C.) That Jurielle Dhave Chua was performing academically


well and a student of good moral standing in school;

D.) That Jurielle Dhave Chua was a physically fit young man
at the time of his demise;

E.) That they suffered mental and psychological sufferings


due to the untimely death of their son.

III. JUDICIAL AFFIDAVIT PROPER

I, QUEENCEL MAE MASAOY- CHUA, 31 years old, Filipino,


married to Ivan Chua, and a resident of #50 Lower Bonifacio
St., Baguio City, Philippines, under oath, hereby depose and
state:

PRELIMINARY STATEMENT

That in accordance with A.M. No. 12-8-8-SC, which


prescribes the use of judicial affidavits to serve as the direct
examination testimony of the witness, on the basis of which
the adverse party may conduct their cross examination on

such a witness, I hereby execute this judicial affidavit in a
question and answer format;

That conformably with Section 3 (b) of the said A.M. No.


12-8-8-SC, I, also state that it was Atty. Jorielle Dave G. De
Guzman of DG and ASSOCIATES LAW FIRM who conducted
the examination;

That conformably also with Section 3 (c) thereof, I hereby


state under the pain of perjury that in answering the question
asked of me, as appearing herein below, I am fully conscious
that I did so under oath, and that I may face criminal
liabilities for false testimony or perjury;

AND UNDER OATH, AVERS THE FOLLOWING:

1.) Q: What is your relation to Jurielle Dhave Chua?


A: I am his mother.

2.) Q: Can you tell me on what happened to Jurielle?


A: He died of a car accident while participating in a
marathon.

3.) Q: Showing to you this death certificate (handing the


document), there is a name written on this certificate, who is
this?
A: Jurielle Dhave Chua, my son.

4.) Q: I am marking this “Death Certificate” as Exhibit “D”


as part of your judicial affidavit; do you conform to my
action?
A: Yes, sir.

5.) Q: What expenses, if any, did you incur in connection


with your son’s death?
A: My husband and I incurred funeral and cremation
expenses in the amount of P120, 000.00.

6.) Q: Do you have receipts to show that you incurred those


expenses?
A: Yes sir.

7.) Q: Showing to you this funeral service receipt (handing
the document), what relation does it have to the funeral
service receipt that you mentioned?
A: That is the one, sir.

8.) Q: I am marking this funeral service receipt as Exhibit


“E” as part of your Judicial Affidavit; do you conform to my
action?
A: Yes sir.

9.) Q: There is a name written on this receipt, who is this


person?
A: He is my husband, Ivan Chua, sir.

10.) Q: How old was your son when he died?


A: He was 17 years old, sir.

11.) Q: What was he doing in life?


A: He was a student of Saint Louis University.

12.) Q: What was his course?


A: Electrical Engineering, sir.

13.) Q: How would you describe Jurielle’s academic


performance in school?
A: He is performing well sir. He has been receiving high
grades in school.

14.) Q: Showing to you this Official Transcript of Records


(handing the document), can you confirm that this is the
transcript of records of Jurielle Dhave Chua issued by Saint
Louis University?
A: Yes, sir.

15.) Q: I am marking this “Official Transcript of Records” as


Exhibit “H”, do you conform to my action?
A: Yes, sir.

16.) Q: Does he have further academic accolades?


A: Yes, sir. He has two dean’s list certificate.

17.) Q: Showing to you this certificate (handing the
document), can you confirm that this one of the certificate
you mentioned?
A: Yes, sir.

18.) Q: I am marking this “Dean’s List Certificate for 1st


Semester S.Y. 2018-2018” as Exhibit “F” to form part of
your Judicial Affidavit; do you conform to my action?
A: Yes sir.

19.) Showing to you this certificate (handing the document),


can you confirm that this is another one of the certificate
you mentioned?
A: Yes, sir.

20.) Q: I am marking this “Dean’s List Certificate for 2nd


Semester S.Y. 2018-2018” as Exhibit “G” to form part of
your Judicial Affidavit; do you conform to my action?
A: Yes sir.

21.) Q: How about Jurielle’s character standing in school?


A: He was a student with good moral standing. I was
given a certificate by the school.

22.) Q: Where is this certificate you mention?


A: This is it, sir. (handing over a document)

23.) Q: I am marking this Certificate of Good Moral Standing


as Exhibit “I” to form part of your Judicial Affidavit. Do you
conform to my action?
A: Yes, sir.

24.) Q: Does he engage in other activities outside of school, if


any?
A: Yes, he frequently joins national competitions for Arnis.

25.) Has he joined any competition for Arnis recently?


A: No, but he joined an eighteen- day training seminar for
the sport last June.

26.) Q: Did he finish the training seminar?


A: Yes, he received a certificate after.

27.) Q: Where is this Certificate you mention?
A: This is the one, sir. (handing over a document)

28.) I am marking this “Certificate of Participation” as Exhibit


“J” and attaching it to your judicial affidavit to form part of
it. Do you confirm my action?
A: Yes, sir.

29.) Q: How can you describe your son at home?


A: He is a loving son. He has so many dreams in life. A
responsible kid who puts so much dedication in his
schooling since he really wants to become an Electrical
Engineer.

30.) Q: What is the effect of your son’s death to you and your
family?
A: We suffered great pain, mental and psychological
sufferings. We had great hope for our only son that he
will finish his course and have a bright future.

31.) Q: For the meantime, I do not have further questions, do


have any statements to add or take away on this affidavit?
A: I don’t have for the meantime sir.

32.) Q: Were you threatened, promised or bribed to do this


confession?
A: No sir. I made it voluntarily with my own free will.

33.) Q: Are you willing to sign this affidavit consisting of nine


(9) pages, to certify that all the statements you made are
true?
A: Yes sir.
