ANSWER

COMES NOW, the defendant, through the undersigned counsel and

unto this Honorable Court, most respectfully avers:

1. That he ADMITS the contents of paragraphs 2 and 3 only insofar as

his personal circumstances are concerned.

2. That he ADMITS his obligation of paying the item bought cited in

paragraph 3 and 4.

3. That the defendant made use of the plaintiff’s delivery services to

deliver the bike to his residence.

 4. That the item was delivered on the 20th of September, roughly a month
after the product was bought by the defendant.

5. That after inspecting the product, the item had a defect on its wheel as
provided in “ANNEX A”.

6. That the defendant, having already planned a month long trip with his
family to the United States, decided to settle the matter once they have
come back from the trip.

7. That the trip would be from the 25th of September to the 25th of October
as shown from their flight tickets in “ANNEX B”.

8. That the defendant admittedly forgot about the issue of the defect due
to their travel.

9. That the defendant ADMITS the content of paragraph 5 and 6 of the

complaint.

10. That the defendant DENIES the content in paragraph 10

believing that the warranty takes effect the moment the item was in his
possession, which was on the 20th of September, therefore making the
warranty period end on the 20th of November 2018.

WHEREFORE, the defendant respectfully prays that the complaint be

dismissed with cost against the plaintiff.

Other relief and remedies as may be deemed just and equitable under
the premises are likewise prayed for.
