Preliminaries

1. This Judicial Counter -Affidavit is in Bisaya (with English

translation), a language known to and understood by the
complainant.
2. The complainant is AIZA C. PEREZ,, Filipino, of legal age, single
and a resident of Purok 20, Barangay Poblacion, Prosperidad,
Agusan del Sur.
3. The Judicial Affidavit-Complaint of AIZA C. PEREZ is given on
the 2nd day of April 2019 before Pros. Tito O. Apura, Patin-ay,
Prosperidad, Agusan del Sur.

(I am executing this Affidavit to answer the complaint of Imprudence

Resulting in Homicide, Physical Injury and damage to property filed against
me by ULDARICO ZAULDA ZABALLLERO)

(Who is this ULDARICO ZAULDA ZABALLLERO)
A: Siya ang driver sa motorcycle nga ning bangga sa akoang motor
niadtong November 30, 2018 sa Purok 4, Barangay San Jose, Sta.
Josefa, Agusan del Sur.
(He was the driver of a mortorcycle that bumped my driven motorcycle on
November 30, 2018 at Purok 4, Barangay San Jose, Sta. Josefa, Agusan del
Sur)

3. Q: Unsa man imong masulti sa iyang alegasyon nga wala daw ka nag
tan aw sa dalan pag tabok nimo mao nang nabanggaan nimo ang ilang
gisakyan nga motor?
(What can say about his allegation that you did not look in opposite
directions when he cross the road which made you bump their
motorcycle)
A: Kana dili tinoud og akong ipang himakak.
(That is not tru and I deny it)

4. Q: Unsa man diay tinuod nga nahitabo kung imong nadumduman?

(What was the true incident if you can remember?)
A: Nga niadtong November 30, 2018 at Purok 4, Barangay San Jose,
Sta. Josefa, Agusan del Sur, diha sa crossing nga dalan buot ako mo
tabok sa pikas dalan nga dili sementado. Sa wala pa ko naka dayon og
tabok nag tan aw ko sa duha ka bahin sa sementadong karsada kung
naa bay padulong. Wala man koy nabantayan nga sakyanan mao tong
ni padayon ko og tabok. Adtong ang atubangang ligid sa akong motor
ning dapat na sa road shoulder sa tabok nga dalan, Nakita nako ang
motr nga gi maneho sa complaianant apil ang mga nag sakay niya,
padulong sa akoa nga pirte ka kusog ang dagan. Wala siya ka likay sa
akoa mao nang nibangga iyang motor satuong bahin sa kaong motor
og kami nalabay sa lain laing direksyon.

 (That on November 30, 2018 at Purok 4, Barangay San Jose, Sta. Josefa,
Agusan del Sur, in a crossroad I intended to go to opposite uncemented road
with my motorcycle. Before I cross the cemented road going to opposite
uncemented road, I look from opposite directions if there was any vehicle
approaching. When I saw nothing, I cross the road. When my front wheel
touched the shoulder of the next pavement, I saw a motorcycle driven by
complainant together with his backrides,approaching to me and he was
travelling very fast. When he was not able to evade me, and he bumped the
right side portion of my motorcycle. And all of us tossed in different
directions.

5. Q: Unsa may imong ebidensya nga sila ang ni bangga sa imo?

(What is your evidence to prove that they were the one who bumped you?)
A: Mapa kita nako ang hulagway sa among mga motor. Ang akong
motor walay guba sa atubangan, ang damage naa diha sa lubot nga
bahin. Ang motor sa complainant naay guba sa unahan bahin sa iyang
motor. Kung ako ang nibangga sa ila, ang langpot tana sa ilang motor
didto gawas dalan. Pero kung Makita nato sa picture nga ilang gi
submit, ang motor nga pula nagpabilin sa dalan nga iyang gi subay.
(I can show you the picture of our motorcycles. My motorcycle has no
damage in the front side, but all in the back portion/side. The motorcycle of
the complainant has sa damage in its frontside. If I was the one who bumped
them, their red motorcycle should be tossed outside the road. However, we
can see in the picture they submitted, the red motorcycle remains in the
pavement it was plying.)

A: Wala na sa pagka karon, kung naa man koy idugang, ako ra isulti
panahon sa hearing
