CONTRACT OF LEASE/PRENDA

KNOW ALL MEN BY THESE PRESENTS:

This CONTRACT OF LEASE is made and executed at the Davao Oriental,


this April 16, 2019, by and between:

MILDA L. SAGOMBA, of legal age, widowed, Filipino, and with


residence at Brgy. Tomoaong, Tarragona, Davao Oriental, LESSOR.

-AND-

ESTERLITA T. CASAMINO, of legal age, married, Filipino and with


residence at Brgy. Cabagayan, Tarragona, Davao Oriental as LESSEE.

WITNESSETH; That

WHEREAS, the LESSOR is the lawful owner and possessor of parcel of


land located at Tamboang, Brgy. Lucatan, Tarragona, Davao Oriental,
the parcels are particularly described as follows;

Location : Tamboang, Brgy. Lucatan, Tarragona, Davao Oriental
Boundaries: North Lot: a public land
East Lot claimed by Magaling Malipwas
South Lot claimed by Ruperto Paan
West by a public land

Area: more or less FIVE (5) hectares

WHEREAS, the LESSOR agrees to lease-out the same parcel of land to the
LESSEE;

WHEREAS, the lessor desires to lease-out the same parcel of land and the
LESSEE desires to lease the same;

NOW THEREFORE, for and in consideration of the foregoing premises, the


LESSOR leases out unto the LESSEE and the LESSEE hereby accepts
from the LESSOR the LEASED premises, subject to the following:
TERMS AND CONDITIONS

1. PURPOSES: That premises hereby leased shall be used exclusively by


the LESSEE for purposes not contrary the nature of the property. It is
hereby expressly agreed that if at any time the premises are used for other
purposes, the LESSOR shall have the right to rescind this contract without
prejudice to its other rights under the law.

2. TERM: This term of lease is for 3 years, starting from April 16, 2019 to
April 16, 2022. Renewal depends on the subsequent agreement of the
parties

3. LEASE-RATE: The payment of the lease shall be in Philippines


Currency or pesos: ONE HUNDRED SIXTY THOUSAND PESOS (160,000
php)

4. PAYMENT: That the LESSEE shall pay to the LESSOR upon signing
of this contract.

5. IMPROVEMENTS: The lessee shall have right to make reasonable


improvements on the area covered by the lease contract. Further, the
lessee has all the right to use and enjoy the improvements.

6. LESSOR'S RIGHT OF ENTRY: The LESSOR or its authorized agent


may enter the property for as long as the entry thereof does not impinge of
the right of the lessee to use or enjoy the property.

7. This CONTRACT OF LEASE shall be valid and binding between the


parties, their successors-in-interest and assignees of the LESSOR..

both the lessor and the lessee.

This instrument consisting of 3 page/s, including the page on which this


acknowledgement is written, has been signed on each and every page
