I. The BUSINESS EDUCATION COUNCIL of the College of Business Education


Department is applying for re- accreditation for the Academic School Year 2018-
2019.

II. Attached herewith are the Business Education Council Students Constitution
and By-Laws, Proposed Activities and Budget, List of Officers and Founding
Members, Accomplishment and Financial Report.

BUSINESS EDUCATION COUNCIL

PREAMBLE

We, the members of the Business Education Council of the University of


Saint Anthony, bound by our sincere commitment and dedication to serve and work for
the benefit and welfare of the Business Education students, academe and its members,
with the guidance of the Divine Providence do hereby ordain and promulgate this
Constitution and By-Laws.

ARTICLE I

NAME AND ADDRESS

SECTION 1. The name of this organization shall be Business Education Council, College
of Business Education, University of Saint Anthony, Iriga City.

ARTICLE II

OBJECTIVES

SECTION 1. To protect and promote the welfare of the students, academe and its
members through coordinated programs and projects; and

SECTION 2. To uphold the financial interest of the organization through proper and
transparent accounting.

SECTION 3. To realize these, the organization will:

a. Strengthen the bond among its members, officers and faculty members, thus
work out plans that will promote the quality education by extending hands to
projects and programs of the College of Business Education in particular and
the College Department as a whole.

b. Organize and conduct seminars, workshops, training and the like to enrich
the students’ knowledge, skills and understandings concerning modern
business environment.

c. Provide minimal assistance to the different activities to be undertaken by the


department.

ARTICLE III

NATURE AND SCOPE OF THE ORGANIZATION

SECTION 1. This organization shall be non-political, non-sectarian and non-partisan.

SECTION 2. Its activities shall be devoted towards the promotion of the welfare of the
students, academe, its members and the general public as a whole.

SECTION 3. This organization shall be exclusively composed of all Business Education


students currently enrolled at the University of Saint Anthony.

ARTICLE IV

MEMBERSHIP

SECTION 1. Membership of the organization shall be compulsory to all bona fide


students of Business Education courses namely: Bachelor of Science in Accountancy,
Bachelor of Science in Business Administration, Bachelor of Science in Computer
Science, Bachelor of Science in Hotel and Restaurant Management, Bachelor of Science
in Office Administration, and Bachelor of Science in Tourism Management who are duly
enrolled at the USANT, Iriga City.

SECTION 2. Duties and Obligations of Members

a. Participate in the activities of the organization.


b. Promote the objectives and purpose of the organization as provided in Article
II of these by-laws.
c. Obey these by-laws, rules and regulations, policies and decisions
promulgated by the Business Education Council
d. Pay the fees and other dues prescribed by the organization as per approved
by the University President.

SECTION 3. Rights and Privileges of Member

a. Attend and participate in the deliberations during meetings;


b. Vote in all matters brought before such meetings;
c. Seek any elective position subject to the provisions of these By-laws;
d. Inspect and examine internal records such as the books of account, minute
book and other records of the organization during office hours with
permission from the BEC - Department Officers and/or the officer in charge;
and
e. Exercise other rights and privileges of a member.

SECTION 4. Policy on attendance, tardiness and absences during organizational


meetings and activities.

a. Officers and members of the organization who fail to attend organizational


assemblies and activities shall be charged with corresponding fines and
sanctions, as enumerated below:

1. An amount of One Hundred pesos (Php100.00) shall be collected from


any officer who fails to attend regular meetings, assemblies or activities.
Penalty fee for organizational members is Fifty pesos (Php 50.00)
2. Those who incur three (3) consecutive absences or a total of five (5)
absences within the school year shall automatically be removed from the
roll of officers or members.

b. Once terminated, the officer or member shall not be entitled to enjoy the
privileges of being part of the Business Education Council.

c. Excuses shall be deemed as valid if and only if pertinent documents will be


presented by the concerned officer or member. In case of emergencies or
unexpected circumstances, officers and members shall be given a maximum
of three days after the conduct of meeting or activity to explain and present
valid excuse letters. Failure to do so leave the organization with no choice
but to mark them absent.

d. Aside from checking the attendance, the task of recording the time of arrival
of all officers and members during meetings and activities is entrusted to the
secretary. Summary of attendance and absences shall be presented to the
organization before the end of the school year, preferably during the last
assembly. Moreover, a monthly report of the total collection accumulated by
the organization from fines shall be given by the treasurer. This will be added
to the organizational fund to finance its programs and activities.

ARTICLE V

ORGANIZATIONAL STRUCTURE

SECTION 1. Department Officers are composed of active members of the organization


duly elected during the Election. The set of officers are (a) President (b) Vice-President
for Internal (c) Vice-President for External (d) Secretary (e) Treasurer (f) Auditor (g)
Business Managers (h) Public Information Officer.

SECTION 2. Academic Organization Representatives – This body is composed of


active members of the organization in their respective course and majors. The
Organization Representatives were the Presidents of each accredited organization under
the College of Business Education.

SECTION 3. Organization Adviser – The organization shall have at least one (1)
adviser duly appointed by the Dean of the College of Business Education. His/her
function is to guide the BEC - Department Officers in planning, implementing and
evaluating the programs and services of the organization.

SECTION 4. Organization Consultant - The Dean of the College of Business


Education serves as the organization’s consultant.

SECTION 5. Election and Term of Office - All the nine (9) BEC - Department Officers
shall be elected at large during the Ballot System of Election as provided in these by-
laws.

ARTICLE VI

OFFICERS AND FUNCTIONS

SECTION 1. President- The President shall be the Chief Executive Officer of the
organization and shall have administration and direction of the day-to-day affairs.
He/she shall exercise the following functions:

a. To preside overall meeting of the organization;


b. To initiate and develop objectives, policies, formulate long-term plans and
programs, training for the approval of the BEC-Department Officers, Dean,

President.
c. To have the general provision and management of the business affairs and
property of the organization;
d. To ensure that the administrative and operational policies of the organization
are carried out under his supervision and control;
e. To foresee the preparation of the budget and the statement of account of the
organization subject to the approval of the BEC-Department Officers;
f. To represent the department in functions and proceedings;
g. To sign all funds and such other papers or documents of the organization
which the BEC-Department Officers may authorize him/her to sign; and
h. To execute in behalf of the organization all agreements affecting the interest
of the organization requires the approval of the BEC - Department Officers.

The President however, may assign the exercise or performance to any other
officers subject to his supervision and control.

SECTION 2. Vice Presidents – External and Internal. In the absence and disability of
the President, the two Vice-Presidents if qualified shall perform the functions of the
President. They shall perform such other duties, as may from time to time assigned to
them by the BEC-Department Officers or by the President.

SECTION 3. Secretary - He/she shall maintain book and records, recorder of the
organization’s formal action and transactions. He/she shall have the following specific
power and duties:

a. To record and see the proper recording of the minutes, transactions of all
meetings of the general assembly and BEC-Department Officers and to
maintain minutes of such meeting in the form and manner required by the
organization or law, if any;
b. To attend to the giving and serving of the notices required by this
organization and this by-laws;
c. To certify to such acts, countersign and make report or statements as may
be required by the BEC-Department Officers, General Assembly or by the
University’s rules and regulations;
d. To turn-over to his/her successor all books and other properties in his/her
possession belonging to the organization;
e. To attend to the proper documentation of the projects and activities of the
organization;
f. To keep the updated list of members and funds of the organization; and
g. To perform such other duties as are incident to his/her position as may be
assigned to him/her by the BEC-Department Officers or the President.

The Secretary may assign the exercise or the performance of any or all of the
foregoing duties, powers and functions to any other person/s subject always to his/her
supervision and control.

SECTION 4. Treasurer - The treasurer shall be the custodian of BEC-Department


Officers’ funds and properties. The treasurer shall have the following duties:

a. To have custody of and be responsible for all funds and properties of the
organization, under his/her control;

b. To keep full and accurate account of receipts and disbursements in the books
of the organization;
c. To deposit in the name and to the credit of the organization in such bank as
may be designated from time to time by the BEC - Department Officers, all
the monies, funds and similar valuable effects to which may come under
his/her control;
d. To make prompt payment and disbursement of all expenses authorized by
the BEC – Department Officers;
e. To render a semester statement showing the financial condition of the
organization to the BEC – Department Officers and as the President may
require from time to time;
f. To turn-over to his/her successor all books and accountable documents and
properties in his/her possession belonging to the organization; and
g. To exercise such other powers and perform such other duties and functions
as may be assigned to his/her by the President or the BEC - Department
Officers. The treasurer has also the power to delegate but always to his/her
supervision and control.

SECTION 4. Auditor – The auditor shall audit the treasurer’s financial accounts from
time to time and check the existence of all properties of the organization every
semester.

SECTION 5. Business Managers – It shall be the duty of the Business Managers to


do the following:

a. Supervise all the activities of the organization;


b. Render report for every official business closed for the organization
particularly during the regular BEC-Department meetings;
c. Propose and submit budget of the activities with the approval of the
President; and or by the President. The Business Managers have also the
power to delegate but always to his/her supervision and control.

SECTION 6. Public Information Officer – It shall be the duty of the Public


Information Officer to do the following:

a. Promote good relations between the department and the entire USANT
community;
b. Disseminate information of plans, programs, policies and important activities
of the Department and keep records of the disseminated information;
c. And perform such other related duties as the BEC - Department Officers may
assign to him/her.

SECTION 7. Representatives/Organization Presidents – It shall be the duty of


the representatives to do the following:

a. Represent their respective organization in the BEC - Department meetings;


b. Responsible for the dissemination of information or agenda presented in the
BEC - Department meetings in their respective organizations;
c. Supervise activities of the organization they belong; and
d. Perform other duties assigned by the President and other BEC -Department
Officers

SECTION 8. Accountabilities – All documents, files, monies, properties and the like
under the responsibilities of all accountable officers shall be turned over to the
succeeding officers as soon as the latter shall have been installed and qualified.

ARTICLE VII

MEETING

SECTION 1. General Assembly Meeting – The general assembly meeting of the


organization shall be twice in every school year. The first meeting shall be done within
the first month after the enrollment period during the first semester and the other one
shall be held within the first month after the enrollment on the second semester.

SECTION 2. Regular Meeting – The regular meeting of the organization shall be held
at any available room in the University agreed upon by the body EVERY FIRST TUESDAY
OF THE MONTH.

SECTION 3. Special Meeting – The special meeting of the organization for any
purpose or purposes, may at any time be called by the following: (a) President of the
organization; (b) three fourth (3/4) of the BEC-Department Officers; (c) three-fourth
(3/4) of the total membership; or at its own instance, at the written request of the
members representing the majority shall be called as for the need arises.

SECTION 4. Place of Meeting – All meetings whether regular or special shall be held
at any available room in the University agreed upon by the body.

SECTION 5. Notice of Meeting – Notice of the general assembly meeting may be


sent by the Secretary and the Public Information Officer by posting announcement on
the bulletin board of the College of Business Education, SGO Building.

SECTION 6. Quorum – Unless otherwise provided by the law, general, regular or


special meeting, a simple majority, shall constitute a quorum. If no quorum is
constituted, the president and/or a motion to adjourn the meeting are in order until the
requisite is met/or following the parliamentary procedures regarding quorum or
adjournment.

SECTION 7. Conduct of Meeting – All meeting shall be presided by the President or


in his absence by any of the Vice- Presidents, or if none is available, an Acting Presiding
Officer to be chosen from among the remaining members by the BEC – Department
Officers or in case of General Assembly, from among the members present in the
meeting. The Secretary shall act as secretary in every meeting. The President may
adjourn the meeting from time to time without notice other than announce it in the
meeting.

ARTICLE VIII

ELECTION

Election of the organization’s Departmental Officers shall be done before the


start of the next semester or before the end of the second semester of the present
school year. The outgoing BEC Officers will facilitate the election for the new set of
Departmental Officers. All Business Education students are qualified to vote and to be

voted provided upon that two (2) line up of party lists must exist in which those who will
be running in the positions President and Vice-Presidents shall be fourth year students,
and the remaining slots shall be open to students at all levels.

SECTION 1. Qualifications and Disqualifications of BEC-Department Officers –


All members who have time, capabilities and willingness to serve are qualified to vote
and be voted upon as BEC – Department Officers except those who are under any of the
following circumstances, which disqualify them to be voted upon, to wit:

a. Having conflicting interest with the activities, affairs and business of the
organization.
b. Grade requirements for the candidates for the positions President, Vice-President
External and Internal, Secretary and Treasurer shall at least have a weighted
average of 1.90 in preceding semester.

SECTION 2. Manner of Voting – All Business Education students except fourth year
level are qualified to vote and participate. Election of the Departmental officers will be
done before the start of the semester or before the end of second semester of the
present school year and shall be conducted by ballot system. The faculty members of
the department will facilitate the election. No member shall be entitled to vote for more
than one.

SECTION 3. Election Committee – Faculty members of the College of Business


Education will be the Election Committee and will facilitate the election.

ARTICLE IX

FINANCES

SECTION 1. Semester Fee – An annual fee of One Hundred Pesos (P100.00) shall be
paid to the organization by all members. The Department Treasurer will do the collection
at the Dean’s Office. Mode of Payment: Twenty Five Pesos (P25.00) shall be paid before
pre-lim, midterm, pre-final and final examinations.

SECTION 2. All funds are subjected to the general rules and regulations of accounting
and auditing procedures.

SECTION 3. Fund Signatories – The organization authorities, BEC – Department


President, Adviser and the Dean of the College of Business Education are the official
signatories of funds. Likewise, funds or financial assistance allocated/appropriated to
Business Education Department shall be under the joint account of the Dean of the
College of Business Education and the BEC-Department President & Treasurer, they shall
be accountable to the organization.

SECTION 4. The Venture - The College of Business Education aims to produce quality
students who could compete in the modern business world. Student publication is one of
the training to develop communication skills for self and corporate employment. With
this, the Business Education Council as the official department organization will sponsor
the funding and expenses of the student publication of the department. An annual issue
of The Venture will be provided to each member. The source of funding and expenses
will be taken from the membership fee and annual dues.

SECTION 5. Alay Sa Kapwa Funds – The organization will contribute five pesos
(Php5.00) from each student intended for the Alay Sa Kapwa Fund of the University of
Saint Anthony and shall be turned over to the Office of the University President on the
second semester.

ARTICLE X

CORPORATE SEAL

SECTION 1. Form – The corporate seal of the organization shall be in such form and
design as may be determined by the BEC – Department Officers.

SECTION 2. All official documents of the organization should always bear the seal.

ARTICLE XI

AMENDMENT

SECTION 1. The BEC – Department Officers in regular or special meetings shall


convene the Organization Adviser to study any proposed amendments or revisions.

SECTION 2. The BEC – Department Officers shall invite all Organization Presidents
under the BEC to constitute as representative assembly for pre-ratification, revision
and/or amendments.

SECTION 3. These by-laws may be amended by affirmative vote of two-thirds (2/3) of


the members present at the general assembly called for the purpose.

ARTICLE XII

INCLUSION

Section 1. POLICY ON THE PROHOBITION OF SELLING, DISTRIBUTION AND


USE OF ILLEGAL DRUGS

a. The Business Education Council shall work in coordination and in conjunction


with the Council of Student Leaders in the promotion of drug awareness,
prevention and rehabilitation.
b. Consequently, the organization shall include in its action plan every year a
specific activity or program for the prevention of and deterrence in the use of
illegal drugs.
c. Any officer or member of the organization who, beyond reasonable doubt, has
been accused and found guilty in selling, distributing or using illegal drugs
outside or within the school premises shall be reported immediately to the office
of Student Affairs, particularly to the Student Discipline Committee, or to the
proper authorities. Such misdemeanor is another ground for probation,
suspension or termination from his post as an officer or member of the
organization.

Section 2. ANTI-HAZING POLICY

a. Business Education Council, being a pro-student’s welfare campus organization,


strictly abhor the conduct of hazing or any form of initiation rites as part of the
admission requirements, nor does it tolerate embarrassing, traumatic, humiliating
situations such as forcing the students to do menial, silly, foolish and other
similar tasks or activities.
b. In like manner, the organization shall protect and safeguard its members from
physical, verbal or psychological abuse.

ARTICLE XIII

EFFECTIVITY

SECTION 1. This Constitution and By-Laws shall take effect upon ratification thereof.
