This e.g. software, software license(s), smart object, component, application, program code (herein referred to as the
“Software”) is the property of Beijer Electronics AB (“Beijer Electronics”). By installing, copying or in any other way using the
Software you, the software user (the “Software User”), acknowledge and accept the terms and conditions in the end user
license agreement accepted upon downloading of this Software and also available at Beijer Electronics’ Smart Store (the
“EULA”), the terms and conditions stipulated in the purchase order issued by Beijer Electronics to the Software User for the
Software User’s purchase of the Software (the “Purchase Order”), and the terms and conditions in this disclaimer (the
“Disclaimer”). The Software User is solely responsible for ensuring that the use of the Software is compliant with the terms and
conditions stipulated in the EULA and the Purchase Order.

The Software User is entitled to install and use the number of copies of the Software as stated in the Purchase Order.

The Software is made available to the User strictly on an “as is” basis” and it is the sole responsibility of the Software User to
ensure that the Software is used in compliance with all applicable requirements, standards and legislations.

All sales of the Software by Beijer Electronics to the Software User are final. Beijer Electronics will not provide replacement
Software in case of loss, damage or destruction of the Software due to the Software User’s use or handling of the Software.

The Software User acknowledges that it will use the Software at its own risk and bears the entire risk for any damage caused to
computer equipment and/or any other property or equipment (including but not limited to loss of data) when installing, copying or
in any other way using the Software.

Beijer Electronics assumes no liability as regards usage of the Software deviating from the usage provided for in the EULA,
such as, but not limited to, the Software User’s use of the Software contrary to the guidelines and recommended limits
contained in any applicable manual and/or guidelines, in any form, issued by Beijer Electronics for the relevant Software.

Beijer Electronics explicitly excludes any and all warranties in respect of the Software (including information and data provided
in the Software), any defects or errors in the Software, including without limitation warranties of quality, functionality, applicability
and availability, absence of errors or interruptions, loss of data, fitness for the individual Software User’s requirements and non-
infringement of any third party rights except as provided for in the EULA.

Beijer Electronics’ total liability for the Software shall never exceed the amount actually paid by the Software User to Beijer
Electronics for the Software.

The Software User agrees to indemnify Beijer Electronics from and against any loss or damage suffered or incurred by Beijer
Electronics as a result of any, claims, suits, actions or demands, directly or indirectly, from any third party caused by death,
personal injuries, damage to any property or any other losses arising out of or in connection with any breach or non-compliance
by the Software User of this Disclaimer, the EULA, relevant Purchase Order or applicable laws and regulations.

The Software User is aware of and acknowledges that any and all intellectual property rights in or relating to the Software and
components thereof, in whole or in part in any form, are and shall remain the property of Beijer Electronics. Nothing set forth in
this Disclaimer or the EULA shall be construed as a transfer of any intellectual property rights.

By entering into this Agreement, or using the Software, the Software User agrees to the collection, processing, copying, backup
and storage of user telemetry data and other system information, including, without limitation, information related to date and
time of Software usage, Software version, Software features usage, Software actions usage, session length, number of licenses
used, communications drivers used, hardware components, operating system and general system telemetry through the
Microsoft Applications Insight platform (jointly referred to as the “Telemetry Data”). The Telemetry Data shall be used to
operate, provide, improve and develop Beijer Electronics products, services and technologies, including the Software, as well as
for general research and development work. The Telemetry Data collected by Beijer Electronics is anonymized.

Beijer Electronics owns the right to immediately terminate the EULA, should the Software User breach any of the terms and
conditions of this Disclaimer or the EULA.

In case of contradictions between the provisions stated in this Disclaimer and the EULA, the EULA shall prevail.
