WHEREAS, one of the major programs sanctioned not only in our Barangay but also
in our municipality is the maintenance of cleanliness and orderliness and the
promotion of environmental preservation in our community;
WHEREAS, regular cleaning of everyone’s own surroundings and maintenance
thereof is the most basic obligation of everyone but it is also the best way of
keeping the inhabitants and its environment healthy;
WHEREAS, in order to be able to maintain the cleanliness of our surroundings,
proper waste disposal is encouraged and littering should be prohibited and
penalizing anyone who violates is the best way to keep them from doing it.
WHEREFORE, for better implementation of said purpose, be it ordained that;
SECTION I. TITLE
This Anti-littering and Environmental Awareness Act of Barangay Poblacion,
Burgos, Ilocos Norte shall be known as “Awan Rugit Yantoy Aglawlaw POBLACION”
or “ARYA POBLACION”.
SECTION II. OBJECTIVE
The primary objective of ARYA POBLACION is to promote and maintain
cleanliness, orderliness, and environmental awareness of the constituents of
Barangay Poblacion, Burgos, Ilocos Norte and to penalize violation of the same.
SECTION III. IMPLEMENTING PROCEDURES
1. The Barangay Government of Poblacion, from its funds or any other legal
sources, shall provide and install garbage cans on strategic locations
around the Poblacion Proper.
2. The Barangay Government of Poblacion shall also provide for the posting
of placards and other means of information for proper dissemination of
this Act.
3. With the use of the existing Multi-Cab and other possible means, the
Barangay shall sustain proper waste disposal.
SECTION IV. COVERAGE
1 All public places within the Poblacion which include but not limited to;
a. all roads and streets including its shoulders within the Poblacion.
b. all bodies of waters, irrigation canals, and sewerages within the
Poblacion.
c. the Barangay Hall, Magsaysay Park, and all Purok Dap-ayans and
their respective surroundings, and
d. other Barangay-owned or maintained areas.
SECTION V. PROHIBITIONS
1. Throwing of litters on above stated areas is strictly prohibited
2. Dumping of garbage on public or private lots is unsightly and unhealthy
and also, without the permission of the owner, is a violation of property
rights and therefore prohibited.
3. Throwing of all kinds of wastes specially contaminants like dead animals,
human wastes, pesticides, and other hazardous chemicals into bodies of
water is punishable under this Act and other Governing Laws of the Land.
4. Sands, gravels, boulders and other materials dumped or piled on
roadsides are prohibited unless permitted by the Municipal Zoning Officer
but;
a) it should occupy no more than 1/3 of the width of the passable area,
b) it should have reflectorized early warning devices, and
c) it should not stay there for more than 3 days.
SECTION VI. WHAT ARE CONSIDERED LITTERS
1. All manmade wastes as small as a cigarette butt or candy wrapper
improperly disposed is considered litter. Although fallen dried leaves are
not considered litters, they are eyesores if left scattered, any intentional
act to cause leaves to fall is considered littering.
2. Stools of animals like dogs, carabaos, cows, etc. are not only unsightly but
are also unhealthy there considering them litters
3. Cut-down tree branches, twigs and the likes that are left on road shoulders
are also considered litters.
4. Stones, pebbles, or sand scattered on cemented roads are hazardous not
only to motorists but also to bystanders or passersby or nearby structures
thereby considered as litter.
SECTION VII. PENALTIES
1. Anyone caught violating this Act shall be fined as follows:
a. First Offense – the violator shall be immediately be fined the amount
of P10.00 or to render a 30-minute community service and be asked to
clean whatever litter he/she have made and personal information be
noted for future reference.
b. Second Offense- all violators on his/her second offense shall be fined
P25.00 or to render 1 hour of community service and asked to clean
whatever litter he/she have made and personal information be noted
for future references.
c. Third Offense – all violators shall be fined P100.00 pesos or to render
4 hours of community service and be asked to clean whatever litter
he/she have made and personal information be noted.
d. Fourth Offense and Beyond- all violators shall be fined P500.00 or
to render 8 hours of community service for every offense and be filed a
case for his/her culpable violation of this Act and asked to clean
whatever litter he/she have made.
e. Grave Offenses- any act which results or can result in extraneous
hazard are penalized with not less than P500.00 but not more than
P1,000 and be forwarded to higher authorities for proper action
depending on the extent of the resulting effect of the action.
f. When the offender is too young to know about this act, the
person who is with said child when a violation is committed shall be
responsible for the action. If the child is alone, the parents or guardians
shall be notified of said violation and shall be responsible for the
action.
g. All monetary penalties collected shall be issued a
corresponding receipt and shall accumulate in the Barangay
Treasury and shall be used primarily for the implementation of this act
except for those collected by Purok Officials wherein 20% will go to the
Barangay Treasury, and the remaining 80% shall accumulate in the
Purok Treasury which shall be used for any project which is in direct or
indirect support to this act.
