RE:Request for investigation of Amazon Flex for civil and criminal fraud to it’s Flex Delivery Drivers.

Dear Mr. Weisner,

Until June 1st, I was a contract flex driver with Amazon in the Denver area. I had been working for them

since October 16, 2018. From the first month, I began to notice discrepancies in the overtime pay. At first

I attributed it to mistakes and misunderstandings by the support division of Amazon Flex. In March/April

I finally realized that shortages in the overtime payments were not a mistake, but a well planned decision

by Amazon to defraud their Amazon contract delivery drivers. I am not speaking of a few drivers but every

one that delivers for Amazon Flex. That is no small number. Although Amazon does not reveal the number

of drivers they contract with, in 2016 a statistician estimated that there were 15,000 flex drivers in

California alone. If you divide that number into the population of California [39.56M) and then divide that

number [2,637 ] into the population of the US [ 327.2M ] you come up with an estimate of 124,000 flex

drivers across the US and 2,123 in Colorado. Even at a minimum of $10 per day per driver; Amazon and

its’ associates are a corrupted enterprise pocketing over a million dollars a day in fraudulent profits by

manipulating actual overtime-times.

The best way to describe this scheme is by my own experiences. I will first detail a “block” that I delivered

this past Saturday. Although I have never seen it written anywhere, Amazon expects you to deliver a

package every 4 minutes or 15 packages per hour, no matter the circumstances. One important aspect

they leave out is that the time to travel to the 1st delivery from the depot [sometimes exceeding 1 hour

and I had one that was over 2 hours of travel] is counted in the delivery time. In other words, if you

contract out to do a 3 hr block that has 45 packages and it takes you an hour to get to the first delivery;

that only leaves you 2 hours to deliver the 45 packages or one package every 2.6 minutes. That is

impossible. Amazon knows it and takes advantage of it. It happens every day with Amazon drivers. And

when you don’t deliver all the packages, you get a nasty canned text message asking you why and then a

second message that it is going in your file and finally, you are terminated. There is an alternative; and

that is where the fraud takes fruition. Let me interject here that every flex driver I have spoken to has

experienced the same fraud I have………without exception.

DELAYS ATTRIBUTABLE SOLELY TO AMAZON.

Amazon has their own GPS app tied in with the deliveries. It is much slower than commercial GPS’s making

it dangerous and making the route last longer. I have had many experiences where the GPS didn’t tell you

to turn until after I had reached the turn. Or the worst when you are getting off a highway and the GPS

doesn’t tell you which way to turn at the bottom of the off-ramp. Also, the GPS isn’t up to date and you

can go 10 miles out of your way only to find out that the street is no longer in use and is blocked. If you

compare the same route on a commercial GPS to the Amazon GPS, the difference is day and night. I had

done routes where I had to use the commercial GPS to navigate and then switch back to Amazon to make

the delivery to the customer and close it out.

I have been sent to routes near Morrison Colorado where both the GPS and cell phone networks disappear

and you have to drive back 5 miles to pick up the signal again. And the fact of the matter is if Amazon

support can’t see you on their screens [or even if they can]; you are not working and you don’t get paid,

especially if it is overtime.

OVERTIME RATES

If a driver signs up for a 3 hour block for $75 [$25 per hour] then any overtime during that block is the

same rate. In the example above, if a driver works for an extra hour, s/he should receive an extra $25.

REPORTING AN OVERTIME

I have never seen any rules or policies for reporting overtime and no one seems to know for sure. I have

been told by different members of support that I needed to get permission before I went overtime; and

by others that this was not necessary and just report in to support at the last delivery in the overtime; and

by yet others that this was not necessary either and one could just send an email to support reporting the

overtime. WITHOUT EXCEPTION, Amazon never gives the correct payment. It is always short without any

explanation; even with detailed facts provided by the drivers. A driver can escalate the denied pay request

to another team [Jeff@Amazon.com] that send you “feel good” canned responses that Jeff [Bezos] asked

them to look further into the escalation…………….but then nothing happens. I believe their actions are not

honest mistake but are on purpose in order to increase unethical and unlawful profits to the detriment of

the 124,000 drivers.

Amazon operates in a type of criminal enterprise. They beguile every driver out of $20-50 per day and

when you multiply that by the number of drivers………………it works out to millions of dollars each and

every day…….. 7 days per week. If you don’t work the overtime, they say you are breaching the contract

because you haven’t delivered all the packages; and if you work overtime to deliver them, Amazon

commits a fraud by manipulating the times worked and therefore shorts the drivers. We are not

independent contractors when you take into consideration Amazons actions and demeanor when they

manipulates overtime times.

I have included 7 times/examples in the last couple months where Amazon has shorted me on overtime.

The times are verifiable as I called support when I was delivering the last package.

I would request an investigation into Amazon flex for criminal fraud and any other prosecution the AG

feels appropriate.

I have had enough of this. You still owe me for 5 overtimes from before so I decided not
to do overtimes. Last evening there were mostly same day packages so I decided to go
ahead and deliver. [Delay was due to tornadoes and hail] I put in 45 extra minutes and
called support before I did it and again at the end. [I also have those audio calls]
AGAIN, I get a canned email that I did not work the 45 extra minutes even though my
GOPRO proves I did.
I have requested your help getting these payments resolved believing they were a
mistake. I no longer believe that and now have no other recourse but to file an
investigative request to the Colorado Attorney General.
I expect retaliation for this filing and I also know that I am not the only one that has
experienced this fraud on your part.
I really thought you were a legit businessman and am really disappointed

Following is an example where I worked overtime which can be verified by their
GPS delivery records and my conversations with support at the end of the
overtime. I don’t believe they do any investigation. They just decide they are
going to take advantage of the flex driver………………..times 124,000 flex drivers.

Ridiculous findings by Amazon Flex Support

On May 8th I took a 3 hr. block from 5pm to 8pm. It was raining hard and after my 4th or 5th delivery lig
out not only the Amazon GBS App but also the GPS in my car.
I tried for awhile to get it running again with no luck. I then called support to see if they could help; aga
There was nothing left to do but to return to the depot with the packages I had not yet delivered.
That evening, I sent an Email describing the situation:

Called support, reported it but they couldn't get it running again either.
Hung out for 1/2 Hr trying to get it running again with no luck.
Only thing left was to take packages back to depot.

Then I received the "canned" Amazon support team email that I was expected to deliver all the packag

They more or less said that this was not a valid excuse and it would go in my record.

Amazon support is ridiculous and I also think some of them are corrupt.
I have to believe that this is in retaliation for me asking to be paid for my overtime and has nothing to d

I just received a response to my previous E-mail from the Amazon Flex team as follows:

If the Amazon support team would really "investigate" like they indicate they do; they would have found
support, indicated that they couldn't figure it out, and couldn't see me on their maps; and they made the
return to the depot with the packages!!!!

Again, I have to believe that the Amazon Support's ridiculous response to this situation was in retaliatio
overtime pay periods and the funding associated with them that I now believe was purposely shorted.

Over the last couple of weeks I have done overtime for Amazon routes. I have GoPro in my car and I audio tape every conv
