COUNTER-AFFIDAVIT
I, Arnel Romero, Filipino, of legal age, married and with
permanent residence at Emerald St., Goldenville Subdivision,
Cabanatuan City, after having sworn to and in accordance of the law
hereby depose and state that:

1. I specifically deny the allegations of the complainant where he

stated that on October 6, 2014, as per an agreement, I drew to
him a check of Deed of Donation amounting to One Hundred
Thousand and One Pesos (Php 100, 001.00) for payment of their
bill in a local bar in Daan Sarile, Cabanatuan City to which during
that time, we used his credit card as substitute to pay for the said
bill since the aforementioned local bar only accepts cash
payments;

2. Clearly, after perusal of the said check of Deed of Donation, it

can be readily state that my signature is forged. For an obvious
comparison, my specimen signature of my bank deposits are
hereto attached as Annex “A”;

3. Complainant’s claim was not sufficiently established.

His allegation, absent any supporting evidence, is nothing more
than a hollow claim, thus, under the rule that he who alleges a
fact has the burden of proving it as mere allegation is
not evidenced;

 4. I cannot be held liable for Violation of BP 22 because the crucial
element of notice of the dishonor is not present. I have never
been personally and actually notified of the dishonor of the said
allegedly bad check before the private complainant filed the
criminal complaint against me; and

5. I am executing this Counter-Affidavit to attest to the veracity of

the foregoing statement of facts and to rebut the charges
against me.
