ELECTRICAL INSTALLATION WORK FOR FLUOR DANIEL AT GURGAON

SPECIAL CONDITIONS OF CONTRACT


1. GENERAL

The Special Conditions of Contract shall be read in conjunction with Technical specifications,
Schedule of quantities and Drawings.

2. ORDER OF PRECEDENCE

In case of any contradiction between Special Conditions of Contract, Specifications, Schedule of


Quantities and drawings, the order of precedence shall be Schedule of Quantities followed by
specifications, Tender drawings, SCC and followed by GCC.

3. SCOPE OF WORK

The scope of work under this contract comprises Electrical Installation work for Fluor Daniel,
building 10C, DLF Cyber City, Gurgaon. The work shall be carried out and completed under this
contract in every respect in conformity with the current rules and regulations of the local electricity
authority, the Indian Standard Institution, Indian Electricity Rules, National Building Code and with
the directions of and to the satisfaction of the Architect/Consultant. The Contractor shall supply all
labour and supply and install all materials, appliances, equipment (except those items which will be
supplied by Owner to the Contractor at site) necessary for the complete provision and testing of the
whole Electrical Installation as specified herein and shown on the drawings. This also includes any
material, appliances, equipment not specifically mentioned herein or noted on the drawings as
being furnished or installed but which are necessary and customary to make complete installation
with all outlets for power, light, telephone conduits and other electrical systems shown on the
schedule or described herein, properly connected and in working condition. The work shall include
all incidental jobs connected with electrical installation such as cutting/drilling and grouting for fixing
of fixtures, equipment etc.

The brief description of the work to be carried out is as follows :-

a. Conduiting, Wiring and Supply & Fixing of Switch sockets of all light points, workstation outlets,
convenience outlets etc.

b. Conduiting, and raceways for Structured cabling.

c. Supply and installation of MDB, UMDB, DBs and Sub-Main conduiting, wiring & Cabling
including incomer supply for MDB and UPS .

d. Supplying and laying of cabling from DLF Tap Off box to MDB and outgoing Cabling from MDB,
UMDB.

e. Supply and installation of earthing system.

f. Supply and Fixing of lighting fixtures.

g. Supply & fixing of cable trays.

h. Conduiting & wiring for Access Control & CCTV system , Fire Detection & Alarm system.

4. SHOP DRAWINGS

After the work is awarded to the contractor, the contractor shall submit the following shop drawings
(5 sets) for approval from the Architect/Consultant within one week:-

a. G.A. drawing, Schematic Drawing, Control wiring drawing and detailed BOQ for all the
DB and Panels.

b. Earthing pits layout.

c. Block Diagram for Fire Detection and Alarm system, CCTV and Access Control.
5. AS BUILT DRAWINGS

As part of the handing over documents after successful completion of the work, the Contractor shall
submit to the Architect/Consultant AS BUILT drawings drawn at approved scale indicating the
complete Electrical system "As installed". These drawings shall be prepared in Autocad 14 or 2000.
These drawings shall in particular, give the following information:

a. A complete wiring diagram as installed & SLD showing all connections

b. Routing of Conduits, Raceways, Sub main conduiting, Cable Trays, and Earthing
strips/wires.

c. Lighting and Power layouts showing circuit numbers for each light fixture, and socket along
with location of DB’s, Panels etc. Power layout shall also show data/voice outlets and
routing of conduits/raceways upto Hub room/Server room as applicable. Location & rating
of sockets and switches controlling light & power outlets

d. DB charts showing details of all circuits, phase wise distribution along with total load in
each phase ,incoming wire/cable size etc.

e. G.A. drawing of all the Panels along with schematic drawings

f. Earthing pits layout.

g. Fire Detection and Alarm system drawings showing location of all detectors, modules etc.

h. Access control drawings.

6. STATUTORY APPROVALS

After the work is completed it is the responsibility of the contractor to get the Electrical Installation
inspected and approved by the Local Authorities concerned wherever required. Nothing extra shall
be payable for the same. If any modification is required to be carried out as per the comments of
local authorities it shall be carried out by Electrical Contractor at no extra cost. Required statutory
approvals are included in the scope of work at no extra charge.

7. OPERATION AND MAINTENANCE MANUALS

As part of the handing over documents, the Contractor shall submit to the Engineer-in-Charge 3
nos. of draft copies of comprehensive operating and maintenance manuals, maintenance schedule
and log sheets for all systems and equipment included in this contract. These shall be supported
with the manufacturer’s operating and maintenance manuals.

The manuals shall contain basis of design, detailed technical data and drawings for each
equipment as installed, the erection, testing, operation and maintenance procedures, spare parts
manual and recommended spares for 3 year period of maintenance of each equipment.

The Contractor shall also submit the Preventive maintenance schedule for the equipment supplied.

The Contractor shall submit four sets of the final Manuals (incorporating comments, if any, of
Engineer-in-Charge) complete in all respects.

8. IMPORT LICENSE

For importing any item if any import license/L.C. is required, the Contractor shall make required
arrangements. Any delay on this account shall be to Contractors account.

9. TRAINING OF OWNER PERSONNEL

The Contractor shall train Owner’s Personnel to operate the equipment installed, to carry out
routine maintenance work including lubrication, overhauling, adjustments, testing, minor repairs and
replacement. Nothing extra shall be payable.

Training shall be done before the expiry of the defects liability period. The period of training shall
be mutually agreed upon by Owner and Contractor.

Owner reserves the right to inspect any equipment/material to be supplied by the contractor as part
of his scope of work, at manufacturer’s works. The Contractor shall provide and secure for the
Owner’s Authorized Representative every reasonable access and facility at the manufacturer works
for inspection and testing.

10. MAKE OF MATERIALS

The Contractor shall supply the material as per list of Approved make of material enclosed in the
contract. Alternative make shall be used with the specific written approval of Architect/ Owner . Due
to non-availability of any material mentioned in the specifications, substitute material shall be used
only after detail of material accompanied by all technical data, sizes, particulars of material and
manufacturers name along with the credit due to Owner, if any, shall be submitted to Owner for
obtaining written approval from Owner /Architect, for such material

11. SAMPLE, SUBMISSION AND APPROVAL

After award of work to the contractor the contractor shall submit following samples for approval from
the Owner/Architect/Consultant .Subsequently it shall be his responsibility to get the samples
approved in due course of time without in any way affecting the overall schedule of completion of
works.

a) Conduit and Accessories

b) Wires

c) Switches and Sockets

d) Distribution Boards

e) Smoke Detector, Heat Detector, Manual call, Hooter,

g) Light Fixtures and Lamps

12. RATES

The rates to be quoted in the Schedule of Quantities shall be for Supply, Installation, Testing and
Commissioning of the equipment at site. The entire work covered by this document shall be treated
as works contract. The rates quoted shall include all packing, crating, insurance, freight, handling
and all other charges for delivering the material at the above site, including Sales Tax, Excise duty,
Works Contract tax, service tax and Octroi. No escalation shall be payable.

13. TAX DEDUCTION AT SOURCE

Owner shall deduct Money as "Tax Deducted at Source" (TDS) as per the prevailing income tax
laws and regulations, from all payments to the Contractor that are so subject.

14. INSURANCE

Contractors All Risk (CAR) insurance policy and other insurance policies, shall be taken out by the
contractor in the name of the Contractor beneficiary Owner. The original policies shall be deposited
with the Owner. The policies shall cover clauses as under.

The Contractor shall at all times indemnify and keep indemnified the Owner and its officers,
servants, agents and any other person moving on the site, from and against all third party claims
whatsoever which may arise out of or in consequence of the construction and maintenance of
works, (including but not limited to property loss and damage, personal accident, injury or death of /
to property or person of any Sub-Contractor and / or the servants or agents of the contractor, any
sub-contractor(s) and/or the Owner) and the Contractor shall at his own cost and initiative at all
times up to the successful conclusion of the defect liability period, maintain all insurable liabilities
under this Clause, including but not limited to third party insurance and liabilities under the Motor
Vehicles Act, Workmen’s Compensation Act, Fatal Accidents Act, Personal Injuries Insurance Act,
Employees State Insurance (ESI), Emergency Risk Insurance Act and/or other Industrial Legislation
from time to time in force in India with insurance company(ies) approved by the Owner, and such
policy(ies) shall be of not lesser limit than the limits hereunder specified with reference to the
matters hereunder specified, namely: Workmen’s Compensation Insurance - to the limit to which
compensation may be payable under the laws of the Republic of India.

Third Party Insurance-bodily injury and property damage to the limit of not less than Rs.1,00,000/-
(Rupees One Lac only) in each accident at site and to a limit of not less than Rs. 5,00,000/-
(Rupees Five Lacs only) for all accidents at site. Provided that the limits specified above shall
operate only as a specification of minimum limits for insurance purposes, but shall not in any way
limit the contractor’s liability in terms of this clause to the limit(s) specified. Should the Contractor
fail to takeout and / or keep current, insurance as provided for in the foregoing Sub-Clause, the
Owner shall be entitled (but without obligation to do so) to take out and or/keep current such
insurance at the cost and expense of the Contractor, and without prejudice to any other rights or
remedies of the Owner in this behalf, to deduct the sum(s) incurred, from the dues of the
Contractor.

Marine Cum Erection Insurance Policy: Comprehensive marine cum erection Policy shall be
provided, under which the entire material and equipment needed for the installation are insured for
the amount equivalent to the cost of material/equipment from the date of consignment leaves the
factory to the date the material/equipment is duly erected are handed over to Owner or Project
Manager/Engineer-in-Charge subject to terms and condition, warranties and exclusion of the policy.

Provided that the limits specified above shall operate only as a specification of minimum limits for
insurance purposes, but shall not in any way limit the Contractor’s liability in terms of this clause to
the limit(s) specified.

Should the Contractor fails to takeout/or keep current, insurance as provided for in the foregoing
Sub-clause, Owner shall be entitled (but without obligation to do so) to take out and/or keep current
such insurance at the cost and expense of the Contractor, and without prejudice to any other rights
or remedies of Owner or Project Manager/Engineer-in-Charge in this behalf, to deduct the sum(s)
incurred, from the dues of the Contractor.

Period of Policies: All insurance covers mentioned above shall be kept alive during the completion
period of contract including defects liability period.

The said Insurance Policies shall be lodged with the Owner authorized representative prior to
Contractor’s start work on site.

15. TENDER DRAWINGS

For guidance of the tenderer, tender drawings are enclosed as part of tender documents. These
drawings are not “Construction drawings” and details there in are for guidance only and are liable to

be modified during actual construction. No claim whatsoever shall be admissible on account of


changes that may be introduced by the Owner/Architect/Consultant.

16. MATERIAL TESTING

Owner shall have full power to get any material of work to be tested by an independent agency at
Contractor’s expense in order to prove the soundness and adequacy.

17. INTERCHANGE ABILITY

All similar parts or equipment shall be interchangeable, with one another.

19. FREE SUPPLY BY OWNER

If any material/equipment is supplied by OWNER to the Contractor free of cost, the Contractor shall
receive these materials and equipment at site, handle with care and store them as directed by the
Owner’s representative at site. The Contractor shall be responsible for the safe custody and shall
insure all materials against theft and damage by fire and earthquake. The Contractor shall maintain
records of consumption on daily basis. In case of any damage to the material resulting in its not
being suitable for use at site the Contractor shall have to replace the same material at his own cost
and without in any way affecting the time schedule of the project. The Contractor shall return the
surplus material back to the Owner in original condition during the handing over process.

20. SECURITY

Contractor shall be held entirely responsible for the security of the project and the protection of the
works at all times inclusive of non working hours. He shall be deemed to have included for all costs
associated therewith.

21. TEMPORARY POWER & WATER

Temporary water and electricity shall be available at single point source. Contractor shall be
responsible for all connections, and all other things necessary to use these services from the this
single point source and, as may be required for his work. Owner does not warrant continuous
supply of these services. Contractor shall allow for alternative standby services at his own cost in
the form of a D.G. Set and water tanker such as not to delay progress in event of malfunction of
central source.

22. MULTIPLE VISITS

Contractor shall be deemed to have allowed for multiple visits to complete the work described.

23. STIPULATIONS AND DEVIATIONS TO TENDER CLAUSES

Tenderers are advised to submit quotations strictly based on the tender documents and not to
deviate from the tender document. However, if it becomes unavoidable, deviations should be
separately submitted along with offer letter .Deviations should be mentioned clearly with clause
number, para and page number of the tender documents.

24. LIQUI DATED DAMAGES

2.5%% of contract value per week of delay beyond the Date of Completion of work subject to a
maximum of 10% of contract value, shall be deducted as Liquidated Damages.
All major intermediate milestones, as determined by Project Manager, will also be assessed and
Liquidated damages shall be applied for the delay in completion of those milestones, on the
percentage rates and delay periods as mentioned above and in that case, the date of completion
shall be referred to as date of completion of that particular milestone. However, if the contractor
manages to capture part of or complete lost time, a proportionate reduction in already applied
liquidated damages shall be done.
