This is a Judicial-Affidavit executed by the Maybelle Fajila in the

above-captioned Answer prepared in the language known to her.

The affiant is of legal age, single, Filipino and a resident of Jaro

Iloilo City

The questions asked of the affiant in her

Judicial-Affidavit and the answers she gave were
before defendant’s counsel at her office at Maryville
BuildingDelgado Street, Iloilo City;

The affiant, when answering the questions asked of her, was

fully conscious that she did so under oath and fully understood that
she may be facing criminal liability for false testimony or perjury in
its execution;

1. Q. Can you state your name, address, civil status, citizenship?

A. I am Maybelle Fajila, of legal age, Filipino and a resident of Jaro

Iloilo City

2. Q. Are you involved in this Civil Case No. 12-3456

for accion reinvidicatoria, pending before Branch 23?
A. No
3. Q. In what capacity are you involved in this case?

A. I am the guard on duty when the plaintiff tried to enter the

establishment.

4. Q. How can you prove that you are indeed the guard on duty at the
time plaintiff tried to enter the establishment?

A. I have a here a copy of our logbook which recorded the time of our
designated duty.

5. Q. What do you want to do with this logbook?

A. I wish to present the same and to mark it as my Exhibit “__”

6. Q. Is it true that you prohibited the entry of the plaintiff?

A. Yes.

7. Q. Why?

A. It was stated under our rules and regulations that I should not
permit the entry of any unauthorized person inside the confidential
area of our establishment.

6. Q. Where are the Defendants Renzo and Patrice Balberona at that

time?

A. My employers were not in the premises at that time. I don’t know

where they were at that time.

7. Do you personally know the Plaintiff Laurence John Sortigosa?

A. No.
