1. The Department of Education (DepED), No. 3, (C) of the Department Order (DO) No. 12,
Series of 2014 or the “Implementing Guidelines on the Direct Release of Maintenance and
Other Operating Expenses (MOOE) Allocations of Schools to the Respective Implementing
Units”, providing for the responsibilities of the Schools, particularly, the school head being
the overall administrator.

2. In addition, Article 217 of the Revised Penal Code states in unequivocal terms that:

"The failure of a public officer to have duly forthcoming any public funds or property with
which he is chargeable, upon demand by any duly authorized officer, shall be prima facie
evidence that he has put such missing funds or property to personal use."

3. Despite constant reminders from this office, still you failed to comply with the rules
requiring liquidations and reports with regards to the money and properties that comes
to your possession.

4. Pursuant to the applicable DepEd Rules and Regulations, you are hereby ordered to show
cause why no disciplinary actions be given to you due to your failure to liquidate and to
follow DepEd Rules and Regulations with regards to the money and properties that
comes to your possession as School Head. Your written explanation must be filed within
ISO 9001:2015 Certified Organization RO1-SDOIN-OSDS-F10-01-01
with Certificate No. AJA18-0119 Effectivity Date: 11April2018

Ten (10) working days from receipt of this order. In addition, please attached the
necessary documentary exhibits and/or sworn statements of your witnesses, if any.

5. Your failure to comply with this order will mean waiver on your part to contradict any and
all findings of this office.
