Subject: Legal Notice.

Under instruction of my client Mrs. Chachal Malik widow of Late Sri P.C.
Malik Chairman, St. Margret Education Society, Derawal Nagar, Delhi
R/o 46, S.F.S. Flats, Ashok Vihar, Delhi. I serve upon you this Legal
Notice which is as following.

1. That Late Sri P.C. Malik, the husband of Mrs. Chachal Malik, has
established St. Margret Education Society which holds the
management of three Schools/institutions namely St. Margret
Senior Secondary School, Prashant Vihar, D-Block, Delhi-110085.
St. Margret School at Derawal Nagar, Delhi and St. Margret
Engineering College at Nimrana, Rajsthan.

2. That Late Sri P.C. Malik in capacity of Chairman of Society, entered


into an agreement with Mr. Naveen Goswami R/o 781, Dr.
Mukharje Nagar, Delhi 110009 consequently, Mr. Naveen Goswami
became 50% partner of St. Margret Education Society only for
running St. Margret Senior Secondary School situated at D-Block,
Prashant Vihar, Delhi-110085 with an objective to promote the
current School activities and bring constructive changes by
introducing new members in the management who are experienced
in the field of administration and education.

3. That as per the condition initially agreed between the parties to


agreement, it is provided that the both parties have equal numbers
of member and the members would be increased on the basis of
increase of members from both side.

4. That as agreed between Late P.C. Malik and Mr. Naveen Gowwami
there are eight life members in the society whereby four from the
side of first party to the agreement i.e. Late Sri P.C. Malik and four
from the of second party i.e. Mr. Naveen Goswami.

It is pertinent to mention here that it is also agreed between


parties that if any life member ceased to be a member for what so
ever reason, a new member may be appointed from the group whose
member ceased at any stage and circumstances.

5. That Mr. P.C. Malik died on 7.11.2010 who was the Chairman of
the said society. After his death, his widow Smt. Chanchal Malik
had applied for membership of the St. Margret Education Society
and depositing Rs. 10,000/- vide cheque No. 734/- 22.3.2013 as
membership fee as prescribed.

6. That it is submitted that you and the executive body of the said St.
Margret Education Society has not yet taken any decision on the
application submitted by my client Mrs. Chanchal Malik.

7. That in these circumstances, it is required to convey that you


people are intentionally ignoring the application submitted by my
client with a view that my client could not to be a member of the
society. Such kind of inaction on your part smells something wrong
and against the interest of the society and institution. It is pertinent
to mention here that the present life members and the members of
executive body are interested to take undue benefit from society as
the founder Chairman has already died.

8. In these circumstances, you are required to take decision on the


application of my client for membership and being a widow of
founder member she has every right to become a member.

9. That if you failed to take any decision within 30 days from receipt of
this notice on the application of my client, my client would be free
to take necessary legal action/ remedy as available in law and you
will be liable for paying the cost of litigation if required. A copy of
notice has been retained in my office for further action.
