EXECUTIVE ORDER NO. 05

CREATION OF THE BARANGAY COMMITTEE ON ANTI-TRAFFICKING AND


VIOLENCE AGAINST WOMEN AND THEIR CHILDREN (BCAT-VAWC)

WHEREAS, Republic Act No. 9208 declares that state shall give the highest priority
to the enactment of measures and development of program that will promote human
dignity, protect the people from violence and exploitation, eliminate trafficking in person,
and eradicate pressures for involuntary migration and servitude of persons to ensure their
recovery, rehabilitation, and integration. Republic Act No. 9262, on the other hand,
underscores the commitment of the state on safeguarding the dignity of women and
children while guaranteeing full respect of their human rights to protect them from
violence and threats to their personal safety and security;

WHEREAS, the two laws likewise provide stronger mandates and direction to
relevant government agency and stakeholders to immediately address human trafficking
and VAWC by organizing Inter-Agency Council for trafficking ((Section 20 of RA 9208)
and VAWC (Section 39 of RA 9262). Their functions include the development of
comprehensive and integrated programs to harmonize the full implementation of RAs 9262
and 9208 at the national and local levels;

WHEREAS, for the purpose of expediency, maximing resources and prevention


duplications fo functions and representation at the local level, local committees on anti-
trafficking and VAWC will be created instead of establishing two separate bodies at the
provincial, municipal and barangay levels;

WHEREAS, the purpose is to establish and strengthen local structure that will
collaborately address the problem of trafficking and VAWC;

NOW THEREFORE, I, HENRY L. TARGA, Punong Barangay of Barangay


Panikihan, Gumaca, Quezon by virtue of powers vested in me by law do hereby and direct
the following:

Section 1. CREATION OF THE BARANGAY COMMITTEE ON ANTI-


TRAFFICKING AND VIOLENCE AGAINST WOMEN AND THEIR CHILDREN
(BCAT-VAWC). There is hereby created the Barangay Committee on Anti-trafficking and
Violence Against Women and their Children in this barangay composed of the following:

Section 2. FUNCTIONS OF THE BCAT-VAWC

1. Institute policies to protect women and children victims of trafficking and violence.
2. Implement the programs and activities as stated in the national plan of action.
3. Undertake information, education and advocacy campaign against trafficking in
persons.
4. Create and establish system on surveillance, investigation and rescue to ensure
effective and efficient coordination
5. Monitor and koversee the strict implementation of RA 9208,RA 9262 and other
related laws for the protection of women and children and the AICAT Kand VAWC
national plans of action.
6. Submit to the Municipal IACAT-VAWC a comprehensive report ;on the program s
undertaken

Section 3. SECRETARIAT. The Barangay Secretary shall serve sa the Scretariat.

1. Coordinate and monitor, uner the direction at the committee, the implementation
of the policies , plans and guidelines promulgated by the committee;
2. Establish, maintain, and manage a kcentarl database on trafficking in persons
3. Provide secretariat, record keeping and other services sto the committeem and
4. Perform such other functions as maybe directed by the committee.

Section 4. INSTITUIONAL ARRANGEMENTS AND COORDINATING PROCEDURES

1. National IACAT and IAC-VAWC shall be the over-all coordinagting, monitoring,


advocacy body at national level;
2. The Regional CAT-VAWC (RCAT-VAWC) as the link between the national and
local government units shall coordinate directly with the province for the proposed
establishment of PCAT-VAWC, DSWD is the designated chair of the Regional
CAT-VAWC, with DIJ) and DILG as the co-chairs, the reasons being their agency’s
major roles in addressing VAWC and Trafficking and their leadership posion in the
National IACs on trafficking and VAWC, as stipulated in both laws;
3. The Regional CAT-VAWC shall meet and discuss membership and participation of
NGOs and Pos and functions based on the genetic template provided kby the
Nastiona IAC.
4. The identification of NGO and PO members to the IACS shall be decided upon by
the member agencies from government. Using Section 20 of the IRR 9280, the
criteria for the selection of NGOs into IAC shall include a proven tract ;of record
addressing trafficking as well as VAWC concern;
5. The province shall directly coordinate with the city/municipality for the
establishment of C/MCAT-VAWC;
6. The Local committees on Anti-Trafficking and VAWC may call on the local
assistance of non-government organization and people’s organization working o n
trafficking and VAEC to assist in this formulation and implementation of localized
programs and intervantions to address human trafficking and VAWCX, whenever
necessary.
7. At any level, the Local Committee shall establish linkage with other existing
bodies/local councils on women and children and may invite other relevant
agencies/organizations to participate in its meetings and activities whenever
necessary.
8. The BCAT kshall submit to MCAT a comprehensive report on the program
undertaken on a semestral basis every 15th January and July of the following while
the MCAT shall submit to the PCAT-VAWC every 22nd of January and July of the
following kyear or in synchrony ;with the reporting schedule to the President by the
National IACS on VAWC and Trafficking.

Section 5. EFFECTIVITY. This Order shall take effect immediately.
