COMPLAINT- AFFIDAVIT

I, NENITA C. BAJALA, of legal age, Filipino a resident of Iloilo City, after

having been duly sworn to in accordance with law, hereby depose and state:

PRELIMINARY STATEMENT

That in accordance with A.M. No. 12-8-8-SC, which prescribes the use of
judicial affidavits to serve as the direct examination testimony of the witness, on the
basis of which the adverse party may conduct their cross-examination on such a
witness, I hereby execute this judicial affidavit in a question and answer format;

That conformably with section 3 (b) of the said A.M. No. 12-8-8-SC, I also
state that it was Atty. Noel Y. Sinco, an attorney-at-law who conducted the examination
of the undersigned affiant;

That conformably also with section 3 (c) thereof, I hereby state under the pain
of perjury that in answering the questions asked of me, as appearing herein below, I am
fully conscious that I did so under oath, and that I may face criminal liabilities for false
testimony or perjury;

AND UNDER OATH, AVERS THE FOLLOWING:

1) The respondent FRANCISCA P. DOROMAL misappropriated to the prejudice to the

complainant the three (3) piglets under her administration and has the obligation to
return to the complainant after 5 to 6 months these piglets but has failed to deliver;

2) The respondent FRANCISCA P, DOROMAL defrauded the complainant NENITA C.

BAJALA by using the amicable settlement by the Lupon, in which she consented and
played with rhetoric just to get away with what she did;

3) Her partner in the felony ANA ROSE JURIDICO, followed the amicable settlement
agreed by both sides and condoned by the complainant while FRANCISCA P.
DOROMAL adamantly refusing even ignoring the amicable settlement witnessed by the
Punong Barangay.

QUESTION AND ANSWER

1. Q : Please state your name, address, personal circumstances, current

occupation and other circumstances?
(Palihonghambal sang imopangalan, address, kag anu pa na imu gina
ubra?)
A: My name is NENITA C. BAJALA, of legal age, Filipino a resident of Iloilo
City and a meat vendor at North Baluarte, Molo, Iloilo City.
( Ako si Nenita C. Bajala, sa mayor na edad, Filipino, tumandok sang
Cuidad sang Iloilo kag ako isa ka manugbaligya sang karne sa Norte
Baluarte, Molo, Cuidad sang Iloilo.)

2. Q : What are the reasons why you voluntarily came to this Office?
A : Because I am a victim of ESTAFA committed by FRANCISCA P.
DOROMAL, of legal age, and a resident of Sitio Centro, Brgy. Tabuk
Suba, Jaro, Iloilo City.
(Tungod, ako isa ka biktima sang ESTAFA na ging himu ni
FRANCISCA P. DOROMAL,mayor de edad, kag residente sang Sitio
Centro, Brgy. Tabuk Suba, Jaro, Iloilo City.)

3. Q : Can you tell us all your knowledge/information about your ESTAFA

complaint?
A : Yes sir. Sometime on September 2017, I hired the respondent to raise my
three (3) piglets within five (5) to six (6) months for disposal but she failed
to produce the raised three (3) piglets to me. FRANCISCA DOROMAL
fails to pay me until now, what she owes but ANA ROSE JURIDICO has
settled the damages about being part of this felony and pay her debt.
(Oo sir. Sang September 2017, Ging sugo ko si ANA ROSE ROSE
JURIDICO kag si FRANCISCA DOROMAL na sila ang magpatambok kag
mag-alaga sa tatlo ko nga gamay na baboy sa lima asta anum ka bulan
pero sa anum ka bulan wala gid nila napakita sa akon ang akon tatlo ka
baboy.)

4. Q : What are the reasons why she cannot produce the three (3) raised piglets
to you?
A : The respondent said that the three (3) piglets got sick but she will pay the
prices of the piglets and her debt to me amounting to P 1,000 on May 31,
2018. Sadly, she did not pay.
(Hambal nila ang tatlo na baboy nagmalasakit pero bayran ya ang presyo
sang mga baboy kag ang utang niya sakon na isa ka libo sa May 31,
2018.Masubo lang na indi siya ka bayad.)

5. Q : After hearing what she did, what did you do?

A : I filed a police blotter on July 5, 2018 at the Iloilo City Police Station 3, at
Jaro, Iloilo City stating these facts. (ANNEX A)

6. Q : Anything else that you do?

A : Yes sir. I also seek the help of the Office of the Lupon Tagapamayapa in
Barangay Tabuc Suba, Jaro.
(Oo sir. Nagpamangyo ko bulig sa Lupon sang Tabuk Suba Jaro.)

7. Q : Did the Lupon resolved the issue?

A : Yes sir. The Lupon let the parties execute an amicable settlement but later
on it is only ANA ROSE JURIDICO followed the obligation. (ANNEX C)
(Oo sir. Ging pa himu kmi sng Lupon sang amicable settlement pero si
ANA ROSE JURIDICO lang gid ang nagbayad sang ging nasugtan.)

8. Q : Ok. So what are the stipulations of the settlement?

A : ANA ROSE JURIDICO, FRANCISCA DOROMAL and I agreed in front
of the Office of the Punong Barangay on March 14, 2018, to do the
following:
1) ANA JURIDICO promised to pay me on May 31, 2018 the amount
of P 7,500 cash;
2) FRANCISCA DOROMAL promised to pay me on May 31, 2018 the
amount of P 8,500 cash.
(Ang duwa ka partido nag sugtanay sa atubang ni Kap sang March 14,
2018 na si ANA JURIDICO nagpromisa na baydan ako sang P 7, 500

 cash sa May 31, 2018 kag si FRANCISCA DOROMAL nagpromisa na
baydan ako sang P8,500 cash sa May 31, 2018.)

9. Q : So, did they abide with the amicable settlement?

A: No Sir. Only Ana Juridico paid the debts and the damages of not
producing the three (3) piglets but FRANCISCA did not pay even a cent.
(Wala Sir. Si Ana Juridico lang gid nagbayad sang utang kg mga
gingdispalko nya na baboy sa akon pero si FRANCISCA wala gid
nagbayad biskan sentimo.)

10. Q : Is there anything more you want to state?

A : She defrauded me in front of the Punong Barangay and Hon. Jabonillo
can testify that Francisco adamantly refused to pay up the amicable
settlement agreed upon by the parties. I relied on his statement in the
settlement but until now she is forcibly refusing to pay the agreement
disregarding the presence of the Punong Barangay who which mediates
the signed amicable settlement.

11. Q : What did the Punong Barangay do after this refusal to abide with the
amicable settlement?
A : He issued the certification to file action (ANNEX B), which states that
there is a failure of settlement and I can now file an action before the court
any government agency after redressing administrative remedies.
(Nag issue si Kap sang certification to file action na may failure sa maka
kuha sang settlement.)

12. Q : Are you willing to sign this affidavit consisting of four (4) pages, to
certify that all the statements you made are true.
A : Yes Sir.
