1. GENERAL INFORMATION
Trinity Gardens is designed for an exceptional living environment with enduring
property and building values. Sheltaqik Limited, hereinafter referred to as the
Developer, has prepared these construction and landscaping Guidelines, hereinafter
referred to as Guidelines, to help ensure that property owners’ building designs are
complimentary to the architecture and environment of the subdivision.

Trinity Garden is being developed as a private subdivision featuring 930-120m2


spacious residential homesites and 2600m2 commercial sites or plots, making a total
of 129 plots and is situated at Igbo-Etche road by Eleme Junction, Port Harcourt.

To accomplish the intent of the land plan, preserve and enhance the natural
endowments of the property and ensure the integrity of the subdivision, certain
guidelines and controls for architectural and landscape design are necessary. These
Guidelines and declaration of covenants conditions and restrictions for Trinity
Gardens, establish particular principles and certain standards to be observed by all
property owners and users in the estate.

Sheltaqik Limited will appoint a Building Review Committee, hereinafter referred to


as the BRC, to review and evaluate all plans and specifications for any and all
proposed construction and future improvements and alternations within the estate.
These Guidelines are to be used by the BRC in the review of builder or owner plans.
Creativity and flexibility of architectural and landscaping design, tailored for
individual use within the framework of the Trinity Garden precept, are certainly
encouraged.

Sheltaqik Limited representatives are prepared to co-operate with property owners


and their agents by providing information, ideas and suggested methods for
accomplishing mutual development goals.

These Trinity Garden Guidelines and CC&R’s have been carefully formulated to
assure an attractive rewarding environment for all its users and for the best possible
safeguards for the continuing appreciation of property values.
II GUIDELINES

1.0 INTRODUCTION
The intended use of these guidelines is to provide a framework to illustrate and define
design objectives for a unified, harmonious setting for the unique style and character
of Trinity Gardens.

Location, size, style, colour and types of buildings, walls, vegetation, ornaments,
drainage, building materials and other design elements are described in the following
pages. Illustrative examples and descriptions are meant to ensure an orderly and well-
maintained sense of community and spaciousness.

2.0 SITE LAYOUT


Emphasis in Trinity Gardens shall be towards the preservation of the native flora of
the region, while at the same time providing reasonable flexibility to the property
owners to make the desired and necessary improvements to their property is key in
development of an estate lot community.

2.1 BUILDING GUIDELINES


The builder or owner of a plot shall submit to the Resident Site Engineer of Trinity
Gardens, copies of the following:
(i) Site Survey plan drawings in AutoCAD 2000 Format according to the survey
submission Guidelines. See Exhibit A
(ii) Building plan drawing in AutoCAD 200 Format
(iii) Structural design drawings in AutoCAD 2000 Format showing all relevant
sections.
(iv) Project schedule i.e. building project schedule
(v) Signed copy of Builders information sheet to be provided by the Resident Site
Engineer.
(vi) Signed copy of builders security deposit to be provided by the Resident Site
Engineer.
(vii) Questionnaire for House Plan submittals to be provided by the Resident Site
Engineer and completed by builder/owner .
(viii) Land building permits from appropriate government authorities.
(ix) Relevant papers showing proof of ownership of land in estate.
(x) Name and qualifications of the site engineer to be present on the proposed
building site.

2.2 BLOCKWORK AND STRUCTURAL GUIDELINES


Each Building site must present the name and credentials of their site engineer(s) to
the Resident Site Engineer and an introductory letter to be presented in person to the
Resident Site Engineer before commencement of work. This is to ensure that only
people with appropriate qualification and experience in building structures handle
projects in the estate. Block shall be supplied by the estate’s block industry. No
building shall be more than one storey in height.

The maximum height of any building is 15.5m above natural ground level measured
from the average height of the area surrounding the building. The building line must
be setback at an angle not exceeding 45o from the minor road boundary and 40o from
the major road boundary.

2.3 BUILDING SETBACK


Generally, building fence lines should be 1meter from minor roads boundary and1.5
metre from major roads boundary pillar. If in the opinion of the BRC, the relaxation
of these standards can protect and enhance an existing natural feature such as
specimen tree, consideration will be given for a variance on a case-by-case basis, to
secure such variance, the form of a tree survey, plan and or site photographs that
verify the existence and characters of the site feature causing the variance request.
Property owners are encouraged to obtain written confirmation from the Resident Site
Engineer that all setback requirements have been met prior to the start of any
construction of the residence/building.

2.4 CULVERTS
Driveway culverts shall be installed prior to any other construction activity on the plot
if the plot s across the drainage ditches. Design criteria and specifications for culverts
are shown on the attached. Exhibit B.
All culverts must be set using cement stabilized material. All entry and delivery
culverts shall utilize sloped end treatments with a minimum 3:1 slope and shall be
installed at a grade not less than four inches (4”) below the designated ditch flow line.
Other culvert end treatments are acceptable but must be submitted and approved by
the BRC

2.5 POOLS, SPAS AND DECKS


Portable or permanent above ground swimming pools are prohibited. Smaller
prefabricated, installed above the ground, spas or hot tubs are acceptable. Above the
ground spas or hot tubs, visible from public view or from other plots must be skiated,
decked, screened or landscaped to hide all plumbing, heatess, pumps, filters, etc.

Swimming pool appearances such as rock water falls and sliding boards must not be
over six feet (1.83m) (6”) in height if visible from public view. Skimmer nets, long
handle brushes, pool chemicals, filters, pumps, heatess, plumbing, etc. must not be
visible from public view. Pool walls shall not encroach on utility easements.

2.6 FENCES, GENERAL


No barded wire fencing is permitted and general building fence lines should be 1
metre from minor roads boundary and 1.5 metres from major roads boundary.
Plastered brick or masonry columns in connection with iron or metal fencing are
permitted and encouraged and should be built according to the following guidelines.

Brick or masonry part: 1.2m


Iron or metal connection: 0.6m

Fencing which crosses a utility easement must include removable panels of not less
than twelve feet (12”) in width to provide access to utility companies. The
owner/builder can create another means of access which must be approved by the
BRC.

2.7 EXTERIOR ELEVATIONS


Exterior elevations should be interesting and not have the appearance of a “shoebox”.
All single –story houses are encouraged to include some variation oF the ridge line.
Priority should be given to those sides of the house, which are visible from streets.
The most articulated elevations should be those, which are in pubic view. However, it
should be assumed that the houses will be seen from all angles and that there will be
continuity of materials and details on all elevations.

2.8 INTERIOR DESIGN


There are in principle, no constraints on interior design, however the use of white as a
colour is discouraged when viewed from the exterior. White curtain linings, shutters
and blinds present too harsh a view in relation to the earthly colours approved for the
exterior and must not be used.

2.8.1 SIGNAGE & HOUSE NAMES


Size - House numbers and letters must be accepted to the B.R.C and not be
smaller than 80mm or larger than 160mm
Position House numbers must either be placed on the house or on the garden
wall in a visible position and lit at night. A standard house number
plate design will be provided.
Post Boxes Post boxes at the houses should be aesthetically designed and not just
plain.

2.8.2 APPROVED COLOURS


Soft suddued earth tone paint colours should be used such as ochre, sandstone, siege,
autuum shades etc. bright contrasting, bold, primary or unusual colours are prohibited.
Each owner/builder is required to submit a colour palette to the BRC for approval.
Gable ends of a uniform material tend to be more architectural then those which
change at the cave line.

High contrast trim or material variations should be avoided in favour of those which
are chosen to blend all elements into single ideas.

2.8.3 ENTRANCES, WINDOWS AND ROOF


Care should be given to the size, type and organization of all windows. They should
never appear like surface “hole” cut into the side of the box. They should be
architectural features and wherever possible, grouped into recessed areas or borded by
projections which provide a shadow pattern. Scattered windows tend to create
awkward, face-like shapes and should be avoided. Window covering visible from a
street must compliment the colour of the residence.

Changes in roof geometry are best when accompanies by offsets in plan. Avoid flat
roofs; a minimum slope on all roofs should be & in 12 pitch. Porches and overhangs
may have a minimum slope of 5 in 12 pitch. A combination of roof pitch may be used
if they are integrated to the design of the house.

2.9 ACCESSORY BUILDING


Accessory buildings, such as detached garages, guest houses, storage buildings, and
outbuildings are permitted in TRINITY GARDENS, however in all cases, the plans
for construction shall be reviewed and approved on a case by case basis. Whenever
possible, accessory buildings should use the same materials and architecture to be in
harmony with the residence No prefabricated aluminium, light duty metal, or “pole d
tin” structures are permitted. Totally barned are projections on fences to be used as
kiosks or business call centers.

All permitted accessory buildings shall be of substantial and new construction.


Storage buildings or outbuildings made to resemble the residence should use the same
exteriors materials and construction techniques as the residence.

3.0 LANDSCAPE
3.1 GENERAL
The owner/builder is responsible for the landscaping on his/her property. However,
the area within the 1 meter setback from the building fence line inside the property
should be left for landscaping to be done by the Developer.
Installation of landscaping must occur prior to occupancy of the house. Installation of
landscaping, including materials and workmanship, must comply with current
industry standards.

3.2 LIGHTING
The owner/builder is to install and maintain lighting on individual lots in a manner to
not cause distract nuisance or to be unsightly. Light sources should not conflict with
the sight lines of pedestrians or motorists as installed in a manner which endanger
their safety and welfare. Light sources must not “spill over” into neighbouring yards.
Exterior residential lighting can convey a warm, inviting, atmosphere. Care is to be
taken in placing fixtures, selection of fixtures and types of light source. Exterior
illumination or architectural features such as columns, entries, and landscape features
are encouraged.

Individual security lighting is allowed including mercury vapour and high pressure
sodium lights, provided that they are not placed in front of the residence or are sited
as to spill over into adjoining plots or public rights of way. No security lighting fixture
shall be erected higher than 8.5m above the surrounding natural ground.

Lighting for outdoor terms courts or personal athletic courts will be reviewed by the
BRC on a case by case basis. In no event shall such outdoor lighting be permitted
which causes a nuisance or is allowed to “bleed ever” onto adjoining plots.

Ground lighting or decorative fixtures must be of high quality materials and


workmandship and be in scale and style with the residence. Free standing decorative
fixture and lamp posts are acceptable but must be approved by the BRC.

Mercury vapour lights, when used for special landscaping lighting effect (hung in
trees as up down lights) is permissible with BRC approval. Incandescent, low voltage
incandescent, metal halide, quarz and natural gas light are acceptable. All wirng for
exterior lighting should be conduit/underground. Christmas lights related decorations
must be removed from the exterior of buildings by January 15th of each year.

3.3 PLANT MATERIALS: FLOWERS, LAWNS AND GRASS


The Developer has a well stocked garden with native and foreign flora for sale to
owners/builders of plots within the estate. The garden is situated in the commercial
district of Trinity Gardens and also contains delightful relaxation spots.

When grasses have been planted to provide an attractive ground cover on a plot,
regular mowing and light fertilization is normally all that is required.
3.4 LANDSCAPE MAINTENANCE
A moving pool will be set up by the Developer in the commercial garden and all plot
owners are encouraged to participate in the mowing pool, participation in the mowing
pool is usually much less expensive than the cost of having a single plot moved. All
landscaping is required to be maintained in a healthy and attractive appearance.
Proper maintenance includes:
a. Mowing
b. Pruning and shaping
c. Weed control in lawns and planting beds
d. Adequate
e. Appropriate fertilization
f. Insect and disease control
g. Seasonal mulching of planting beds
h. Replacement of diseased or dead plant materials

Each plot shall be maintained in a neat, clean and orderly condition by the
owner/builder.

3.5 REINSTATEMENT DURING AND AFTER CONSTRUCTION


Any owner/builder developing his/her property must ensure that waste produced
during construction are not disposed of in adjoining plots. If they are disposed into
adjoining plots, the disposal should be temporary and the adjoining plot restored to its
initial condition devoid of waste by the person currently developing his/her own plot.
This should be down immediately after each day’s construction activities.

3.6 DRAINAGE
The estate lot development utilizes existing natural drainage features while keeping
the manipulation of natural drainage features to a minimum. Overland runoff should
be channelized only where necessary. The drainage of roadways and private plots are
important, but care must be taken to not unnecessarily alter or accelerate the surface
runoff of the natural drainage ways.
3.7 WATER WELLS AND SEPTIC SYSTEMS
Water well downhole construction a.k.a borehole construction, for the supply of water
is permitted on individual plots. The wells should have casing pressure cemented to
full casing depths.

Old fashioned septic systems are not permitted. A system must be aerobic and self-
contained. A system shall not produce odours and should be serviceable through a
surface-level access opening.

4.0 MISCELLANEOUS
SITE STORE
All building sites should have a site store for the storage of materials and a shelter to
protect workers from the elements such as heavy rain or extreme sunshine. A site store
is mandatory before commencement of work.
Plumbing
Exposed plumbing is discouraged, however, if used it must not be visible from the
roads.

Satellite Dishes
Satellite dishes for internet access are not allowed on individual hoses. A centralized
system offering bandwiths to individual houses shall be provided by the Developer.

Electrical supply
Property owners comply with the standard conditions of electrical supply as issued
from time to time by the BRC.

4.1 RESPONSIBILITY
The Guidelines
These guidelines do not absolve the house owner/builder from complying with the
National Building Regulations and Local Authority Approval by the BRC does not
absolve the owner/builder from complying with standards set by those bodies.
SURVEY SUBMISSION GUIDELINES

The site survey plan showing the building and related features shall be saved in AutoCAD
2000 Format and including all information and dimensions. Both hard and electronic copies
should be submitted. The electronic copy submitted shall be on one layer named Plot
-------and shall be in Model Space only.

The drawing shall then be inserted into the proper plot description location on the Trinity
Gardens Master Survey by the BRC. The Trinity Gardens Master Survey shall be maintained
by Sheltaqik Limited.
BUILDERS INFORMATION SHEET

Builders shall co-ordinate all deliveries to their sites so as to limit the unnecessary damage to
common areas throughout the estate.

It will be the responsibility of the owner/builder to gain access through gated entry for
deliveries to construction sites and have a representative on site during these delivery periods.
Owner/builders will strive to keep the roads clean of debris during construction so as to avoid
unnecessary input.

Builders Security Deposit

The owner/builder has reviewed the Trinity Gardens Development Guidelines. The
N…………………….. security deposit is to ensure timely repairs or replacement and clean
up of the Trinity Gardens estate property damaged by the construction activity as a result of
the construction of the primary residence on plot ------------------------ provided in the
submittal to the BRC.

If in two weeks of the occurrence, damages or clean up to the Trinity Gardens estate property
is not complete, the BRC shall complete the repairs and deduct the cost from the deposit. The
BRC will furnish a copy of the paid invoice to the depositor when security is not refunded in
full. If no repairs replacement or cleanup is required during the construction period 100% of
deposit will be returned to the depositor.
