 RESUMEN

La presente investigación sobre las normas constitucionales relacionadas

con el derecho a la consulta previa e informada, da cuenta que influyen de
manera positiva en el Departamento de Cajamarca, para el
aprovechamiento de los recursos naturales y el medio ambiente. Del
mismo modo se evidencia que la socialización de la norma constitucional
en esta materia, puede ser positiva en el sector justicia y sector político,
de ese modo se puede afrontar con éxito los problemas que afectan a la
mayoría de pobladores rurales y campesinos, sin desmedro de su
identidad natural y cultural. La participación de la población en la consulta
previa debe construir, paso a paso a construir planes de desarrollo regional,
generando confianza entre sus moradores. La improvisación en la aplicación
de estas normas constitucionales por parte de las autoridades regionales
ha significado el problema denominado conga. Temas como el agua, los
bosques y los recursos mineros, son temas sensibles que tienen que
manejarse dentro del derecho constitucional, al amparo del convenio 169
de la OIT, cuidando el uso de los términos y advirtiendo que no se debe
entender como el reconocimiento de derechos que corresponden a los
Estados, reconocer sus derechos sobre los recursos existentes en sus
territorios, lo que incluye consultarles previamente respecto de su
utilización. Para ello se debe establecer vías de diálogo más apropiadas
para mejorar la información, establecer mejores niveles de articulación al
interior de la región y lograr incidir ante las autoridades competentes, de
tal forma que los pobladores logren ser parte activa durante todo el
proceso, promoviendo la concertación. Finalmente la concesión de tierras
comunales con la autorización de la consulta previa puede ser positiva no
sólo para Cajamarca sino para todo el país. Por cuanto eso significa
atender los derechos de los pueblos respecto a sus costumbres y
tradiciones.

 ABSTRACT

The present investigation on the constitutional procedure related to the

right to the previous and informed consultation, realizes that they influence
in a positive way Cajamarca's Department, for the utilization of the natural
resources and the environment. In the same way there is demonstrated
that the socialization of the constitutional norm in this matter, can be
positive in the sector justice and political sector, thereby it is possible to
confront successfully the problems that affect the majority of rural and rural
settlers, without decline of his natural and cultural identity. The
participation of the population in the previous consultation must construct,
stepwise to constructing plans of regional development, generating
confidence between his inhabitants. The improvisation in the application of
these constitutional procedure on the part of the regional authorities has
meant the problem called conga. Topics as the water, the forests and the
mining resources, are sensitive topics that they have to handle inside the
constitutional law, under the protection of the agreement 169 of the OIT,
taking care of the use of the terms and warning that it is not necessary to
to deal as the recognition of rights that correspond to the States, admit his
rights on the existing resources in his territories, which it includes consult
them before respect of his utilization. For it it is necessary to to establish
routes of dialog more adapted to improve the information, establish better
levels of joint to the interior of the region and manage to affect before the
competent authorities, in such a way that the settlers manage be an active
part during the whole process, promoting the conciliation. Finally the
concession of communal lands with the authorization of the previous
consultation can be positive not only for Cajamarca but for the whole
country. Since it means it to attend to the rights of the peoples with regard
to his customs and traditions.
