MEMORANDUM OF UNDERSTANDING

This Memorandum of Understanding is made and executed at Hyderabad on


this the 12th day of July, 2019 by and between:-

Sri Shivanesan Selvarajan S/o.A. P.S.Selvarajan, aged 32 years, Occ:


PVT Service, R/o. H.no.4-1-1225, Flat No.202, Anantha Laxmi
Residency,Boggulakunta, Abids, Hyderabad..

(Hereinafter called the “FIRST PARTY”)

AND

Smt. Shalini Bhagath W/o Shivanesan Selvarajan, Aged about 30 years,


R/o.245,246,Flat No:102, Road No-8,Chaithanyapuri,Near Genius Grammar
school, Hyderabad, Saroornagar,K.V.Rangareddy, P&T Colony

(Hereinafter called the “SECOND PARTY”)

WHEREAS the marriage of First party with the Second Party took place

on 31-10-2011 at TTD Kalyanamandapam, Liberty, Himayathnagar. The said

marriage was an arranged Marriage.

WHEREAS certain differences arose between both the parties and both

the husband and wife started living separately from the year 2014 onwards.

WHEREAS the First Party filed Divorce Proceedings as against the First

Party pending before the Hon’ble Family Judge vide OP No of 2018 and the

Second party has filed the DVC No of 2018 pending on the file of XI

Metropolitan Magistrate.

WHEREAS, during the pendency of both the above cases, the First Party

and Second Party have resolved to compromise the matter amicably with the

following terms and conditions, in the presence of their respective elders and

Counsels:-

NOW THIS MOU WITNESSETH AS FOLLOWS:-

1. That as per the terms of settlement agreed between the parties, the First

Party has agreed to Pay the sum of Rs. 4,60,000 lakh (Rupees four Lakh Sixty
Thousand only) with respect to the settlement to the Second Party towards full

and final settlement as her permanent alimony. It is also agreed between the

parties that there shall be no further and/or future claims or demands of any

kind whatsoever by either of the parties against each other.

2. That the both first party and the second party agreed to file petition for

conversion of contested divorce to mutual divorce filed by the 1st part initially

against the 2nd part with alleged apprehended allegations, pending before the

Hon’ble Family Judge, LB Nagar and with respect to the same , the second part

would withdraw the DVC No

3. That First Party and the Second Party shall file a mutual consent Divorce

Petition before the Family Court at Lb Nagar. The both the parties undertake

to fully cooperate with the judicial processes associated with their mutual

consent Divorce Petition filed before the Family Court and shall be present

before the Family Court on the day or days that will be fixed by the Family

Court for obtaining Decree of Divorce.

4. It is agreed between the First Party and Second Party that after this

settlement and final Decree of Divorce by mutual consent, there will be no

dispute on whatsoever grounds between the parties and they will not file any

appeal, any further court case such as maintenance, civil or criminal,

litigations etc. or proceedings against each other in respect of the marriage

between First Party and the Second Party.

5. That after obtaining the divorce, it is specifically agreed by both parties

that they are at liberty to lead a life of their own choice and contract marriage

of their choice without any interference whatsoever in each other’s life, and

that they will have no claim of whatsoever nature on the other person or

his/her property, whether movable or immovable, whether self-acquired or

inherited.

6. That this Memorandum of Understanding has been arrived at between

the First Party and Second Party of their own free will, without any coercion,
undue influence or pressure from any quarter and the terms agreed to shall be

binding on both the parties herein.
