WHEREAS, Appropriation Ordinance No. 03, Series of 2012 of Barangay Magulon authorizing
the implementation of its Annual Budget for Fiscal Year 2013 involving an appropriation of
ONE MILLION ONE HUNDRED TWENTY SEVEN THOUSAND SEVEN HUNDRED EIGHTY FOUR
PESOS & 00/100 (PhP1,127,784.00) was submitted to this Sanggunian for review pursuant to
the provision of Republic Act No. 7160;
NOW THEREFORE, on motion by Honorable Napoleon C. Belingon, duly seconded and upon
unanimous vote, be it:
RESOLVED, to declare operative in its entirety 2013 Annual Budget of Barangay Magulon,
Municipality of Lamut, Province of Ifugao, approved by the Barangay Council under
Appropriation Ordinance No. 03, Series of 2012, subject to posting as provided for under
Section 53 of the Local Government Code of 1991;
RESOLVED FURTHER, to require the barangay to comply with all accounting rules and
regulations;
RESOLVED FURTHERMORE, to inform the barangay that this review action does not authorize
any item of appropriation that is specifically prohibited by or inconsistent with the provisions
of laws and DILG Circular 138;

NOW THEREFORE, on motion by Honorable Napoleon C. Belingon, duly seconded and upon

regulations;
RESOLVED FURTHERMORE, to inform the barangay that this review action does not authorize
any item of appropriation that is specifically prohibited by or inconsistent with the provisions

WHEREAS, submitted to this Body for appropriate action is the request of the Honorable
Francisco P. Tenenan, Sr., Municipal Mayor, this Municipality for an authority to enter into a
Tripartite Memorandum of Agreement (MOA) with the Department of Agriculture-Regional Field
Office-Cordillera Administrative Region (DA-RFO-CAR), Baguio City, Provincial Local
Government Unit (PLGU), Lagawe, Ifugao and Hapid Valley Irrigators’ Association, Hapid, Lamut,
Ifugao intended for the Implementation of Agri-P-Noy Farm Machinery (Standard Rice
Thresher);
WHEREAS, upon review of this Body on the provisions of the Memorandum of Agreement
revealed that the Implementation of Agri-P-Noy Farm Machinery (Standard Rice Thresher) for
Hapid Valley Irrigators’ Association would enhance rice production and will benefit the farmer-
members of the association;

WHEREAS, submitted to this Body for appropriate action is the request of the Honorable
Francisco P. Tenenan, Sr., Municipal Mayor, this Municipality for an authority to enter into a
Tripartite Memorandum of Agreement (MOA) with the Department of Agriculture-Regional Field
Office-Cordillera Administrative Region (DA-RFO-CAR), Baguio City, Provincial Local
Government Unit (PLGU), Lagawe, Ifugao and Timpuyog Irrigators’ Association, Pugol, Lamut,
Ifugao intended for the Implementation of Agri-P-Noy Farm Machinery (Standard Rice

WHEREAS, upon review of this Body on the provisions of the Memorandum of Agreement

WHEREAS, the amount of ONE MILLION FIVE HUNDRED THOUSAND PESOS & 00/100
(PhP1,500,000.00) was appropriated as “Aid/Assistance to MLGU-Lamut for Magulon-Matangili Road
Improvement under the 2012 Supplemental Budget No. 02 of the Provincial Local Government Unit,
Province of Ifugao;
WHEREAS, under Provincial Ordinance No. 2009-016 known as “The Provincial Government
Fund-Transfer Ordinance of 2009”, it is declared policy of the Provincial
Government of Ifugao to transfer funds appropriated as “Aid or Assistance” under any
approved appropriation ordinance, without delay and without cost, to the identified Local
Government Unit (LGU), Non-Government Organization (NGO) or People’s Organization (PO) and
other entities for proper, efficient and prompt implementation consistent with existing laws
and rules;
WHEREFORE, on motion by Hon. Benjamin L. Bantag, duly seconded, and upon unanimous vote
be it:
RESOLVED as it is here resolved, to earnestly request the Provincial Governor, Hon. Eugene M.
Balitang, to Fund Transfer to Local Government Unit of Lamut, Province of Ifugao the amount of
ONE MILLION FIVE HUNDRED THOUSAND PESOS & 00/100 (PhP 1,500,000.00)) earmarked as
“Aid to LGU-Lamut for Road Improvement at Magulon-Matangili- Farm-to-Market Road.
RESOLVED FURTHER, to express to the Provincial Government of Ifugao the sincere and honest
commitment of this Local Government Unit to implement development project according to its
program of work;

Lamut for Pacco-Nayon Road concreting;
WHEREAS, under Provincial Ordinance No. 2009-016 known as “The Provincial Government
Fund-Transfer Ordinance of 2009”, it is declared policy of the Provincial
Government of Ifugao to transfer funds appropriated as “aid or assistance” under any approved
appropriation ordinance, without delay and without cost, to the identified Local Government

WHEREAS, the approved Appropriation Ordinance was transmitted to the Office of the
Municipal Mayor on January 25, 2013 for appropriate action; however, the same was
returned with veto on the Administrative Provisions of said Ordinance, particularly on
the Restrictions on the Use of Appropriated Funds which accordingly is
detrimental/prejudicial to public welfare;
WHEREAS, the justification of the Local Chief Executive for vetoing Section 7.10 of the
Appropriation Ordinance was merely confined on the application of Section ©, Rule VI
of RA 9769. In fact, it is clear that the qualifications and limitations of said particular
provision is contained in the other provisions of the same Section and Rule leading to
think that the other provisions although known was purposely left out in construing
said Rule, just to have a basis for the veto and to cater to the interest of the few. It is
very basic in statutory construction that every part of the statute must be interpreted
with reference to the context i.e. that every part of the statute must be considered
together with the other parts, and kept subservient to the general intent of the whole
enactment (Paras VS COMELEC, November 4, 1996). The Rule regarding the share of the
employer and the employees to PAG-IBIG was clear and yet the whole provision was
not taken into account;
WHEREAS, while this Body recognizes the employee’s discretion to increase or not
his/her personal share to the PAG-IBIG fund as provided under paragraph 3, Section 1,
Rule VI of RA 9769, the Sangguniang Bayan is most concern on the share of the Local
Government Unit as the employer of which its limitation is provided for in paragraph
2, Section 1, Rule VI of RA 9769 as stated, “The maximum monthly compensation to
be used in computing employee and employer shall not be more than Five
Thousand Pesos (PhP5,000.00)..xxx. It is therefore clear that the employer is not
required to give equal counterpart to the employee’s share if the employee elects to
contribute a higher share;

WHEREAS, Paragraph 3, Section 1, Rule VI of RA 9769 clearly states that the employer,
however, shall only be mandated to contribute what is required under these Rules
unless the employer agrees to match the member’s increased contribution. It is
construed therefore that the employer’s share can only be increased if the employer
agrees to such increase, wherein in this case, the Local Government Unit, being the
employer, did not give its express consent. The employer’s share to PAG-IBIG fund of
an employee is considered as benefits to the employees including the officials of the
Local Government Unit.
WHEREAS, Article 100, (a), (1), (vii) of Republic Act 7160, also known as the Local
Government Code of 1991 authorizes the Sangguniang Bayan to determine the
positions and the salaries, wages, allowances and other emoluments and benefits of
officials and employees paid wholly or mainly from municipal funds, thus, the Local
Chief Executive or any member of the Executive Department of the Local Government
Unit cannot on their own decide to increase the employer’s share;
WHEREAS, some of the veto message of the Local Chief Executive includes citation of
laws, statues and decisions by the Supreme Court in which case is but proper, however,
not to cite all the related provisions and attaching a case digest which does not have
the same facts to the case at hand is improper and misleading. Case digests should
not be attached if the facts of the case cited and the case cited and the case at hand
are not similar in nature, when the purpose of citing a case is just to emphasize well-
settled doctrines of law then is it enough to cite the case just to have a basis, to do
otherwise is misleading, inappropriate and degrades the decision of the Supreme
Court;
RESOLVED, to override the veto of the Local Chief Executive, Hon. Francisco P.
Tenenan, Sr., this Municipality on Section 7.10 – Expenditures of the approved
Appropriation Ordinance No. 2013-01;
RESOLVED FINALLY, to forward this Resolution to the Hon. Francisco P. Tenenan, Sr.,
the Sangguniang Panlalawigan and other offices concerned, for their information.

prepared by the Local Poverty Reduction Action Team (LPRAT), this Municipality;
WHEREAS, upon scrutiny, this Body agrees that the list contains the priority projects
as endorsed by the partner CSO representatives as proof of genuine participation in
identifying the priority projects;

WHEREAS, upon scrutiny on the Memorandum of Agreement, this Body found the provisions of
the Memorandum of Agreement to be legal and valid, except for the third provision of said
Memorandum of Agreement which is detrimental to the BLGU of Nayon, Lamut, Ifugao;
WHEREAS, this Body noted that the Barangay Official concerned including the Local Chief
Executive and the Municipal Engineer accepted the terms and conditions stipulated in the
Memorandum of Agreement by signing the Memorandum of Agreement without seeking first
the authority from this Body;
NOW THEREFORE, on motion of Honorable Councilor Atty. Adryan B. Chaguile, duly seconded
by Honorable Councilor Napoleon C. Belingon and upon unanimous vote; be it:

WHEREAS, presented for review and approval is the foregoing Barangay Tax Ordinance
No. 01, Series of 2012 of Barangay Umilag;
WHEREAS, this Body found out that the amendment is not timely, thus, it is not in
accordance with the provisions of RA 7160 particularly on the period to amend a tax
ordinance;
WHEREAS, as to form and contents, the Tax Ordinance is valid and properly enacted;
thus, this Body may approve the amended Ordinance holding in abeyance the
implementation until it has complied with the five (5) year period set by Republic Act
7160;
RESOLVED, to declare operative Barangay Tax Ordinance No. 01, Series of 2012 of
Barangay Umilag; however, suspending the implementation hereof until it has complied
with the five (5) year period for the amendment of tax ordinances as set by RA 7160;

WHEREAS, the Municipality of Lamut is one of the eleven (11) municipalities in the Province of
Ifugao and the 2nd largest municipality in terms of population accounting for 12.23 percent of
the province’s population of 1,520,743 persons. It remains to be the biggest driver of
population growth in the Province;
WHEREAS, on April 4-6, 2013, the Municipality of Lamut, Province of Ifugao will be celebrating
its 54th Founding Anniversary and Annual Town Fiesta to be participated by the eighteen (18)
Barangays, all sectors, national government agencies whose offices are situated in this
Municipality and non-government organizations;
WHEREAS, to give more significance and make this annual event another success, this Body
deems appropriate to invite a well-respected national figure whose programs are geared toward

Cordillera Administrative Region (DA-RFO-CAR), Baguio City, intended for the implementation
of the Construction/Improvement/Rehabilitation of Bunog-Maleteng and Umilag-Magulon Farm-
to-Market Roads in Lamut, Ifugao;

Body found out that, aside from being meritorious, it is legal and valid;

WHEREAS, this Body highly appreciate the action and initiative of the IFELCO Board of
Diretors in identifying and approving the installation of 5 MVA substation at Lamut,
Ifugao as priority project of the electric cooperative;
WHEREAS, this Body strongly believed that this is a very noble project of IFELCO, the
Installation of a 5 MVA station as it would address the perennial problem of this
Municipality as well as the whole province on power interruption;

is imperative that changes in signatories specifically in the Office of the Municipal Mayor where

WHEREAS, the Sangguniang Bayan of Lamut, Ifugao is a legislative body duly organized
pursuant to law for the enactment of ordinances and the adoption of resolutions for the
governance of Lamut, Ifugao;
WHEREAS, pursuant to Section 50 of Republic Act No. 7160, otherwise known as the Local
Government Code of 1991 and Rule XVII, Article 103 of its Implementing Rules, local
Sanggunian bodies are mandated to formulate and adopt their own internal rules of procedure
for the proper discharge of legislative functions;
WHEREAS, to promote good order in Sanggunian deliberations, it is vital that specific rules be
adopted and enforced in the interest of legislation.

INTERNAL RULES OF PROCEDURE
OF THE
SANGGUNIANG BAYAN
MUNICIPALITY OF LAMUT
PROVINCE OF IFUGAO
RULE I - MEMBERSHIP
Section 2. Powers, Duties and Functions. - The powers, duties and functions of the
Sanggunian shall be as provided for under Rule XVII of the Implementing Rules and
Regulations of the Local Government Code of 1991.
Section 4. The Presiding Officer. - The Municipal Vice-Mayor shall be the Presiding
Officer of the Sangguniang Bayan of Lamut.
In the absence or inability of the Municipal Vice-Mayor to act as the Presiding Officer,
the Sangguniang Bayan Members present, constituting a quorum, shall elect from
among themselves a temporary Presiding Officer. The acting or temporary presiding
officer shall assume the duties of the Vice-Mayor as Presiding Officer during that
particular session when the latter is absent or unable to perform, except to cast his
vote in case of a tie. However, he shall certify within ten (10) days from their
enactment or adoption, all ordinances and resolutions passed by the Sangguniang
Bayan.
Section 5. Powers and Duties of the Presiding Officer. - The Presiding Officer shall:

c. Decide all questions or order, subject to appeal by any Sanggunian Member
in accordance with these Rules;
d. Sign all acts, ordinances, resolutions, memorials, writs, warrants and
subpoena issued by, or upon order of the Sanggunian;
e. Declare a recess during sessions anytime he deems it necessary provided
that the duration of the recess is less than fifteen (15) minutes;
f. Declare the session adjourned to some other date, time and place in cases of
extreme emergencies, serious and uncontrollable disorder, public
disturbances and other unavoidable circumstances;
g. Make brief remarks, comments or clarificatory questions on any measure
pending deliberation by the body provided that he shall not express himself
either for or against the said measure or question.
h. Vote but only to break a tie. Hence, he cannot vote in order to create
a tie. His right to break a tie is compulsory.
i. Exercise such other powers and performs such other functions as may be
provided by law, ordinance or regulation.
NOTES: The regular Presiding Officer shall not be a chairman of any standing
committee, but shall have a voice and a vote in all committee
deliberations. He may, however, be elected as chairman of any special
or ad hoc committee that the Sanggunian may organize for specific
purposes.
The appointment of the Sanggunian Secretary shall be in accordance with Civil Service
laws, rules and regulations.
Section 7. Powers and Duties of the Secretary. - The Sanggunian Secretary shall:

g. Keep his office and all non-confidential records therein open to the public
during the usual business hours;
h. Translate into the dialect used by the majority of the inhabitants all
ordinances and resolutions immediately after their approval and cause the
publication of the same together with the original version in the manner
provided under the Local Government Code of 1991;
i. Take custody of the local archives and, where applicable, the local library
and annually account for the same;
j. Prepare a status report on measures approved by the Sanggunian and
present this in the “Secretary’s Report” during the Regular Session; and
k. Exercise such other powers and perform such other duties and functions as
may be prescribed by law or ordinance or Internal Rules of Procedure of the
Sangguniang Bayan relative to his position.
RULE IV - SESSIONS
Section 8. Regular Sessions. The regular sessions of this Sanggunian shall be every
Tuesday at 9:00 o’clock in the morning of each week at the Sangguniang Bayan Session
Hall or at a place that may be decided in the preceding session. However, if session
day falls on a holiday or is declared as a non-working day, the following day shall be
understood as the regular session day.
During sponsorship of Flag Ceremony by the Sangguniang Bayan, the regular session
shall be temporarily moved to Monday of the same time.
In case a Special Session will be held at the request of the Municipal Mayor to the Vice-
Mayor, called by a majority of the Sanggunian members, the Municipal Vice-Mayor or
the Secretary to the Sanggunian will prepare the notice. A Notice of Special Session
will be written and shall state the date, time and purpose of the session. It shall be
served personally, or left with a member of the household of the Member at his usual
place of residence. Notice of Special Session through text messages from the Secretary
to the Sanggunian may be recognized; however, a written notice shall be prepared to
be signed by the members later during the special session stating specifically the
agendum/agenda especially when the subject matter is regarding allocation of
municipal funds. Unless otherwise agreed upon by two-thirds (2/3) vote of the
members present, there being a quorum, no other matter may be considered at a
special session except those stated in the notice.
The Municipal Mayor in cases of emergency may call a special session, in which case
his office shall prepare the Notice of Special Session.
Each Sanggunian shall keep a journal and record of its proceedings, which may be
published upon resolution of the Sanggunian concerned.
On a motion to hold a closed session duly approved, the Presiding Officer shall direct
the session hall cleared and doors closed

Only the Secretary and such other persons as are specifically authorized by the
Sanggunian shall be admitted to the closed sessions. They shall preserve the secrecy
of whatever may be read or said at the session.
No two (2) sessions, whether regular or special, may be held in a single day.
Section 14. Quorum. - A majority of all the elective and qualified Members of the
Sanggunian shall constitute a quorum to transact official business. The term “elected
and qualified” shall be construed to include the Presiding Officer, the regular members
and also the “ex-officio” members.
In computing the presence of a “quorum”, the term “majority” shall be based on the
actual membership or incumbents in the Sanggunian that shall exclude the following:
Should a question of quorum be raised during a session, the Presiding Officer shall
immediately proceed to call the roll of the members and thereafter announce the
results and then declare whether there exists a quorum or not. A request or motion to
determine the presence of a quorum is not debatable.
Section 15. Absence of Quorum. - Where there is no quorum in a given session, the
Presiding Officer may declare a recess until such time that a quorum is constituted, or
a majority of the members present may adjourn from day to day.
If there is still no quorum despite the foregoing, no business shall be transacted. The
Presiding Officer, upon proper motion duly approved by the Members present, shall
then declare the session adjourned for lack of quorum.
Section 16. Motion to Adjourn Vacates Call. - At any time after the roll call has been
completed, a motion to adjourn shall be in order, and if approved by a majority of
those present, all proceedings shall be vacated.

Section 18. Call To Order. The Presiding Officer shall open the session by calling the
Sanggunian to order.
Section 19. Roll Call. The roll call maybe dispensed with when it becomes obvious
that there is a quorum. Under this circumstance, it behooves upon the Secretary to the
Sanggunian to note in the minutes who among the members are actually present and
who are not present at the start of the session.
Section 21. Prayer. On every session day, a one-minute prayer must be made. It shall
be led by any of the members as may be designated by the Presiding Officer.
Section 23. Privilege Hour. This is the time allotted for any member of the
Sanggunian to express the sentiments of his constituents of his own official views,
opinions, comments or position on various issues and affairs of public interests,
however, the members are not immune from suit.
Section 24. Question Hour. This is a period allotted for members to ask question
from invited “resource person/s” coming from both the government and private
sectors, usually head of offices, technical men and prominent individuals, primarily
intended to seek information from the latter on certain matters that are of public
interest. This item, if properly utilized, also provides the opportunity for the members
of the Sanggunian to interact with different personalities and in so doing the principle
of “citizen’s participation” is enhanced and institutionalized.

Section 25. Approval of the Minutes of Proceedings. The minutes of the previous
session should be read and approved by the Sanggunian for authenticity. Without its
approval, the draft minutes is not a valid document. Copies of the minutes of each
session shall be made available to each Sangguniang Bayan member for review and
approval for the next session.
Only the title of the proposed measure or communication (or its substance, if it has no
title) shall be stated under the First Reading. The Secretary to the Sanggunian reads all
the items (title of proposed measures usually in the form of ordinance or resolution as
well as communications usually in the form of petition, manifesto, letter or resolution)
and thereafter the Presiding Officer shall refer it to the concerned standing committee
with or without instruction.
Section 27. Committee Reports. An official written account of the action taken by a
Committee relative to a particular task assigned to it, together with its findings or
conclusions and the corresponding recommendations, usually in the form of a
resolution.
The Chairman shall render the committee report, unless he dissents with the majority
decision. In his absence, any committee member concurring with the report and duly
designated by the said committee shall render the report.

The Committee on Rules shall prepare the Calendar of Business and a copy thereof
shall be furnished to every member of the Sanggunian not less than one day before the
date of the regular session. All items to be included in the Order of Business should
be submitted to the SB Secretariat at least one (1) day preceding any regular session.
The Calendar of Business shall consist of the following parts:
(a) Unfinished Business – refers to proposals or measures that have been left
un-acted upon, postponed by the Sanggunian at the time of its
adjournment. Their consideration shall be resumed until such unfinished
business is disposed of. Thereafter, the Presiding Officer shall call for the
Business for the Day.
(b) Business for the Day - refers to a list of items that have been reported out
by committees and are ready for deliberation on “Second Reading” as
determined by the Committee on Rules. This also includes those items for
the body’s decision on Third and Final Reading. In case an item entered
under First Reading and Referred to Committees needs the immediate
action of the Sanggunian, this shall require at least two-thirds (2/3) votes
of the members present for it to be placed in the Business for the Day
Section 29. Deviations - deviations from the prescribed Order of Business may be
done only under the following circumstances:
a. When the Sanggunian decided to suspend the rules thru an “assumed motion”
by the Chair or thru a motion to suspend the rules by a member. In any
case, the decision to suspend the rules shall require a vote by general
consent, a unanimous vote, or at least a two-thirds (2/3) vote of the
members present.
b. When the measure to be acted upon the Sanggunian is “certified by the local
chief executive as urgent”, it shall have priority over all other items of
business, and shall be considered without need of suspending the rules even
if it is not included in the Calendar of Business.
Section 31. Creation of Committees. - The following rules shall be observed in the
creation of committees:

d. Committee of the Whole – this committee is composed of the whole
Sanggunian which is being resorted to when a certain matter brought before
it could be best acted upon or resolved informally.
Section 32. Standing Committees. The Sanggunian Bayan of Lamut, Ifugao shall
create the following standing committees, the general jurisdiction of which shall be as
hereunder provided:

The Chairman of the Committee shall represent the Sangguniang Bayan in the
Personnel Selection Board (PSB).
7. Engineering and Zoning and Real Estate. This Committee shall be concerned
on all matters or questions pertaining to or related to the construction,
maintenance and repair of roads, bridges and other government
infrastructure projects; improvement and demolition of public buildings,
streets and bridges, parks and playgrounds; all matters connected with real
estate, land estates, subdivision, housing, determination of boundaries,
buildings and structures; and zoning, proper implementation of the National
Building Code.

11. Health. This Committee shall be concerned on all matters or questions
pertaining to or connected with the health, sanitation and hygiene of
residents, hospitals, health centers, medical and dental clinics, medical
care, medicines and medical supplies, pollution, industrial waste, garbage
collection and disposal; cleanliness and beautification of the community;
promotion of sanitary and healthy environment and other health and
sanitation measures.
12. Tourism and Institutional Linkages & External Affairs. This Committee
shall be concerned on all matters pertaining to or connected with the
following:
13. Peace & Order, Justice, Drugs and Rehabilitation. This Committee shall
be concerned on all matters or questions pertaining to or connected with
the drug trafficking; drug abuse and rehabilitation; peace and order,
security and safety of persons and properties; police matters and
discipline, Fire Department, Jail and Penology, Prevention and abatement of
accidents, crimes and other kinds of nuisance. The Chairman of the
Committee shall represent the Sangguniang Bayan in the People’s Law
Enforcement Board (PLEB).
15. Social Welfare and Human Rights. This Committee shall be concerned on
all matters or questions pertaining to or connected with Women’s welfare,
rights and privileges; family welfare, social welfare, Disaster, and relief
assistance, Enforcement of Gender and Development Code, Children Code
and similar ordinances, administration of justice, protection of individual
human rights as guaranteed by international laws, the Philippine
Constitution and other statutory laws; the administration of justice,
protection and violation of individual human rights as guaranteed by
international laws, the Philippine Constitution and other statutory laws.
16. Trade and Industry. This Committee shall be concerned on all matters or
questions pertaining to or connected with the establishment/operation of
all kinds of trade and industry; measures that affect trade, commerce and
industry; Development, expansion, trade, industry and investment, price
monitoring, protection of consumers,
18. Youth and Sports Development. This Committee shall be concerned on all
matters or questions pertaining to or related to sports activities and
development; youth welfare and development as responsible citizens;
inculcation of patriotism and nationalism among the youth and youth
empowerment.

Section 33. Membership, Officers, Election. – Each Standing Committee shall have a
Chairman and a Vice-Chairman, who shall be elected by a majority vote of the
Sanggunian from among its Members. The three (3) Members of the Committee shall
be selected by the elected Chairman.
The regular Presiding Officer and the Sanggunian shall have a voice and vote in all
committees.
No member of a committee shall act upon or participate in any matter in which he has
a special, direct and substantial interest.

Section 39. Vacancy. Whenever a vacancy occurs or is declared to exist in any of the
standing committees, the same shall be filled by election of the Sanggunian by a
majority of all the members of the Sanggunian, or by the Presiding Officer, or by
general consent (unanimous assent) of the members present, there being a quorum.

RULE VIII. COMMITTEE REPORTS
Section 43. Contents of Committee Reports. The committee report shall contain the
following information:.
a. Number of the Committee Report with Code provided for the purpose of
easy monitoring;
b. Name of the reporting committee or committees;
c. Brief statement of the subject matter referred to it and the action taken
thereon including information gathered during the conduct of committee
hearings or meetings and other relevant information;
d. Findings or conclusions;
e. Recommendation (preferably, in the form of a resolution);
f. Names and signature of concurring members;
g. Appendices (Optional)
Section 45. Recommitting a Measure. When the Sanggunian is not satisfied with the
report of a particular committee on a measure referred to it, the same may be re-
committed.
Section 46. Inclusion of Measure/s for Second Reading. After a committee has
rendered its report and is recommending favorably the enactment of a proposed
measure (i.e., ordinance or resolution) it has “reported out”, a copy of the proposed
measure shall be furnished the Committee on Rules which shall calendar it for Second
Reading. Before the said proposed ordinance is sponsored on the floor, the Committee
Chairman concerned thereof shall furnish every Sanggunian member a copy.
No proposed measures without draft shall be forwarded for deliberation under Second
Reading in case of Ordinance and Business for the Day in case of resolutions.
Section 47. Committee Meetings and Hearings. The committees shall determine the
frequency of their meetings or hearings. A majority of all the members of the
committees shall constitute a quorum. Committee meetings or hearings shall be held
only in a public building on a quarterly basis or as the need arises.
Unexcused/unjustified absences in three (3) consecutive meetings may operate to
relinquish membership therefore.
Section 48. Committee Reports and Orders. Committee Reports and/or Orders on
any ordinance or resolution shall be considered in regular sessions.

When a Committee submits a report, the Members thereof shall be presumed to have
concurred in the report and shall be precluded from opposing the same, unless they
have entered their objection thereto during the committee meeting.
Section 49. Period to Report. The Committee shall submit a report on the proposed
ordinance or resolution within twenty (20) days, and within ten (10) days for
resolutions after it has been referred to it.
Section 52. Urgent Measures. - Any legislative matter duly certified by the Local
Chief Executive, whether or not is included in the Calendar of Business, shall be
presented and considered by the Sanggunian in the same session without need of
suspending the rules.
The Sanggunian, likewise, may, on motion made by the Chairman of the Committee
concerned, consider a proposed ordinance or resolution as urgent and consideration
thereof shall be scheduled according to a timetable.
If said motion is approved, the Sanggunian shall therefore prepare a timetable fixing
the date on or before which the proposed ordinance or resolution must be reported by
the Committee concerned, the number of days or hours to be allotted to the
consideration of the measure on Second Reading, and the date or hour at which
proceedings must be concluded and final vote on said measure taken.
On the day set for the consideration of a proposed ordinance or resolution for Second
Reading, the same shall be read in full with the amendments proposed by the
Committee, if any, unless copies thereof have been distributed earlier and such reading
is dispensed with, thereafter, the proposed ordinance or resolution shall be subject to
debate and pertinent motions.
Section 54. Debate and Closure of Members. - In the discussion of any measure, a
motion to close the debate shall be in order after two speeches for and one against, or
after only one speech for has been delivered and more entered against it.

When several members have registered or signified their intention to speak on the
matter under consideration and when said matter has been sufficiently and thoroughly
discussed by the member speaking, the Presiding Officer, motto propio, or upon
motion of a Member, having the floor, shall desist from speaking further so that other
members may not be deprived of their opportunity to speak.
After the close of debate, the Sanggunian shall proceed to the consideration of
Committee amendments. A member who desires to speak for or against an
amendment may do so.
After the amendments have been acted upon, the proposed ordinance or resolution
shall be voted on Second Reading.
No ordinance shall be approved unless it has passed three readings, and copies thereof
in its final form have been distributed to the members at least three (3) days before its
passage, except when the Local Chief Executive or the Sanggunian certifies to the
necessity of its immediate enactment to meet a public calamity or emergency. Upon
the Third Reading of a proposed ordinance or resolution, no amendment thereto shall
be allowed, and the vote thereon shall be taken immediately thereafter and the ayes
and nays entered in the Minutes.
Upon the passage of all ordinances and resolutions the Sanggunian Secretary shall
record the ayes and nays. Unless otherwise decided by the Sanggunian, the Secretary
shall prepare copies of approved resolutions using the standard format, while it will
use the commission format in the case of ordinances. Each copy of the approved
ordinance or resolution shall be stamped with the seal of the Municipality and record
Section 59. Approval by the Local Chief Executive. - Every ordinance enacted or the
resolution approving the local development plan and public investment program
adopted by the Sanggunian shall be forwarded to the Local Chief Executive for
approval. The Local Chief Executive shall affix his initials on each and every page of
the ordinance or resolution and the word “Approved” shall appear with his signature
on the last page thereof..
Within ten (10) days after the receipt of the ordinance or resolution, the Local Chief
Executive shall return the said ordinance or resolution to the Sanggunian with either
his approval or his veto. If he failed to return the same within the prescribed period,
the ordinance or resolution shall be deemed approved.

Section 60. Veto Power of the Local Chief Executive. - The Local Chief Executive
may veto any ordinance or resolution only on the ground that it would be prejudicial
to the public welfare attaching thereof his reasons in writing.
The Local Chief Executive shall have the power to veto any particular item or items of
an appropriation ordinance, and ordinance or resolution adopting a local development
fund and public investment program or of an ordinance or resolution directing the
payment of money or creating liability. In such case, the veto shall not affect the
item/s which is/are not objected to. The vetoed item/s shall not have effect unless the
Sanggunian overrides the veto in the manner hereunder provided otherwise, the item/s
in the appropriation ordinance of the previous year corresponding to those vetoed
shall be deemed reenacted.
All veto actions of the Local Chief Executive, upon receipt by the Secretariat, shall be
referred immediately to the concerned committee for further study and
recommendation to the Body en banc.
The Sanggunian may override the veto of the Local Chief Executive by two-thirds (2/3)
vote of all its members, thereby making the ordinance or resolution effective.
The Local Chief Executive may veto an ordinance or resolution only once.
Section 62. Review by the Sangguniang Bayan. - Within ten (10) days after
enactment, the Sangguniang Barangay shall furnish copies of the barangay ordinance
to the Sangguniang Bayan for review so that it will determine if the ordinance is
consistent with law, and with municipal ordinances.
Failure on the part of the Sangguniang Bayan to take action on barangay ordinance
within thirty (30) days from receipt thereof, shall presume that the same is consistent
with law and with municipal ordinances and, therefore, valid.
If within thirty (30) days, the Sangguniang Bayan finds the barangay ordinance
inconsistent with law or with municipal ordinances, the Sangguniang Bayan shall
return the ordinance with its comments and recommendations to the Sangguniang
Barangay for adjustment, amendment or modification, in which case, the effectivity of
the ordinance shall be deemed suspended.
Not later than five (5) days after the passage of the ordinance or resolution, the
Sanggunian Secretary shall cause the posting thereof in English together with a copy
translated in the dialect used by the majority of the people in the area and shall record
such fact in a book kept for the purpose, stating the dates of approval and posting
thereof.

RULE X - VOTES AND VOTING
a. raising of hands;
b. nominal voting ( roll call);
c. secret voting
Section 66. Voting on the Question. - Whenever a nominal voting (roll call voting) is
being applied, the Secretary shall call the roll of members in alphabetical order or by
rank. As each name is called, the member shall announce his vote by stating ”Yes” or
“No” as the case may be. As a general rule, a member may explain his vote but not to
exceed three (3) minutes.
A second roll call may be requested by any member from the Presiding Officer but this
time only the names of those who failed to vote shall be called. This is to give another
opportunity to those who failed to cast their vote to exercise their right and also
determine the number of members who might have violated the “rule of abstention”.
After this second roll call, no other request of the same kind shall be entertained by
the Chair.
Section 67. Voting Restrictions. - No member can vote, or allowed to vote, on any
measure on which he or any of his relatives within the third degree of consanguinity or
affinity has direct or personal pecuniary interest. This rule, however, does not apply in
voting for elective positions in the Sanggunian where a member, as a matter of right,
can vote for himself.
Any member who opts to abstain from voting shall explain his/her reason for
abstention.
Section 68. Change of Vote. - A member may change his vote but only when the
result of the voting has not yet been announced by the Presiding Officer. Otherwise,
he can only change his vote by unanimous consent of the members present. Provided
that the rule shall not be applied if voting is by ballot.
Section 69. Vote by a Late-comer.- No member who comes late during the session
while voting is in progress, shall be allowed to cast his/her vote provided the result of
the voting has not yet been announced by the Presiding Officer..
Section 70. Allowable Motion During Voting. - Except for a late motion pertaining to
a question of quorum, no other motion shall be entertained by the Presiding Officer
while voting is in progress.
Section 71. Tie Vote. - A tie vote resulting from a vote taken on any motion, measure
or proposal shall be construed to mean that the particular motion, measure or
proposal is defeated, unless the Presiding Officer decided to break it. Exception to this
rule is when the “motion to appeal from the decision of the Presiding Officer” is put to a
vote and it resulted in a tie. In this case, the tie vote is considered to sustain the
decision of the Presiding Officer.
Section 72. Breaking a Tie. - In case of a tie, the Presiding Officer is allowed to cast
his vote. He is, however, precluded under existing laws to cast his vote in order to
create a tie.
Section 73. Majority Vote of All the Members. - As provided for under RA 7160 and
its Implementing Rules and Regulations, a majority vote of all the members of the
Sanggunian is required in the following circumstances:

a) Enactment of ordinances levying taxes, fees or charges prescribing the rates
thereof for general specific purposes and granting tax exemptions,
incentives or reliefs.
b) Adoption of resolution authorizing the Mayor to negotiate bonds and
contract loans and other forms of indebtedness.
c) Enactment of ordinances authorizing the floating of bonds or other
instruments of indebtedness for the purpose of raising funds to finance
development projects.
d) Adoption of resolution authorizing the Municipal Mayor to lease to private
parties such buildings held in a proprietary capacity subject to existing laws,
rules and regulations.
e) Enactment of an ordinance granting a franchise to any person, partnership,
corporation or cooperative to establish, construct, operate and maintain
ferries, wharves, markets or slaughterhouses, or such other similar activities
within the Municipality as may be allowed by applicable laws; Provided that
cooperatives shall be given preference in the grant of such a franchise.
f) Adoption of resolutions concurring with the appointments issued by the
Mayor to heads of departments and offices as required under RA 7160.
Section 75. Plurality Vote. - A decision of the Sanggunian thru a “plurality vote” shall
be valid only and enforceable if it is the result of an election of officers of the
Sanggunian or members of committees. No legislative proposal or measure of
whatever nature shall be passed adopted or enacted by the Sanggunian thru a plurality
vote.
Section 76. Percentage Vote. - For purposes of this Section, a percentage vote shall
be construed to mean as “proportion of a certain whole”. Percentage vote shall be
applied in the following:

Abstention, if ever allowed to a member, shall not be considered in computing the
majority vote. Since abstention is not a vote, it does not count either way. Mere
silence and abstention are not the equivalent of affirmative votes or of negative votes
Section 78. Record of Proceedings. - The Sanggunian shall keep a “journal and
minutes” of its proceedings which may be published upon resolution of the majority of
the members thereof.
Section 80. Reading and Consideration of Minutes. - The minutes of the previous
session shall be submitted by the Secretary to the Sanggunian during its succeeding
regular session. The Sanggunian shall first determine if there are corrections to be
made on the minutes (narrative/summary) and act on it accordingly before the same is
adopted by the body and becomes its property. Consideration of the minutes shall not
be dispensed with. Reading of the journal (verbatim) may be dispensed with if the
members were already furnished a copy thereof beforehand. Being all responsible men
and women, the members are presumed to have read the minutes already before they
came to the session. In any case, the minutes submitted by the Secretary shall be acted
upon by the member present, one way or the other.
Section 81. Contents of Minutes. - The minutes contains the following information:
Section 82. Decorum Defined. – The term “decorum” refers to the propriety of
conduct and decency of words or speech of members in a deliberative assembly or
body.

c. Relevance of Statements to Issue. - All questions, discussion, or statements
by every member should be germane to the pending question or issue being
deliberated upon.
d. Refraining from Personalities. – Personalities shall be avoided at all times.
It is the member’s proposal or “motion” that is at issue, not the member
himself.
e. Coursing Remarks and Questions to the Chair. – All remarks, questions
and answers should be coursed to the Chair.
f. Speaking Against Own Motion is Not Allowed. – A proponent of a motion is
not allowed to speak against his own motion except when his motion has
been amended to such extent that its main substance is no longer his or is
entirely different from his original motion. In this instance, since it is no
longer his motion, he may even vote against it.
g. Observance of Time Limit. – No member shall speak longer than the time
allotted to him. In case there is no time fixed, it is understood that the “ten-
minute rule” shall not be exceeded.
h. Civility in the Conduct of Members. – Members are expected to manifest
proper deportment. When someone has the floor, everybody should be
seated. No member shall impugn the integrity or character, nor question the
motives, of another member.
i. No monopoly of Discussion or Debate. – No member shall monopolize any
discussion or debate. No member shall speak more than twice on the same
subject matter without the consent of the body. No member shall be granted
a second turn to speak until all who wish to avail the first opportunity shall
have spoken.
j. Member May Change Vote. – If the method used is not by ballot, a member
may be allowed to change his vote provided that the result of the voting has
not yet been announced or the votes have not yet been counted.
k. Recognition First Before Speaker. – No member shall speak before the body
unless the Presiding Officer duly recognizes him, except when he proposes
the following motions:

4. When is barred from the Internal Rules of Procedure
Section 84. Wearing of Uniforms. – All members are required to wear their uniforms
when attending sessions.
Section 85. Going Out During Sessions. – No member shall be allowed to leave the
chamber when session is going on. Unless otherwise permitted by the Presiding Officer
for emergency matters.
Section 86. Leaves of Absences. – All leaves of absences from any session of the
Sanggunian should be applied for and submitted to the Presiding Officer for action.
The prescribed form for leave application will be Civil Service Form No. 6 (Rev. 1984)
where the purpose or reason of such leave will have to be clearly indicated and
whether such leave will be with or without pay. An application for a vacation leave for
one full day or more should be filed in advance, or whenever possible, five (5) days
before the effective date of the leave. On the other hand, an application for sick leave
should be filed immediately upon the employee’s return from such leave. In cases
where the Sanggunian Member will undergo medical examination or a scheduled
operation, or was advised to rest in view of ill health, the sick leave may be applied for
in advance and duly supported by a medical certificate.
Section 87. Discipline of Members. – The Sanggunian may punish its members for
disorderly behavior and with the concurrence of two thirds (2/3) of all its Members,
reprimand, censure, suspend or exclude from the session a Member, but if the penalty
is suspension, this shall not exceed sixty (60) days.
NB:To effect the implementation of the above rules, the LMB Chapter President
and/or the Chairman of the Committee on Rules are appointed Sergeants-at-
Arms. All fines/penalties will be collected by the Cashier 1 of the LGU of Lamut
and shall be remitted to the Records Officer I of the Sangguniang Bayan and
shall accrue to the Sangguniang Bayan Fund, disbursements of which will be
made in accordance with guidelines that will be set up by the Members.
Section 88. General Rule. - No member shall speak without first “obtaining the
floor”. A member who has obtained the floor shall address all his remarks to the
Presiding Officer. He shall conduct himself with proper decorum by confining his
remarks or arguments to the question under debate and avoiding personalities.

No member shall speak for more than fifteen (15) minutes on a particular issue or
question being debated upon unless he is allowed to do so by a majority of the
members present.
During the period of amendments, every member shall observe the so-called “five-
minutes rule”, that is, remarks or argumentation by any member on each proposed
amendment shall not exceed five (5) minutes.
a. While having the floor, the member may be interrupted in his speech or talk
by the Presiding Officer to state a point of order, to respond to questions
from the floor, to clarify something related to the issues being discussed or
make certain remarks within his privilege.
b. The speaker may also be interrupted by any member if the latter desires to
ask questions through his privilege to interpellate and by proposing the
following motions:
a) Point of Order

c) Point of Parliamentary Inquiry

Section 91. Fines – There shall be fines to be imposed upon every member of the
Sangguniang Bayan for the following instances:

Section 92. Collection of Fines - The method of collection shall be determined by the
Sanggunian Bayan.
Section 94. Who May Move. - When a motion, report or proposed measure is adopted
or lost, it shall be in order for the Member who votes with the majority to move for the
reconsideration thereof on the same or succeeding session day. Such motion shall
take precedence over all other questions, except a motion to adjourn to raise a
question of privilege and a call of order.
Section 95. Recording of Motions. - Every motion shall be entered in the Minutes
with the name of the Member making it, unless it is withdrawn on the same day.
Section 96. Reading and Withdrawal of Motions. - When a motion is made, the
Presiding Officer shall state it before being debated. Except as herein otherwise
provided, a motion may be withdrawn any time before its approval or amendment.
Section 100. Motion to Cover One Subject Matter. - No motion shall cover more than
one subject matter.

Section 101. Amendment of Title. – An amendment to the title of a proposed
ordinance or resolution shall not be in order until after the text thereof has been
perfected. Amendments to the title shall be decided without debate.
Section 102. Call to Order. - A motion to read any part of the Rule is equivalent to a
call to order and takes precedence over any motion other than to adjourn.
a. Those affecting the rights of the Sanggunian: the safety, dignity, and the
integrity of the Members;
b. Those affecting the rights reputation and conduct of the Members,
individually, in their capacity as such Members;
Subject to the five-minute rule, questions of privilege shall have precedence over all
other questions, except a motion to adjourn.
Section 104. Privileged Questions. - Privileged questions are those motions or subject
matters, which under the Rules, take precedence or other motions and subject matters.
Section 105. Who Can Move. – Any member of the Sangguniang Bayan of Lamut could
move for the suspension of any part of this “Internal Rules of Procedure” at any
particular session, except those prescribed by existing laws.
Section 106. Vote Required. - No Rule shall be suspended except by general consent
or by a two-thirds (2/3) vote of majority of the Members present, a quorum being
present.
Section 108. Effect of Suspension. - If the Sanggunian votes to suspend the Rules, it
shall forthwith proceed to consider the measure. A two-thirds (2/3) vote of the
Members present shall be necessary for the passage of said measure, a quorum being
present.
Section 109. Official Seal. - The Sangguniang Bayan of Lamut shall adopt the Official
Seal of the Municipality of Lamut.
Section 110. Amendments. – Any portion of these Rules maybe amended by a two-
thirds (2/3) vote of all the Sanggunian Members. Changes to the Rule can be
incorporated.

2. The utilization of funds from the Share of the Barangay Government from the
National Wealth shall be strictly in accordance with the provision of Joint DILG-
DOE Circular No. 98-01, dated September 30, 1998. Accordingly, 80% shall be
for the lowering cost of electricity & 20% for livelihood development projects;
3. The disbursement of funds from the 20% Development Fund shall be strictly in
accordance with approved Annual Investment Plan of the barangay; and
4. The usual accounting rules and regulations and auditing requirements shall be
observed in the disbursement of funds from the appropriations authorized in the
Annual Budget that it shall be the sole responsibility of the barangay government.

national wealth for each host LGU;

20/100 (PhP117,786.20) was appropriated under the 2013 20% Municipal Development Fund for
the purchase of Barangay Panopdopan Sanitary Land Fill;
WHEREAS, the said amount was fund transferred to Barangay Panopdopan as per request of
the Barangay Council;
WHEREAS, the Barangay Council has identified the lot for the landfill but cannot possibly
comply with the rules and regulations set forth by the Commission on Audit;
WHEREAS, the construction of spring box at Matdoc, Panopdopan is one priority project of the
barangay as manifested in their 2013 Annual Development Plan;
WHEREAS, in order to address other priority needs of the constituents, the Barangay Council

and current operating requirements of the Local Government Unit (LGU) that
subsequently serve as basis for the preparation of Annual and Supplemental Budgets;

Operators hereunder enumerated have complied with the requirements for franchising as
stipulated in the Franchising Requirements Guideline Memorandum Circular No. 01, Series of
2008 dated September 10, 2008 and Municipal Ordinance No. 2010-001 and other local laws:

WHEREAS, the said office equipment specifically a long firearm was not procured due
to many requirements that are being required for licensing and that the office doesn’t
consider it already as priority;
WHEREAS, due to the dilapidation of some furniture and fixtures in the said office, it
was decided that the amount of Twenty Thousand (PhP20,000.00) previously budgeted

WHEREAS, the PNB-Lagawe Branch acted on the request and provided the LGU-Lamut a
separate Account Number 17477900033 for the Twenty Percent (20%) Development
Fund of the Municipality;
