MOTION TO REVIVE CASE

COMES NOW, Private and minor complainant NICOLE ALEXANDRIA T.

SOFIA, unto this Honorable Court respectfully states THAT: :

1. On the Order of this Honorable Court dated August 8, 2017, the case was
provisionally dismissed provided that the parties comply with certain terms of
conditions;

2. The third condition of this Court is that:

“3. The accused and his wife is prohibited within the radius of one
kilometer (1 km.) from the school and residence of the minor complainant.”

3. However, on June 18, 2019, Accused herein, violated the said terms and
conditions and went to the school of the minor complainant, Nicole Alexandria
T. Sofia during school hours;

4. Moreover, the accused on the said date even stalked Nicole Alexandria T. Sofia
and went to asked malicious questions to several school personnel;

WHEREFORE, premises considered, it is most respectfully prayed of this

Honorable Court that this Motion be given its due weight and credence and that the
case against Tyrone Plaza Sofia be REVIVED.

Other reliefs and remedies just and equitable under the premises are also prayed for.
