COMPROMISE AGREEMENT

This Agreement executed this ___ day of June, 2018 at Legazpi City,
Albay, by and between:

BABY RUTH F. ROGACION, Filipino, of legal age with address at


23 Olbes St., Vel-Amor Subdivision, Legazpi City represented herein by Atty.
Noel Allen R. Bose (hereinafter referred to as “the plaintiff”).

-and-

OSCAR SANTILLAN, Filipino, of legal age with address at Lot 18


Block 15, Ma. Aurora Subdivision, Gogon, Legazpi City, represented herein by
Atty. Lizglen L. Gliponeo (hereinafter referred to as “the defendant”).

WITNESSETH: That -

WHEREAS, the plaintiff and the defendants are parties in Civil Case
No. 11399 entitled “Baby Ruth Rogacion vs. Oscar Santillan and the occupants of Lot
18 Blk 15, Ma. Aurora Subdivision, Gogon Legazpi City covered by TCT No. 28159”
(hereinafter referred to as “the case”) for Accion Publiciana pending before the
Regional Trial Court of Legazpi City.

WHEREAS, the parties desire to buy peace and wish to avoid a


protracted litigation in this case.

NOW THEREFORE, in consideration of the foregoing and the


further covenants hereinafter set forth, the parties agree as follows:

1. Plaintiff shall allow the defendant and his family to continue


occupying the portion of the lot covered by Transfer Certificate of Title No.
28159, which the defendant and his family are currently occupying (hereinafter
referred to as “the subject property”);

2. Plaintiff shall not evict the defendant and his family from the subject
property within one (1) year from the entry of judgment in this case;

3. Plaintiff shall offer to sell the subject property to the defendant should
she decide to sell the same. Plaintiff is not bound to sell a portion of the subject
property;

4. Plaintiff shall give the defendant the right of first refusal in the event
that she decides to sell the property;

5. Defendant is authorized to represent those occupying the subject


property;

6. Defendant shall neither introduce new improvements upon the
subject property nor shall he lease or sell any portion of the property and he
shall maintain the cleanliness and orderliness of the subject property during
their occupation;

7. Defendant shall, without a need for any demand, voluntarily vacate


the subject lot within one (1) year from the execution of this compromise
agreement. Defendant shall remove all improvements he and his family
introduced over the property at his expense, and shall return the subject
property in a proper order;

8. Defendant shall allow plaintiff to build fences and post signages upon
the subject property one (1) year after entry of judgment in this case, or when
defendant vacates the subject property on an earlier date.

9. Defendant shall notify the plaintiff of their intended date of departure


should they vacate earlier than one (1) year after entry of judgment in this case.

10. The signatories to this Compromise Agreement hereby represent and


warrant that they are duly authorized to execute this Compromise Agreement;

11. The parties or their assigns hereby waive, renounce and forever
quitclaim all their respective claims and counterclaims subject of the instant
action as well as those that may arise therefrom, in connection therewith or in
relation thereto, except the execution of this Compromise Agreement or any
other proper action as a consequence of the violation of the terms of this
Compromise Agreement.

12. The foregoing covenants are not contrary to law, morals, or public
policy and the parties bind themselves to comply strictly with their
undertakings.
