SUB: Collection of funds/ donations by employees, their spouses/ dependents etc.,


from customers and outsiders

Attention of branches/ offices is drawn to Circular No.88/2016 dated 17.02.2016 and


224/2016 dated 20.04.2016 wherein it was reiterated that collection of funds by the
employees whether workmen or officers in whatever form or for whatever purpose from
the public / customers will be a clear misuse of their office and the concerned employees
indulging in such acts will render themselves liable for Disciplinary Action in terms of
Office Memorandum No. F.No.14/56/2015/Vig dated 28.01.2016 and F.No.14/56/205/Vig
dated 28.03.2016 of Ministry of Finance, Department of Financial Services (Vigilance
Section).

Now, Ministry of Finance, Government of India, Department of Financial Services


(Vigilance) vide F. No.14/56/2015/Vig dated 09.07.2019 advised that the practice of
obtaining donations/ illegal gratifications from the contractors or other persons having
commercial relationship/ official dealings with the Bank should strictly be avoided and if
any such incident comes to light, then disciplinary action should be initiated against
delinquent official(s) and the concerned official(s) should be proceeded against for the
offence of bribery under Prevention of Corruption Act, 1988.

In view of the above, for information of all the employees the guidelines are reiterated as
under:

1. The collection of funds/donations by employees, their spouses/ dependents etc.,


from the general public/ customers shall be considered as clear misuse of their
office.

2. Practice of Employees’ welfare associations run by employees/spouses of


employees/dependent of employees getting/ obtaining donations, advertisements
or sponsorships from the contractors, customers, vendors or persons having
commercial / business relationships with the Bank is also construed as misuse of
office.

3. It shall be noted that employees or trade unions or employees’ welfare


organizations should not collect donations, advertisement tariffs or raise funds in
any form whatsoever from customers/ outsiders. The Trade Union etc., may accept
contributions only from the willing employees which may form the fund for trade
union purposes.

4. All the employees shall take note that they are prohibited from collecting funds
from customers/ public/ outside agencies/persons who have commercial/business
dealings with our Bank. If any employee/spouse/ dependent of employee are found
collecting funds/donations for any purpose whatsoever, in violation of Bank’s
instructions, the same shall be treated as a “Major Misconduct” attracting
disciplinary action.

Branches/ offices shall take note of the above for strict compliance.
