NOTIFICATION

It is noticed that Mobile food court vehicles/Carts are operating and

increasing in numbers day by day and causing inconvenience to the road users,
traffic congestion and affecting public safety during peak hours in IT Sector and
other areas in entire Cyberabad. There is a need to frame guidelines for such
enterprises to operate them and to prevent accidents, property, traffic
congestion and inconvenience to the Public / Residences/ Organizations /
Educational and other Institutes / on the Respective Roads / Areas in entire
Cyberabad Police Commissionerate.

After due representation and consultation with the stakeholders

concerned and taking into consideration, the present circumstances, in exercise
of the powers conferred upon me under section 7 Clause (1) of Cyberabad City
Police Act r/w Section 21 Clause (1) (b) of Hyderabad City Police Act 1348-F, I,
C. V. Anand, IPS, Commissioner of Police, Cyberabad do here by notify for the
information of general public, that the following restrictions/rules are imposed
as given below for different categories of Mobile food court vehicles/Carts.

1. All Mobile food court vehicles/Carts requiring to operate in Cyberabad

Commissionerate jurisdiction will have to seek permission from the office
of DCP (Traffic) by applying in prescribed format.
2. This will also be applicable to all LMV/MMV/HMV type of Mobile food
court vehicles/Carts.
The mobile food vending cart/van owners must obtain the following
permissions from the concerned government authorities, before they actually
run the business.
1. Registration with RTA: Food vending vehicles must be registered with
the concerned RTA of the area and to certify that the vehicle is fit to run
a mobile canteen with closed body under commercial category. The
mobile food vendors must submit the recent road tax payment receipt.
 2. GHMC/Local self Government:- The vendors must obtain trade license
to run the business and also obtain NOC from Public Health
Department a sub unit of GHMC from the concerned designated
authority stating that the vehicle is suitable for food vending and
maintaining the food standards and fitted with a Hand Wash/Portable
Drinking water facility and Garbage handling unit, standard of food
norms and its hygiene.
3. Insurance Policy:- The mobile food court vendors must obtain business
insurance policy for health and safety of employees. The food vendors
should have public liability insurance to cover injuries to the public and
product liability in case anyone gets food poisoning as a result of eating
food or any disasters/ natural calamities.
4. VAT Registeration:- The vendors must obtain registration certificate
from concerned authority.
5. NOC from Fire department:- The vendors must obtain NOC from the
concerned district fire officer to run the mobile food court/cart and must
place mobile fire extinguishers has advised by the fire officers.
6. Commercial Cylinders:- The vendors must use commercial cylinders
only and must submit the consumer number etc., details.
7. Gas and Electrical Safety certificate:- All gas – powered equipment
used for catering purposes such as gas safe engineer. It is also
important to get all the electrical equipment tested every 6 or 12 months
from a registered electrician to ensure that it si safe to use.
8. NOC from Land owner (if operating in private land):-
1. The mobile food vendors shall submit NOC from the land owners if
they intend to operate mobile food court/cart in a private land.
2. Self declaration to be submitted by the operators in case of the own
land possessed by Food Court operator.
9. Location Map:- Rough location sketch to be provided by the mobile food
court vendors.
After obtaining all the above permissions/NOCs all the mobile food
vendors must obtain police permission from traffic department of the Cyberabad
Police Commissionerate specifying the place of position of Food
Cart/Truck/Van, timing etc enclosing all the permissions obtained from
departments concerned as mention above. The carts will be permitted to place
within a minimum width of 60 feet/100 feet on main roads and 30 feets in the
internal roads and they shall not encroach on to the main road other than the
place allocated by the Police. The placing of the truck would be as decided by
the Traffic Police based on applications received by the mobile food vendors.
 The timings for the placing of the food trucks will be decided depending
on location and local situation. The timings and movements of the food
cart/truck/van will be fixed by the traffic department only.
Necessary rules and guidelines will be prescribed along with the
permission which will be binding on the applicants.

The above restrictions will come into force from 04.03.2016 and those
found violating the above restrictions will be prosecuted as per MV act, City
Police Act and other laws as applicable.

Undertaking:

2. There will be no danger caused to anybody by this activity.
3. The entire liability of any direct or indirect loss whether human or material
as a result of this activity will be borne by the management/Individual

4. In case of any violation of laws/rules the organizer/management is liable
for legal /criminal action as applicable.
5. This permission is liable to be terminated at any time without assigning any
reasons.
