COMPROMISE
Sir,
With the intervention of some respectable persons Claimant
and O.P/Respondents arrived at the following compromise:-
1. That the claimant has filed a petition against the respondents
for the grant of compensation on account of injuries and
permanent disablement sustained by claimant in a Motor
Accident but both the parties want one time settlement and
respondent no. 2 National Insurance Co. Ltd. wants one time
settlement and reedy to deposit suitable
payment/compensation without intervention of the Tribunal

and no payment, balance and compensation is due against the

all the respondents, as it is evident from the settlement lying
on record and the claimant has waived the liability of
respondent No. 1 Shri Kapil Agrawal (Owner of the truck) and
respondent No. 3 Shri Ram Kumar (Driver of the truck) in lieu
of payment made by the respondent No. 2. National Insurance
Co. Ltd. (Insurer of Truck)
2. That the respondents No. 2 National Insurance Co. Ltd.
(Insurer of Truck) have no objection in the above compromise
and he will liable to give all the payment/compensation
toward the respondent No. 1 Shri Kapil Agrawal (Owner of
the truck) and respondent No. 3 Shri Ram Kumar (Driver of
the truck) accordingly compromise.
3. That it is very essential in the interest of justice and equity that
compromise between the claimant and the respondents be
adjudicated in terms of above compromise.
It is therefore respectfully prayed that a suitable order in
the wake of the above circumstance compromise may kindly
be passed in the above noted petition.
