Tax Clearance for foreigner/expatriates in Malaysia

Sometimes you have to leave your company for some reason. And as a foreign worker, before your last day, you may
need to cancel/ shortened your working visa. But, before you are able to do so, you should clear your tax. And
sometimes, clearing your tax might be a hassle for some people if you don’t have any information on how to do it.

Clearing tax in Malaysia is actually quite simple if you have the check list. So, I’ll share with you my check list for the tax
clearance in Malaysia.

What you need to prepare:

Entry and Departure Schedule : you may record your entry and departure schedule based on the stamps on your
passport. Yes, I know it’s sooo hard especially if you are a frequent traveller, but there’s no choice! psstt, Excel
comes handy to solve this problem, feel free to use it)
Flight ticket to exit Malaysia OR future company o er letter
Acknowledgement receipt e-BE for last year assessment : Lost your receipt? don’t worry, you can get it by logging
in to ezhasil website in https://ez.hasil.gov.my/CI/
BE Form : you can also get it from ezhasil
Original Passport
Passport photocopy (Full pages)

EA Form from previous year: That’s why, don’t throw away your EA Form after you declare your tax! In some
cases, you might need to present ALL of your EA form during your employment in the current company
By any chance you have claimed for any tax relief or tax rebate, you may need to present the original copy of the
receipt. So, don’t lose your receipt, otherwise you might need to pay the penalty

What your current HR need to prepare:

Leaver form (Cp21) : If your HR is experienced in handling expatriates, then this form will be familiar to them
EA Form for current year assessment

That’s it! what you need to do now is:

1. Call LHDN at 1-800-88-5436 (LHDN) and then ask where is your tax le located. Because you need to go to the
speci ed branch to clear your tax
2. Go to the branch that they speci ed, and don’t forget to bring all of the documents I mentioned earlier
3. Go to the counter and just tell them you want to do your tax clearance, and you all set
4. Typically, they will return your tax clearance documents after 5-7 working days, so please plan your last date in
your current company accordingly.

I just want to clarify, is the entry and exit schedule for the whole year 2017 or only while on employment pass ? As previously I have
been on a student pass here since I was in University. It is only schedule as per the employment contract date?

Hi,
Yes, you may go to the immigration and ask for a print out of your entry/exit.
Of course you may need to ask your embassy to write a declaration letter that states you are the owner of the lost passport.

mulai kerja lagi di jakarta
Dan lagi kalau misalnya tax clearance saya belum selesai, apa saya bisa pergi dari malaysia dulu?

Tax clearancenya sendiri tergantung LHDN nya tempat rahma ngurusnya.
Biasanya gaji terakhir di company tempat rahma resign, bakal di hold dulu sama mereka, kalau ga bikin tax clearance, ya gajinya
gak cair biasanya yg bulan terakhir.

Hi,
The duration to complete your tax clearance will vary based on the lhdn o cer that take care of your documents.
But given that your request is around chinese new year, I believe it would take a bit longer.

They count the residency status per Financial Year.

I have a question. i have changed the company, so previous company income tax i have settled and cleared already..
currently i m working in a di erent company. i wanted to le the income tax do i need to Submit the EA form from the
both employer or since i already cleared i only can get from new employers EA form?

Hi Khrisna, I assume you change company in 2017? You need to sum the value from EA given by the old company
and EA from your new company.

Regarding to the Entry and Departure Schedule form, would you mind clarifying to me about the two column named “Total days”?
As I am an expat, there’s a little bit di cult to me to understand Malaysian words.

Hi Steve,
Total days is the days you spent in each country.
Example:
Enter Malaysia – 1 Jan, Exit Malaysia 30 Jan, Total Days=30 Days.

I was on maternity leave and now cannot travel back to Malaysia due to health concerns . My husband at malaysia will be doing a tax
clearance on behalf of me . I have provided him a authorisation letter to do so .
He will be travelling back to home country in another week and he will go to lhdn to submit my documents tomorrow .

May I know whether lhdn sends out the tax clearance certi cates directly to my employer via post or email?
or we have to manually go collect in person and then provide to my employer?

Since my husband is returning in a week , are there any alternatives to reach out the clearance certi cate to my employer ?

They could also send the clearance letter to your employer directly via posmalaysia, but usually it’ll take around
1month to reach your employer.

It depends on the o cer, usually they’ll ask only for the recent receipts

i am an expat from India and I am currently in employment pass in a company . i have a got a new o er and i am switching company
within Malaysia. The new employer asked for tax declaration and i gave 2017 tax clearance letter .

Since i am joining them in 2018 july do i need to do the tax clearence for 2018 (jan to june) or this 2018 tax will be taken over by my new
company and the tax can be cleared in 2019 .?

Kindly help on this issue

Hi,
You need to do the tax clearance, as the old company will usually hold your last witdrawn salary, until you clear
your tax.

I was taxed as a resident for 2017(stayed for 182 days). I stayed for consecutive year 2018 for 4 months till april ,Will I be
taxed as a resident for 2018 as well?.Initially my tax was RM 3070 later when I requested for tax clearance it was revised to RM 9352..Am

I am working in Malaysia Since 15th January 2018 and my last working day was 13th August. I went to LHDN on 23rd August and
submitted all tax clearance documents and got the acknowledgement receipt. Now in between due to some issues my last warking day
changed to 14th September and I have already booked my ights to go back to my home country.

In such case can anyone else can do the tax clearance on my behalf if I authorized to someone please let me know urgently.

Is this your rst year in Malaysia? If yes, then you couldn’t refund the 28%, since that’s the tax rate for non-
resident.

Dear Sir,
I used the foreigner e-gate at KLIA airport a few times and therefore some stamps are missing from my passport.
As such I cannot demonstrate that I have spent more than 182 days in Malaysia.
Is there any other way I can do that? Perhaps getting a record from the immigration or showing my pay slips during that time?

My family and I left Malaysia without cancelling the EP Or a tax clearance. Consequently, the sponsoring agent submitted
a police report to cancel the work permit, as required by law.
1. Can I still visit Malaysia or are my family and I blacklisted for a period of time?
2. Can I le my 2018 tax return and tax clearance without any problems? 28% of salary was taxed and I received the EA FORM from the
sponsoring agent as well?
3. Is it even worth trying to le a tax return, or too much of a hassle under the circumstances?

1. You can still visit Malaysia, the di erence is, you are going to need tourist visa instead.
2. Yes you can le the tax for FY2018 based on your EA form.
3. It depends on your salary bracket (the margin between your tax rate vs 28%), but I could say it’s quite worth it, given that you
are in MY for more than 182 days in 2018.

The processing time takes about a week, they usually going to post it to your company. But if you want speed up
the process, you can tell them that you want to collect it yourself, and explain them that ur leaving soon.

clearance they ask me to pay extra because I stayed in Malaysia less than 180 days. For company work purpose only I went to India and

Hi Kanan, by the regulation, if you are staying less than 182 days in a year in Malaysia, you are obliged to pay
using non-resident tax ( at 28%). By right, the rst time you entered Malaysia, your HR should deduct your salary
by 28% to avoid any disputes during tax clearance.

Thanks for your reply. I am working in Malaysia from 2012. Only 2015 and 2017 only I stayed in Malaysia for
less than 182 days. 2017 i stayed 162 days. my company give me one letter to me, there they mention they
only ask me to work from India. My question is if I submitted that document may I get tax relief from 28%?

If you are staying in Malaysia for <182 days in a year, then you are Non-resident.
Hence, you can’t be taxed using resident tax, and refund is not possible.

Hi, the clearance letter is usually needed by your company to release your last month salary, without that letter,
they won’t give you your last mth salary.

Btw, you can explain it to LHDN that you’re leaving this country soon, and ask to collect the letter (usually they’ll sent release letter
to your company using Postmail)

In my opinion, is When you have submitted the tax clearance letter that time to give 4 email address or phone number.
In daily or 2 days one time you send the email to the tax o ce employee. then only give at least 10-14 days. I got the tax
clearance that way
only.

I have been working in Malaysia for few years now and have led for fy2018 recently.

I changed my passport details last year after renewal and now in EZ Hasil i can’t retrieve any of my previous records (acknowledgement

I have been trying to call LHDN for 2 days on a row however they do not pick up a single time saying line busy.

Is there any way i can retrive my past records?

I believe you want to retrieve your BE receipt? If that’s the case, you may go to nearest LHDN branch, and explain
your situation. Explain about your situation that you can’t retrieve past BE receipt due to the system limitation.

job.
so, I am planning to attend an interview in Malaysia. otherwise, I will come to Malaysia and search job Malaysia only.

weather Malaysian government are allowed to come and search for the new job?

If you enter Malaysia using social visit visa and do your interview in Malaysia then should be okay, as long as you
don’t overstay (kindly check your visa).

Problem will come to you if you overstay in this country without any single visa.
