e) "Bad Order C'4nt.ainer'" means container that is physically damaged which may allOW

q) "Chassis" means an equipment used to cany containers from one place to another under

r) "Container" 'means a Structure So designed to hold and' keep articles, materials' and

handling and transport" generally, having an internal volume or capacity of not less than
one (1) cubic meter. Containers are further defined according to their uses as dry cargo,
refHgerated,liquidbUlk,platform, open top, solidbulk,ventilated, etc.

s) "Containerized/Container eaigoes" means,'cargoes packed in containers for easy ,

t) "Container F~ghf Sta1;ion"means normallya warehoUseor a transit shed ad,1ace!1t to


the Container Yard (CY) used for sorting 'and storageof containercargo both for import

u) ~CotItainer Tally Sheet" means cargo receipt;issUedby the ship's checker or agent and
acknowledgeby the arrastre's ch~ as evidenceof receipt of containers..It indicates,

v) "Container Terminal" means a port fadlity designed to providean inter,ratEduse of

dd), "Excreta" means waste matter excreted from the body, as sweat, urine or feces.

gg) "Full Container, Load" 'means a container loaded with cargoes beJonging'to a single

locomotives,bulldozers,graders, payloaders,transit mixers, and the like,

pier,and is,used for the temporaryor short-termstorageof goods in transit,or to be shipped
or discharged from a vessel., ' ,

x) ~Trimming" means the balancingof a vessel by shiftingcargo, etc.

xi) "Vennin" means any troublesome, filthyor destructive animals.

xii) ''Vehicle'' includes 'any carriage traveling on Its own wheels or nJnners and used or
intended to be used for the conveyance or canying or persons, animals or goods.

'xiii) "Vessel".includesany ship boat or any waterborne craft used in the conveyanceor '

canying ~f persons, animals, or' goods. . , '

xv) 'Wharf' means a continuous structure 'built parallelto or along the margin of the sea or

discharge cargo, em,barkor disembark passengers, or lie atrest.

ARRIVALS AND DEPARroRES

Section 1.. Notice ofAnivaI. - The owner or agent ofeJery vessel iOtendinQto call at a port,
whether private' or public, which is within the .jurisdiction of the Authority shall, w~in the time
specified in Section 1, Article IV (Berthing Regulations) of these Regulations, prior to the ETA
give notice in writing to tI1e Authority of its arrival, and make application for a-berth. if it is
intended to berth at the wharf, pier, or anchorage within the Port or harboi- limits. In addition,
the master of the vessel shall contact the CPAby radio orot:t1$' means suffident to t::J:JnVeythe
message. For domestic.vessels, the 'shipowner or agent shall show proof that such vessel is
possessed Ofa vaUdMARINA authority either in the form of a Certificateof PublicConvenience

signpls shall remain hoisted until the proper officer has given the permiSSion'to lower

b) No vessel other tha~ an authorized vessel shall approach within 200 meters to a vesset
which is exhibiting 'the Immigratiori, H~lth, or Customs signals. An authorized vessel
shallmeanan Immigration,Health,Customs,PilOtLaunch;PCGvessel,or CPAvessel. .

c) No person other than a pilot or authorized govemmeotofficer(s) Qrduly authorized ship


agents' may board ot' disembark from any vessel coming from a foreign port until the

Section 7. Laid'UD Vessels. ~

Section,9.. Transfer of Dangerous Carao. -,Without the written permission of the Authority
and previous dearance of the BOCand such other' clearance required by other government
agendes, no transfer of dangerous import/export cargo shall be carried out either between two
(2) vessels anchore.d in' a .port, or in the' approaches to a port, or between one vessel Jying
alongsidea pieror wharfand another vessel lyingalongsidethe formervessel. In the case of
domestic cargo, the Authority'spermit,s necessary, and such other permits as may be required .
byproperauthority. .

The term "dangerous cargo" as ,used in this Sectidn means any,solid, gas, or. liquid which is
obnoxious, corrosive, Infla"1mableor wh!ch exhibits-dangerous properties that likt;!lyendangers ,

the safetyof the vessel(s),ltscargoand/orpassengers, or physicatportfacilities. ','

passing through navigable rivers, Straits, chanllelswithin the Pilotage Districtof Cebu, as well
as shifting, docking and undocking, every vessel' with 500 GRT and above, engaged in
'. coastwise or foreign 'trade s~1I be under, compulsory pilotage.' However, ship captains or
masters. of domestic vessels thatreQularly call'at ?Sgovernment port may be allowed to pilot
their own vessels, provided they a~ duly permitted by the Authority under such terms and
conditionsit may imposed as may be consistent with existinggovernment regulations.

Section 3 - ExemDtion. - In the followingcases,' pilotageservice is not compulsory:

a) Governmentvessels not engaged in commercialtrpde;

b) Vesselsof foreigngovemment(s)-entitled
to cOurtesy;and, .

c) Vessels calling at private ports not located within a designated channel and whose

a) The AuthOrityshall grant a ~it to suChnumber of pilotsto operate or maneuver vessels
to berths or anchorage withinthe PilotageDistrictas the Authoritydeems necessary for the
. purpose of providingsafe and effici~t pilbtageseMce.

b) No per$Onshall be granted a pennit as a harbor pildtof any vessel within'~ Pilotage


Districtunless he has passed the required examinations therefor givendby prOperagency of
the government; and has been issued a license by the PCGand a permit by the Authority.

Section 5. RevocatiOn of Pilot's Permit. - Permit issued by the Authority to a' piiot to
~ or maneuver:vessel shall be subject,to suspension or revocation~r cause, in
connection therewith. '

'SeCtion 6. Pilotaae Fees and Rate. - All pilotage,fee:; and rates ctlargeable for'pilotage
services in a Pilotage Districtshall be subject to the approval of the Authority.For the privilege
of having been granted a permit to operate within the Pilotage District,a privilegefee of not
less than ten percentUO%)of the gross incomeof 1fie,pilOtorganization shall be charged by
the Authorityand paid under such guidelines established by the,Authority, without prejudiceto
the option of the authority to impose a direct collection system. Provided, that the rate of
privilegefee established herein shall be subject to periodicreviewby the CPC.

Section 7. Disdoline of Pilots. - The ~uthority shall regulate; supervise, and ensure the
maintenance of good conduct and discipline of all pilots and may require its Chief Pilot to
submit a report to the Authority on any pilOtWhere there is a reason tD believe'that public
interest or the effidencv of pilotageservice is involved.

Section 8. Investiaatio~' Of Pilot. Upon indorseJ)1ent by the General Manager of a
complaint, either at' his own initiativeor upon complaint under oath by other persons, against
any' pilot for, negligence,.ineffidency, . incapadtyor violationof pilotagerules and other
regulations of the Authority, the legal Offlcerof the Authority shall conduct an investigation.
r-- 'and ~bmit his report afJCIrecommendations tD the General Manager who may adopt the said
report in toto or in part. In, c;onnec:t:ion
therewith, the General Manager may thereby reprimand,

ARTICLE XV
. FINALPROVISIONS'

Section 1. ReDealinGCauSe. - To the extent consistentwith the rules and regulations


prescribed by any other governmentagencies'relativeto the subjecttreatedin this Order,
these Regulationsshall be in additionor supplementalthereto; provided,however,that these
Regulations~hallsupersedethose rules and regulationspreviouslyissuedby the BOCand the
PPAreiatingto matters such as anchoring,berthing and movementof vessets, handling,
storing, custody, movement and deliveryof' cargo and other..related matters within the
jurisdictionof the Authorityinsofar as said BOCor PPA regulations are inconsistent with these
