5) reduce the setback between live entertainment and existing residential development; and 6)
reduce the setback for all outside activities, temporary structures and signs and existing
residential development on a portion of 116.8 acres in a C-2 (General Commercial) Zone and R-
5 (Apartment Residential District) Zone both within a P-C (Planned Community Overlay
District) Zone in the Summerlin Master Planned Community.

Generally located on the south side of Griffith Peak Drive and the west side of Town Center

BACKGROUND:
Project Description
General Summary

Site Plan
This is a request to allow a maximum of 20 temporary outdoor commercial events per year on a
portion of an undeveloped 116.8 acre project site. More specifically, the temporary outdoor
events will be relegated to the undeveloped portion of APNs 164-01-112-009 and 164-01-312-
007 located to the northeast and east of the ballpark, respectively. Existing multiple family and
single family residential development are located immediately to the east of aforementioned
APNs. Temporary, paved parking facilities are located immediately east of the ballpark on APN
164-01-312-007. The parking areas utilized for the ballpark will not be occupied by any of the
temporary outdoor commercial events. The temporary outdoor events will also be located on the
undeveloped portion of APN 164-01-312-006, immediately south of the ballpark. Existing
multiple family development is located immediately south of this parcel, across La Madre
Mountain Drive. Access to the project site is granted via Orchard Park Drive and Spruce Park
Drive, and Spruce Goose Street.

Applicant’s Justification
The project site is currently vacant and the applicant would like to utilize the property for up to
20 temporary events per year in conjunction with the surrounding businesses and events. The
applicant desires to waive the applicable Development Code requirements for temporary outdoor
commercial events subject to approval and issuance of temporary permits for each individual
event. Fireworks are an example of the temporary events that will be requested should the use
permit request be granted.

STANDARDS FOR APPROVAL:


The applicant shall demonstrate that the proposed request meets the goals and purposes of Title
30.

Analysis
Current Planning
Use Permits
A use permit is a discretionary land use application that is considered on a case by case basis in
consideration of Title 30 and the Comprehensive Master Plan. One of several criteria the
applicant must establish is that the use is appropriate at the proposed location and demonstrate
the use shall not result in a substantial or undue adverse effect on adjacent properties.

Use Permits #1 through #3


Staff can support the request to allow a maximum of 20 temporary commercial events per year
since the ballpark is a regional facility that is utilized by the entire Las Vegas Valley with a
diverse clientele with varied community interests. Furthermore, staff can support allowing
events longer than 10 calendar days as the request is primarily for special events centered around
various theme nights associated with the ballpark, special holiday seasons and festivities. Staff
can support the request to allow temporary outdoor commercial events on a property with no
licensed business with a condition of no more than 20 temporary commercial events per year.
The proposed request should not have an adverse or negative impact on the surrounding land
uses and properties; therefore, staff recommends approval.

Use Permits #4 through #6


Staff cannot support the applicant’s request to conduct live entertainment beyond daytime hours
due to the close proximity of the existing residential development located to the east and south of
the project site. Staff also cannot support the applicant’s request to reduce the setback between
temporary outdoor activities and live entertainment to the existing residential developments.
Staff finds the request is a self-imposed burden and the setback reductions may have an adverse
and negative impact on the abutting residential development; therefore, staff recommends denial.

Staff Recommendation
Approval of use permits #1 through #3; and denial of use permits #4 through #6.

If this request is approved, the Board and/or Commission finds that the application is consistent
with the standards and purpose enumerated in the Comprehensive Master Plan, Title 30, and/or
the Nevada Revised Statutes.
PRELIMINARY STAFF CONDITIONS:

If approved:
• Maximum of 20 temporary outdoor commercial events per year;
• All events to be approved through the temporary commercial use application permitting
process.
• Applicant is advised that approval of this application does not constitute or imply
approval of a liquor or gaming license or any other County issued permit, license or
approval; a substantial change in circumstances or regulations may warrant denial or
added conditions to an extension of time; the extension of time may be denied if the
project has not commenced or there has been no substantial work towards completion
within the time specified; and that this application must commence within 2 years of
approval date or it will expire.
