CONSTITUTION AND BY-LAWS

PREAMBLE
We the officers and members of the College of Engineering Student Government
(COENG-SG), imploring the aid of Divine Providence in order to establish a national, democratic
and autonomous Student Union, to train ourselves in self-government to promote high standards
of character, scholarship, leadership and service, to foster closer relationship and understanding
with the administration and the community, to encourage and promote efficiency of all student
activities, and to contribute to the Camarines Norte State College (CNSC) goal of excellence in
higher education in the Region, farther adhering to the principles of justice and fairness that must
always govern the conduct of government functionaries, do hereby promulgate and adopt this
constitution and by-laws.

ARTICLE I
GENERAL PROVISIONS NAME & DOMICLE
Section 1. This organization shall be the supreme student governing body of Camarines Norte
State College - College of Engineering and be known as the COLLEGE OF
ENGINEERING-STUDENT GOVERNMENT (COENG-SG).
Section 2. There shall be a: Mace, the official symbol of the Student Government; Gavel, to
be used during meetings and assemblies and; Adopted seal, that reflects the symbolic of
ideas and accountability.
Section 3. The COENG-SG shall be affiliated and accredited by the OSS Chairperson of
COENG.
Section 4. The COENG-SG shall have its permanent office at the COENG, CNSC Main
Campus, Daet, Camarines Norte 4600.

ARTICLE II
DECLARATION OF OBJECTIVES AND FUNCTION
Section 1. The COENG - SG shall undertake programs of action complimentary to the
development of the CNSC COENG students both in academic and non-academic aspects and uplift
this institution through student action.
Section 2. The COENG-SG shall pursue the following specific objectives:
i. To uphold the rights of Press Freedom inside the campus so that the SG shall serve as
an active forum for student ideas and sentiments.
ii. To uphold the ideas of the CNSC geared toward ensuring a well-rounded intellectual,
social, cultural and physical development of every student.
iii. To develop a sense of service and responsibility among the students for the welfare of
the society.
iv. To pursue a dynamic program of student involvement in campus activities so as to
enhance their skills and talents in serving the goals of CNSC.
v. To strengthen the ties among students, faculty, administration and other sector of
academic community by way of discussing problems and plans through peaceful and
intellectual means so that common good may be achieved.
vi. To provide the transparency in all Finance matters.
Section 3. To carry out the objectives in all Finance matters. The SG shall:
i. Organize and coordinate student’s activities designed to improve general welfare of the
students as well as to prepare them for constructive citizenship.
ii. Represent the students in the academic and administrative councils of the CNSC
COENG so provided by laws, rules and regulations promulgated by competent
authority.
iii. Makes recommendations and consults with the CNSC Office of Student Affairs -
COENG about student matters, affairs and activities through its adviser.
iv. Help or serve the students who may need assistance especially in dealings with the
faculty, administration and other members concerning their participation in seminar,
workshops and other similar activities as the representatives of the Institution.
v. Assists the school on authority dissemination among the students such as the rules and
regulations on students’ conduct and discipline.
vi. Provide a representative from the students to stand for the issues, rules and reputations
implemented inside the school campus.

ARTICLE III
MEMBERSHIP
Section 1. All the students of the COENG, who are officially enrolled in the College during
the academic year, shall automatically become member.
Section 2. Membership may be lost provided that the student receives final, executory and
unappealable decision subject for his/her suspension, dismissal or termination.

ARTICLE IV
BILL OF RIGHTS
Section 1. All members shall have the freedom of the press and speech and peaceful assembly.
Section 2. All members shall have the right to petition the proper authorities for redress of
grievances, present views and opinions conductive to broad, sound and healthy thinking of vital
issues concerning the welfare of the students.
Section 3. Every member has the right to have his/her grades speedily processed and the
confidentiality of his/her academic records shall maintain.
Section 4. Every member shall have the right to be informed for the rules and regulations
affecting him.
Section 5. Every member shall have the right to appeal decisions affecting their rights, interest
and welfare.
Section 6. Students shall have the right to due process in accordance to existing laws. No
student shall be imposed to disciplinary sanction without due process.
Section 7. Students shall not be subjected to exploitation, harassment, bullying or cruel and
unusual punishment.
Section 8. All members have the right to form, assist and join school-based and non-school
based organizations, alliances and federations for their integral development.
Section 9. Every member shall have the right to free access of records, reports and other
documents kept by the SG.
Section 10. Every member shall have the rights and privileges to utilize the adequate, conducive
and safe facilities and services provided by the College for free.
Section 11. Students shall have the right to undertake research, publish and discuss findings
and recommendations appertaining thereto, in accordance with the principles of academic
freedom.
Section 12. Students shall have the right to exercise ideological, political, cultural and religious
beliefs.

Section 13. Every member shall have the freedom of Suffrage.
Section 14. Every member shall have the right to elective or appointive position of the SG.
Section 15. No member shall be obliged to contribute any amount of money or any object of
value or service, unless otherwise provided by this Constitution.
Section 16. Every member has the right to receive, primarily through competent instruction,
relevant quality education in line with the national goals and conducive to their full development
as persons with human dignity.
Section 17. Every member shall have the rights and privileges to all Student Development
Programs.

ARTICLE V
DUTIES AND RESPONSIBILITIES OF THE MEMBERS
Section 1. Every member shall observe, uphold this Constitution and By-Laws.
Section 2. Every member shall pay Membership Fee and contributions levied by the Student
Government Assembly.
Section 3. Uphold the academic integrity of the College, endeavor to achieve academic
excellence and abide by the rules and regulations governing his academic responsibilities and
moral integrity.
Section 4. Promote and maintain peace and tranquility of the College by observing the rules
of discipline, and by exerting efforts to attain harmonious relationship with fellow students, the
academic staff and teaching and non-teaching personnel.
Section 5. Every members shall participate in any initiated activities provided for the student
development.
Section 6. Every member shall perform his/her duties and responsibilities.

ARTICLE VI
THE EXECUTIVE BUREAU
Section 1. The Student SG shall be composed of the elected and appointed College Student
SG Officers.
Section 2. The powers of the Executive Bureau shall be:
a. Prepare and propose before the General Legislative Council the programs and
activities to be undertaken by the SG.
b. Execute the programs and activities approved by the General Legislative Council.
c. Monitor the allocation of the Students / SG Trust funds, subject to the college auditing
rules.
d. Take the overall supervision over the Student Government Standing Committees.
e. Hear and make recommendations for the complaints filed against the members of the
SG.
f. Decide on matters pertaining to the implementation or imposition of the approved
rules, regulations and resolutions.

Section 4. Duties and Responsibilities of the SG Officers
A. The President shall be the chief executive of the SG. He/She shall:
i. Preside over the regular, special and emergency meeting of the SG.
ii. Carry out and implement resolutions, policies and laws approved by the SG Officers.
iii. Create ADHOC and standing committees and appoint the chairperson and members
hereof.
iv. Represents the SG in his official capacity as President and occasions and events where
his representation is needed.
v. Propose the budget of the SG for every activity.
vi. Appoint the Secretary - General, Secretary - Internal, Secretary - External and the First
Year Ambassadors of the SG.
vii. Perform such other functions as may be required of him/her by the Assembly and the
students.
viii. Address and take actions in all existing issues and concerns affecting Student’s welfare.
B. The Vice-President shall:
i. Assist the President in all matters where his/her presence is required.
ii. Take over the duties of the President in cases of absence, disability, resignation and
removed for cause of the President.
iii. Monitor the activities of all the academic organizations of the College.
iv. Monitor the academic status of all officers of the COENG - SG.
v. Head of the Research and Extension Committee.
vi. Perform such other functions as may be required of him/her by the President, the SG
and the students.
C. The Secretary General shall:
i. Assist the President and all the Secretaries in all matters where his/her assistance is
required.
ii. Prepare the Accomplishment Report of the SG for every semester.
iii. Prepare notices/communications pertaining to the activities of the SG or the Assembly
and coordinate with the Public Relations Officer for dissemination.
iv. Be the chairperson of the Committee on Journals and Archives.
v. Perform such other functions as may be required of him/her by the President, the SG
and the students.
D. The Secretary Internal shall:
i. Assist the President and all the Secretaries in all matters where his/her assistance is
required.
ii. Record and keep the Journal/Minutes of the meeting.
iii. Check, record and prepare the attendance of the officers during regular, special and
emergency meeting of the SG.
iv. Record, keep and prepare inventory monitoring logs for presentation monthly.
v. Be the vice-chairperson for internal affairs of the Committee on Journals and Archives.
vi. Perform such other functions as may be required of him/her by the President, the SG
and the students.
E. The Secretary for External Affairs shall:
i. Assist the President and all the Secretaries in all matters where his/her assistance is
required.
ii. Check, record and prepare the attendance of the COENG students during collegewide
and schoolwide events.
iii. Lead the SG’s public well-being through unrivaled skills on preparation of external
communication letters, logos, seals and other symbols which will represent the SG.
iv. Be the vice-chairperson for external affairs of the Committee on Journals and Archives.

v. Perform such other functions as may be required of him/her by the President, the SG
and the students.
F. The Finance Officer shall:
i. Act as custodian of the funds and property of the SG.
ii. Disburse the funds and properties of the COENG-SG in accordance with such rules
and/or Executive Order promulgated by the SG.
iii. Should be liable to any Finance lost entrusted to him/her.
iv. Prepare the Finance statements which shall be supported by receipts at the end of every
semester and provide a copy for all the organizations duly signed by the Finance
Officer, Auditing Officer, President and Adviser.
v. Be the Chairperson of the Finance Committee.
vi. Perform such other functions as may be entrusted to him/her by the President, the SG
and the students.
G. The Auditing Officer shall:
i. Audit the Finance statements or any funds of the SG.
ii. Certify to the legality of the expenses incurred by the SG.
iii. Be a regular member of the Finance Committee.
iv. Be the Chairperson of the Sports Committee.
v. Perform such other functions as may be entrusted to him/her by the President, the
Finance Officer, the SG and the students.
H. The Procurement Officer (I & II) shall:
i. Supervise all business, including inquisition of properties, services and fund-raising
activities of the SG.
ii. Be the authorized person to receive/disburse fund of the COENG-SG in the absence of
the Auditing Officer, by the virtue of the Finance Officer and by the President.
iii. Perform other functions as may be required of him/her by the President, the SG and the
students.
I. The Public Relations Officer shall:
i. Disseminate information for mass media duly approved by the President.
ii. Be the Spokesperson of the COENG-SG.
iii. Monitor and make an action for unnecessary posts with regards to the SG on social
media.
iv. Post the minutes, finance statement and disseminate other important documents
prepared by the Secretaries and the Finance Officer to all Organizations.
v. Receive a monthly budget for information disseminations.
vi. Perform such other functions as may be required of him/her by the President, the SG
and the students.
J. The Year Level Ambassadors and Organization Representatives shall:
i. Make survey of the problems that concerns students especially those that may require
the College Disciplinary Action.
ii. Make a report of those that need to be referred to the College Disciplinary Council.
iii. Composed the Grievance and Ethics Committee.
iv. Perform such other functions as may be required of him/her by the President, the SG
and the students.

Section 5. The Special Power of the SG shall:


i. Prepare and propose and approve the projects, programs and activities to be undertaken by
the SG.
ii. All matters involving money initiated by every club and organization in this college must
be approved by the COENG-SG President before it is implemented.

iii. All Organizations under COENG are required to pass/submit a Finance report and narrative
report every semester.

Section 6. Term of Office


a) The term of office of the officers will not exceed one (1) academic year (August - June).

ARTICLE VII
THE LEGISLATIVE BUREAU
Section 1. The legislative power shall be vested in the legislative bureau which shall consist
of the President-elect of every block of the CNSC-COENG.

Section 2. The legislative bureau shall:


a) Make survey of the problems that concern students especially those that may require
the College disciplinary action.
b) Plan activities of the student government for student development duly approved.
c) Create resolutions for student development, provided, the President of the Executive
Bureau can veto any unconstitutional resolutions.
d) Approved the appointment of Secretary General, Secretary Internal and Secretary
External.
e) Perform such other duties as may be designated by the President of the Executive
Bureau and/or the SG.

Section 3. The Composition of the Legislative Bureau

ARTICLE VIII
QUALIFICATION OF CANDIDATES
Section 1. Only students who are second year college and up (with two (2) consecutive
semesters enrolled the College), has the right to aspire for the position of President down to of the
Student Government.

ARTICLE IX
ACCOUNTABILITY OF SG OFFICERS
Section 1. Any officer of the SG may be impeached for the following grounds:
a) For deliberately violating this constitution
b) For lack of moral ascendancy to govern.
c) For gross negligence of his/her duties.
d) For grave misconduct reflecting upon his/her moral character.
e) Three (3) unexcused absences on announced meetings.

Section 2. Any officer, of the COENG-SG deemed not impeachable due to the offence may
still be suspended on the following grounds:
a) Unwarranted physical violence.
b) Action tends to destroy the credibility of the SG.
c) Malversation of SG funds.
d) Using the SG name without an approval of the majority members of the officers.
e) Convicted of any crime promulgated by the court/authority.

Section 3. Any officer failed to follow the existing rules and regulations of auditing and
accounting rules, and to submit the reports at necessary time before he/ she graduates shall be
facing charges on the penal provisions of any existing laws subjected to fiscal and monetary.

ARTICLE X
FILLING OF VACANCIES
Section 1. In case of vacancy of the President, the Law of Succession shall then be applied.
Section 2. In case of vacancy of the Vice President down to the lower position, the General
Assembly should decide.
Section 3. In case of the Year Level Ambassadors vacancy, the President shall appoint for the
vacant position.

ARTICLE XI
COMMITTEES
Section 1. The COENG-SG shall constitute committees that function in all matters of
concerning the student activities.

Section 2. The standing Committees:


A. Committee on Education – an oversight committee on all matters relating to
education, schools, colleges; implementation of the provisions of the free higher education act,
scholarships, subsidies and incentives to students.
B. Committee on Grievance and Ethics – all matters relating to the conduct, rights,
privileges, safety, dignity, integrity and reputation of all Members.
C. Committee on Research, Extension and Development – all matters relating to
the relations in the CNSC administration, other Student Councils/Governments and outside the
school representations; all external affairs, research and extension services; and its development.
D. Committee on Finance – all matters relating to funds for the collections and
expenditures and for the payment of indebtedness; and, in general, all matters relating to
expenditures.
E. Committee on Gender and Development – all matters directly related to women
and men; other genders; on sexual orientation on gender identity and expressions; the equality and
their developments.
F. Committee on Information and Communication – all matters relating to public
information, mass communication and other services, the development and promotion of
information technology; and other matters.
G. Committee on Journals and Archives – all matters relating to the communication
letters; minutes and journals; preservation of records and consolidation of archives of the COENG-
SG.

H. Committee on Logistics and Accounts – all matters relating to the auditing of all
accounts on the expenses and activities for the whole academic year; including budget submission
and approval, disbursements and accounting; auditing all accounts on deposit funds; record of the
logistics and property of the COENG-SG.
I. Committee on Peace and Order – all matters relating to the enforcement,
peacefulness, safety and security of the constituents, administration and the others.
J. Committee on Sports – all matters relating to athletes, sports and others that
supports and engages the College of Education students on Local Intramurals and System wide
Intramurals and SCUAA V.
K. Committee on Ways and Means – all matters relating to generate funds generally;
fees; loans and other sources and forms of sponsorships; and creation of income generating
projects.
L. Committee on Economic Affairs – All matters relating to the allocations of the
annual budget for the succeeding academic year; economic development and programs inclusive
development of policies and strategies.
M. Committee on Membership and Student’s Participation – all matters relating to
the membership and affiliation; including the role, rights and responsibilities of student’s
organizations, academic and non-academic, and other similar groups, and the establishment of
mechanisms for participation of the students in governance and activities.

N. Committee on Culture and Arts – all matters relating to the preservation,


enrichment and evolution of the Filipino culture and arts; inclusion of training programs and
cultural; artistic programs of institutions and organizations operations.
O. Committee on Ecumenical and Spiritual Affairs – all matters relating to the
spiritual celebrations, ecumenical, recollections and religious affairs, generally.
P. Committee on Environment – all matters relating to the conservation and
protection of the physical and natural environment, the regulation of the impact of human activities
on the same, the promotion of environmental awareness of constituents.

ARTICLE XII
MEETINGS
Section 1. The regular meeting of the SG shall be held every First and Third Friday of the
month, at 5:00 o’clock in the afternoon at COENG-SG Office. 50% plus one members of the SG
shall constitute a quorum.
Section 2. Emergency and Special meetings may be called by the President or upon written
request of at least eight (8) incumbent officers of the SG or by the majority of members of the
Representative Assembly.
Section 3. The Secretary - General shall issue notices of the meetings at least two (2) days
before the meeting are to be held.
Section 4. General Assembly shall be held once every semester but in case of necessity
another General Assembly may be called. Notice of the meeting shall be sent out by the Secretary
- General at least two (2) days prior to such meeting by posting in conspicuous places preferably
within the COENG Grounds and/or in the social media. The date, time, place and the agenda shall
be determined by the SG through its President.
Section 5. In case of the absence of the President, the remaining Officers will choose from
among themselves who will preside the meeting.
Section 6. The meetings and assemblies, except general assemblies, shall be in the form of
Parliamentary Procedure which includes the following procedures:

2. Roll Call/ Determination of the Quorum
3. Adoption of the Agenda
4. Approval of Minutes from Previous Meeting
5. Reports of Officers (if applicable)
6. Reports of Committees (if applicable)
7. Unfinished Business (if applicable)

9. Announcements (if applicable)
10. Adjournment

ARTICLE XIII
FUNDS
Section 1. The funds of the COENG-SG shall consist of the Student Government Fee paid by
the students upon the collection of the Finance Officer.
Section 2. All members shall pay Membership Fee of Twenty-Five pesos (Php 25.00) per
semester, this fund shall be used as revolving funds of the SG and payable to the SG Finance
Officer or whoever is designated by the President.
Section 3. The manner of collection of fees shall be guided by the approved minutes of
meeting conducted by the SG provided that the amount to be collected is lower than or equal to
One hundred and fifty pesos (Php 150.00).
Section 4. All funds except the revolving funds (regardless of amount) shall be deposited in
refutable bank in the name of the Student Government. The bankbook shall be in the custody of
the Finance Officer or per resolution approved by the majority Officers of the SG.
Section 5. No funds shall be withdrawn or deposited without the approval of the SG Officers
duly signed by the President, Adviser and Finance Officer or any alternate.
Section 6. Officers who are late during regular, special and emergency meetings, and/or
assemblies with no valid reasons are ground for penalty to be determined by the President,
proceeds shall be allotted for COENG-SG development.
Section 7. A penalty of One hundred and fifty pesos (Php 150.00) shall be imposed to every
officer who failed to attend the regular, special and emergency meetings, and/or assemblies with
no valid reasons. Proceeds will be special trust funds under the custody of the Finance Officer.
Section 8. Collection of membership fee shall be on a monthly basis, Five pesos (Php 5.00)
upon enrollment and continuous on the succeeding months with a maximum of Five (5) months
per semester (a total of Php 25.00 per semester), payable to SG Finance Officer.
Section 9. There shall have a certificate of clearance in all Students Organizations, for every
end of semester, for payment of fees to monitor the transparency of the collections and the violation
of each member on Article V Section 5 of this Constitution and By-Laws provided that this shall
not cause deterrent of the students’ enrolment.
Section 10. The collection and disbursement of the funds of the SG shall govern by existing
laws, rules and regulations of the COENG-SG.

ADVISER

Section 1. The SG shall have the discretion to choose one (1) Adviser of the COENG-SG from
the COENG Department.

ARTICLE XV
AMENDMENTS AND REVISIONS
Section 1. The COENG-SG Executives and Legislators in a meeting may propose
amendments to the Constitution by a two-thirds (2/3) vote of all members present in the assembly.
Section 2. Amendments of CBL shall be in the form of ANY of the following:
a. All members as defined in Article III may propose amendments, which shall be presented
before the Executive Meeting, upon a vote of 2/3 of all the Officers present in the
Assembly.
b. Amendments shall be in the form of a Representative Assembly.

EFFECTIVITY

Section 1. This Constitution and By-Laws shall take effect immediately after the ratification
of the members during the General Assembly.
