This Agreement is made on this the day _ between Mrs Chandra A Bohra &Mr Ashok A

Bohra residing S R nagar Bangalore-560027, hereinafter called the “OWNERS” of one


part and Mr Babu residing at Bangalore-.
Hereinafter called the “CONTRACTOR” of other part (alt ph no ___________)

WHEREAS the owner desires to construct a commercial Building at Jayanagar Bangalore of RCC
Second floor ,Third, fourth floor (Or sheet)and terrace floor .

Approximate Built up area -----------6000.00sq.ft(incl PEB on top floor)


In accordance with the drawings, specifications and details prepared by the architect on an Labour
rate of Rs 24500/-AI(Twenty four thousand five hundred only AI ) for 100 sft .
Following are the works Inclusive of the above rate

All structural Superstructure work like Rcc ,Columns,Beams,Slabs,rack ,Lintels,chejja,lofts,Staircase ,and


all Rcc works for successful completion of the project with proper tools
1. With MS sheet (roof ht 11’0”) and steel plywood centering(plywood for
Columns and Beams ) Bar-bending, Concreting.
2. Block work 8”,6”,4”, Plastering, door window fixing, and elevation works,Parapet
wall,compound wall5ft ,OH tank platform,Waterproofing,Curing . Any work not mentioned by
contractor in the exclusions shall be deemed to be in the inclusions in his scope of works
Now it is agreed that the under mentioned terms and conditions will be in this contract
between the OWNER and CONTRACTOR.

GENERAL CONDITIONS

1 The “Contractor” shall carry out and complete the work in every respect as per the drawings
and instruction of the architect and to the entire satisfaction of the Architect and the Owners.
The schedule of work and detailed specification falling within the scope of the work is to be
carried out by the “Contractor”& his supervisor shall attend to safety to material inventory

2 The term “Architect” shall means M/s Kreative consultants , 203 2nd floor Shree complex St Johns
road BANGALORE-42, appointed by the owners or in the event of them ceasing to be Architect, any
such other firm/person appointed by the OWNERS.

3 The contract is an labour rate contract. The contractor agrees to hold the price fixed till The
completion of the job. No escalation on the quoted rate will be allowed during the Construction till the
completion.
The Contractor hereby agrees to complete his part of the work in all respect with in 4 calendar months
from the date of commencement of the work which will be reckoned as from__________________
The Contractor further agrees that the period shall be determined by the Architect who shall issue
certificate of commencement and of the final completion. Nevertheless any delay which may be
caused due to circumstances, beyond normal control, the owner shall grant such extra time to the
Contractor for the completion or may be certified, as necessary by the Architect.

5 During the process of Construction, any work, which is not carried out to the satisfaction as per
instructions of the Owners and the Architect, such work shall be removed and redone at
Contractor’s cost & all works will be subject to quality check by architect & others appointed by
owner & shall carry a quality guarantee period of two years effective architect’s certificate date.

6 If at any rate due to poor quality of workmanship or un-narrated delay in execution of the work,
the owner desires to carryout the balance of work personally himself or through any other agency,
he can do so by giving one week’s notice to the contractor and amount due to the Contractor or to
the Owners will be settled within 45 days time. The work not executed to the satisfaction of the
Architect/Owners shall be deducted from the contractor’s bill at the time of settlement.

7 If any item is added and carried out, it will be treated as non-tendered item. In case any work
not specific is carried out, such non-tendered item claimed in the bill shall be subject to the
scrutiny and approval of the Architect and the decision of the Architect shall be the final and
binding on both the parties. While determining the rates for non-tendered items executed by
the contractor and architect will pay on the actual market price worked out for labor involved
plus supervision charges and overheads to the Contractor.

The Contractor shall be fully responsible for the safe custody of all the materials and equipment’s
stocked at site inclusive of all materials and equipment’s supplied by the Owner.

9 The contractor should post experienced engineer/Supervisor at the site and ensure that
construction work continue as per architectural and structural plans along with the safety
measures shall be his responsibility.

PAYMENT CONDITIONS:

1 A mobilization advance of Rs 25000/- to be paid to the contractor at the time of finalizing


the agreement against valid receipt/bank guarantee /to be deducted in the first payment.

2 The contractor shall raise a labour bill along with a detailed statement of completed works for
every 10 squares of defect-free best quality completed work for payment for a minimum of Rs
100000/- The architect is to certify and issue the certificate for payment.

3 In each stage of payment, security deposit of 5% will be deducted. The amount will be released after
the defect liability period of 4 months in force from the date of“final completion certificate” issued
by the architect. Above payment shall be made by the owners to the contractor on certification by
the architect after completion of above works at different stages.

Special Condition:

The defect liability period of 4 months or one monsoon whichever is later is reckoned from the
date of “final completion certificate” issued by the architect. Any defect such as cracks which
may appear within this period shall be made good by the Contractor immediately at his own cost.
In case the Contractor is unable or unwilling to do so, Owners will be at liberty to get them done
and recover the cost there of from the contractor. Any amount due to the contractor shall be
settled after such recovery.
All charges such as departmental deposits, service charges, road cutting charges
shall be paid by owner. The N.O.C permission for road cutting, etc. shall be arranged By the contractor
through his licensed plumber and electrical contractor.

IN WITNESS WHEREOF the parties have set their hands this day 2019

This contract will have jurisdiction of Bangalore city court only.

CONDITIONS OF THE CONTRACT

The rates quoted includes all charges for scaffolding centering materials, shed for materials clearing of
site, marking, watering, for curing of concrete as mentioned in the specification. The rate quoted shall
be deemed to be for the finished work to be measured in the site.Roof to roof measurements and 75 %
for balcony . The rates shall also be firm and shall not be subject to variations.

Water and electricity will be supplied by the owner at convenient point in the site and the
Contractor should make his own arrangement to the matters. Electricity and water is given free to
the contractor at one point only.

It is agreed by the Contractor that the possession of the property shall always remain with the owners.

The owners are not responsible for any untoward happenings at the construction site, accident
causing injury or death to any worker, employed by the Contractor and the contractor indemnify
the owners from any dispute claim whatsoever in this regards. The contractor in his scope shall
obtain his trade licence make necessary arrangements to cover all the sides of the site. Including
ESI/PF and insurance for his workmen .His boys shall have all visitors details entered in a book,

The Architect and Owners are at liberty to terminate the contract agreement without assigning any
reason .

All works per floor will be completed per floor fully finished & for use ready status in _____days
and any delay will attract a penalty of rs 5000/-per day incl all days.
