Factual information about appointment of Act Apprentice in ICF

One Course completed Act Apprentice trained in ICF attempted self


immolation and succumbed to the injuries. The above incident is being
reported in News Papers / TV Channels / Websites with distorted version of the
truth with regard to the appointment of Act Apprentice. In order to give a
correct and factual position with regard to the recruitment of the Act
Apprentice the following statement is being released.
1. Rule 22(1) of Apprentice Act, 1961 states that
“It shall not be obligatory on the part of employer to offer any
employment to any apprentice who has completed the period of his
apprenticeship training in his establishment, nor shall it be obligatory on the
part of the apprentice to accept an employment under the employer.”
2. In every notification issued by ICF for engagement of Act Apprentice
for imparting training candidates are specifically advised as under.
“It should be noted that the selection and training are strictly in
compliance with the provisions of Apprentice Act, 1961 and NO
EMPLOYMENT IS GUARANTEED TO THE APPRENTICES ON COMPLETION OF THEIR
TRAINING”.
3. All the Apprentices also execute a Bond appreciating this point before
starting of their apprenticeship training. As per extant orders, Group ‘D’
recruitment in Railways including ICF has to be mainly done through Railway
Recruitment Cells by open market recruitment. However, like other Railways,
ICF has also given job to Course Completed Act Apprentices with specific
approval of Board, as Substitutes when regular recruitment was delayed for
unforeseen reasons.
4. The policy of engagement of substitutes by Railways has since been
changed with the issue of Railway Board letter No.E(NG)-II/22008/SB/SR/15
dated 17.09.2010, wherein no preference is given to course completed Act
Apprentice, even when substitutes are to be engaged in very special
conditions and also open market recruitment has become regular.
5. S/Shri Jayaganesh and Neelagandan have filed O.A.520/2005 before
Hon’ble CAT, Madras challenging the engagement of Substitutes by Southern
Railway. Chairman, Railway Board is the first respondent in this O.A. Hon’ble
CAT has observed that engagement of Substitutes is a backdoor entry and
regular appointment should be done by the process of open market
recruitment and this was also upheld by the Hon’ble High Court of Chennai in
W.P.No.8821/2007.

6. Course completed Act Apprentices were meeting officers of ICF
including GM in groups and through various Hon’ble Members of Parliament
and VVIPs seeking appointment in Railways. Factual position has been
explained to them individually and severally. It is also a fact that requirement
of ICF for recruitment is done through Railway Recruitment Cell, Chennai as
per the extant instructions of Government of India. 134 persons are being
appointed from the panel published by RRC in October 2015.

7. Presently also, the Course Completed Act Apprentices have filed O.A.
No. 310/00816/2015 before the Hon’ble Central Administrative Tribunal
praying for appointment in ICF, which is pending.

The above facts may be carried in the right perspective.
