CONTRACT OF LEASE

KNOW ALL MEN BY THESE PRESENTS:


This CONTRACT OF LEASE is made and executes at the City of Biñan, this ____ day of August,
2019, by and between:
MR. ANDREW KIM ROSARIO, of legal age, Filipino, with residence at Blk 21 Lot 12 San Agustin
Village, Baranggay San Francisco Binan, Laguna and hereinafter referred to as the LESSOR.
-AND-
MR. _______________________, of legal age, Chinese, with residence address
____________________________________________ and hereinafter referred to as the LESSEE
WITNESSETH; That
WHEREAS, the LESSOR is the owner of property (house & lot) situated at the address of the
lessor, and hereinafter referred to as the “Leased Premises”
WHEREAS, the LESSOR agrees to lease-out the Leased Premises to the LESSEE and the LESSEE is
willing to lease the same;
NOW THEREFORE, for and in consideration of the foregoing premises, the LESSOR leases unto
the LESSEE and the LESSEE hereby accepts from the LESSOR the Leased Premises, subject to the
following:
TERMS AND CONDITIONS
·0 PURPOSE - The leased Premises hereby leased shall be used exclusively by the LESSEE
for residential purposes only and shall not be diverted to other uses.

·1 TERM - The term of lease is for a period of one year from ___________ to
____________.
Upon its expiration, this lease may be renewed under such terms and conditions as may
be mutually agreed upon by both parties. The LESSEE may pre-terminate this contract at
any time, provided, that the deposit provided under Clause 4 hereof may be forfeited by
the LESSOR, as a form of penalty.

·2 RENTAL RATE - The monthly rental rate for the Leased Premises shall be
_______________________ (Php _________________), Philippine Currency.

·3 DEPOSIT AND ADVANCE - Prior to move-in, the LESSEE shall pay the LESSOR an amount
equivalent to five (5) months advance and One (1) month deposit in Philippine Currency.
The succeeding monthly payments shall be made after the first three months and shall
be paid to the LESSOR every ____ of the month. The LESSOR shall answer partially for
unpaid utilities such as water, electricity and telephone. For any damage which the
LESSEE may have incurred on the Leased Premises, the LESSOR shall deduct the
equivalent amount of damage from the deposit of the LESSEE.

·4 OCCUPANTS/ASSIGNMENT - The Leased Premises shall be allowed a maximum of ____


(___ ) occupants who shall all be employees of LANCE SOLUTION TECHNOLOGY INC..
with postal address at Southwood Office Tower 2, Southwoods City, Biñan, Laguna,
provided that only ____ (___) occupants shall be using the Leased Premises at any time.
Should the Lessor assign, sell or dispose the Leased Premises, the LESSOR shall ensure
that the rights and interests of the LESSEE under this Contract shall be protected and
shall remain in force for the entire duration under Clause 2 above or any extension
thereof.

·5 IMPROVEMENTS – The LESSEE and/or his designated co-occupant shall not make
structural changes, alterations or improvements in the PREMISES without the written
consent of the LESSOR. However, any major alteration or improvement that will inure to
the benefit of the PREMISES made or introduced by the LESSEE and/or his designated
co-occupant with the , teh become property of the LESSOR without any obligations on
the part of the LESSOR to reimburse the cost to the LESSEE and/or his designated co-
occupant.

SANITATION AND REPAIRS – The LESSEE and/or his designated co-occupant shall keep the
PREMISES clean and in sanitary condition. The LESSEE and/or his designated co-occupant shall
take good care of the property, fixtures and furniture and shall keep it at all times in good
condition. The LESSOR shall be responsible for all ordinary repairs on the PREMISES such as
water, electrical, sewerage installations caused by ordinary wear and tear, except repairs due to
the acts, fault or negligence of the LESSEE and/or his designated co-occupant, members of
his/their household, guests or visitors.
·6 FIRE HAZARD AND OBNOXIOUS SUBSTANCE – The LESSEE and/or his designated co-
occupant shall not keep, deposit or store in the PREMISES any obnoxious substance or
inflammable material which might constitute a fire hazard. Violation of this provision
shall be an immediate cause for termination of the lease.

·7 THIRD PARTY LIABILITY – The LESSEE and his designated co-occupant, during his/their
occupancy of the PREMISES, shall hold the LESSOR and/or his representatives free and
harmless and without liability with respect to any damage, injury, liability or
responsibility, of whatever kind or nature and due to any cause whatsoever, that may be
suffered in the premises by any and all person or persons and their property. These
person/persons shall include, but not limited to, the LESSEE himself, his designated co-
occupant, any other occupant, members of his/their household, friends, representatives,
relatives, employees, agents or guests and domestic help.

·8 INSPECTION OF THE PREMISES – The LESSEE and/or his designated co-occupant shall
maintain the PREMISES in good and tenable condition and for such purpose, the LESSOR
or his representatives shall have the right at reasonable times and upon at least one day
notice, to enter and inspect the PREMISES in order to ascertain that the PREMISES are in
good and tenable condition pursuant to the obligation of the LESSEE and/or his
designated co-occupant . The LESSEE and/or his designated co-occupant, by this
agreement, allow the entry of the LESSOR or his representatives in the PREMISES to
accomplish the purpose laid down in this paragraph.

·9 PUBLIC UTILITIES/ASSOCIATION DUES – The LESSEE shall pay for telephone, electricity,
cable TV, water, Internet and other public services and utilities, while the LESSOR shall
be responsible for the payment of all dues owing to the subdivision/developer during
the duration of this Contract. The LESSOR warrants that the terms of this Contract
conform with the rules and regulations of the relevant association/developer.

·10 FORCE MAJEURE – If the whole or any part of the Leased Premises shall be destroyed or
damaged by fire. flood, lightning, typhoon, earthquake, storm, riot or any other
unforeseen events or acts of God, as to render the Leased Premises during the term be
substantially unfit for use and occupation of the LESSEE, then this Contract may be
terminated by the LESSEE by notice in writing to the LESSOR.

·11 TRANSFER AND MORTGAGE – In the event of sale, transfer, mortgage or any other
encumbrance of the PREMISES, or any sale, transfer, mortgage or any other
encumbrance of the same, the LESSOR shall warrant that the purchaser or mortgagee
shall respect all the terms and conditions of this lease agreement including the provision
thereof.

·12 RETURN OF THE PREMISES – Upon termination of this contract of lease for any reason
whatsoever, the LESSEE and/or his designated occupant shall immediately vacate the
PREMISES and return possession thereof to the LESSOR which includes the ____ ( ) door
keys of the house unit. No demand shall be necessary on the part of the LESSOR. By this
agreement, the LESSEE and/or his designated co-occupant hereby agree that the LESSOR
can enter, by whatever means, and occupy and take possession of the PREMISES upon
such termination. Any resulting damage as a result of the exercise of this right by the
LESSOR shall be for the account of the LESSEE and/or his designated co-occupants.

·13 A signed inventory list of the items found in the house unit is hereby attached and made
an integral part of the contract.

·14 Any violation of the terms provided for in this Contract on the part of the LESSEE and/or
his designated co-occupant or the LESSOR shall be sufficient ground for termination of
this Contract of Lease by the aggrieved party. If any amount due under this agreement is
not promptly paid by the LESSEE on the date such payment is due, the LESSOR shall have
the right to enter the PREMISES and cause the immediate eviction of the LESSEE without
the need for any demand, prior notice or other legal action. By this agreement, the
LESSEE and/or his designated co-occupants hereby agrees that the LESSOR can enter, by
whatever means, and occupy and take possession of the premises upon expiration of the
contract or upon any violation of this contract. Any resulting damage as a result of the
exercise of this right by the LESSOR or his representative shall be for the account of the
LESSEE and/or his designated co-occupants.

·15 The LESSEE shall provide the names with passport IDs of all the occupants…

Any changes in the terms provided for in this Contract must be mutually agreed upon
and in writing. The LESSEE shall be liable to the LESSOR for all actual and consequential
damages incurred, including Attorney’s fees. Any judicial action, ejectment, or any or all
other actions, arising in this contract, shall exclusively institute in the proper court of San
Pedro, Laguna only.
