CERTIFICATION UNDER OATH

This is to certify, under oath, that the undersigned has received Subpoena
Duces Tecum (FF-V-19-0181) issued by the Office of the Deputy Ombudsman for
the Visayas, which required the submission of clear and certified true copies of
the following documents for the project: Construction of Covered Basketball
Court or Gymnasium at Brgy. Mahayahay, Malitbog in year 2018, viz:

1. Minutes of the Pre-Procurement Conference

2. Certificate of Availability of Funds
3. BAC Resolution for the Mode of Procurement
4. Notice of Invitation to Apply for Availability and to BID
5. PhilGEPS Posting
6. Minutes of Pre-bid Conference
7. All Supplemental Bid Bulletins, if any;
8. Minutes of Bid Opening
9. Abstract of Bids
10. Post-Qualification Report
11. BAC Resolution Recommending Award
12. Notice of Award
13. Approved Contract Agreement
14. Notice to Proceed; and
15. Bid Documents of the Winning & Losing Bidders:
a. Bid Data Sheet (BDS)
b. Contractor’s Bid Security bond; and
c. Contractor’s Performance Security Bond

This is to certify, further, that the undersigned, as the BAC Chairman of BLGU-
Mahayahay, cannot produce the certified true copies of the above-mentioned
documents pertaining to said project since that project did not actually exist.
Instead, that what was previously and actually constructed and completed in
Brgy. Mahayahay, Malitbog, Southern Leyte was a Multipurpose and Livelihood
Training Center funded under the 20% Economic Development Fund CY 2017
which was implemented in the year 2018 as appearing in:

(1) CY 2017 Annual Investment Plan (AIP) (Annex “A”); and

(2) Approved Appropriation Ordinance No. 003 S-2017 (Annex “B”).

That, in lieu thereof, I am respectfully submitting herewith the following

certified true copies of the following documents in relation to the Construction of
Multi-Purpose and Livelihood Training Center, to wit:

1. Annual Investment Program

3. Minutes of Pre-Procurement
4. Certificate as to the Availability of Funds

Duces Tecum (FF- V-19-0181), and for whatever legal purpose this may serve.
