EXECUTIVE ORDER NO. 28

(Series of 2019)

AN ORDER CREATING AN AD HOC COMMITTEE ON M.O.C.C., DEFINING ITS FUNCTIONS,

PROVIDING FOR ITS INTERNAL ORGANIZATION AND FOR OTHER PURPOSES.

WHEREAS, during the Executive-Legislative Agenda (ELA) Formulation Workshop held at

Marihatag Tree Park and Resort on July 17-19 and August 13-14. 2019, the participants were
apprised of the Municipal Mayor’s plan to create a Municipality-Owned and Controlled
Corporation (M.O.C.C.) in order to consolidate the LGU’s economic enterprise and/or provide
for a separate economic entity that will handle socio-economic and agro-industrial activities for
the benefit of the LGU and constituents of Marihatag, Surigao del Sur;

WHEREAS, in order to implement the plan, the creation of an AD HOC COMMITTEE ON

M.O.C.C. is necessary so that proper procedures and processes are followed affording everyone
the opportunity to participate in the formulation of policies for the establishment of a
Municipality-Owned and Controlled Corporation (M.O.C.C.);

NOW THERFORE, I, JUSTIN MARC L. PELENIO, MUNICIPAL MAYOR OF MARIHATAG,

SURIGAO DEL SUR, BY VIRTUE OF THE POWERS VESTED IN ME BY LAW, DO HEREBY ORDER,
AS FOLLOWS:

Section 1. Creation of an Ad Hoc Committee on M.O.C.C. – There is hereby created an

AD HOC COMMITTEE ON M.O.C.C. with twelve (12) members, as follows:

1. Chairman Mr. ANDRONICO P. ALVIZO JR., Executive Assistant/MMO

2. Vice-chairman Mr. NOE S. ELIZAGA JR., Executive Assistant/MMO
3. Member Ms. PATRICIA JOY M. ANDAM, Executive Assistant/MMO
4. Member Mr. NOLI R. MORENO, Municipal Treasurer OIC
5. Member Ms. NERRY Q. SABATIN, Municipal Budget Officer-Designate
6. Member Ms. MA. TERESA C. YAGONIA, Municipal Accountant
7. Member Mr. ROLANDO B. BANDIBAS, Municipal Planning and Development
Coordinator
8. Member Mr. ADELITO C. ORBETA – Municipal Cooperatives Officer

SECTION 2. Duties and Functions of the AD HOC COMMITTEE ON M.O.C.C. – The AD

HOC COMMITTEE ON M.O.C.C. shall have the following duties and functions:

1. To meet as often as necessary, but preferably weekly, to discuss all issues,

concerns, matters pertaining to legality and viability of creating a Municipality-
Owned and Controlled Corporation or M.O.C.C.;

2. To invite stakeholders, officials from National Government Agencies (NGAs),

representatives from the private, business and CSO sectors;
3. To formulate a comprehensive plan regarding the establishment or organization
of a M.O.C.C.;
4. To draft an Ordinance Authorizing the Creation of a M.O.O.C.;
5. To recommend the budgetary allocations necessary for the operation of a
M.O.O.C.;

SECTION 3. Funding requirements. – The funding requirements for the operational

needs of the Ad Hoc Committee on M.O.O.C. shall be taken from Budgetary allocation for the
Municipal Mayor’s Office (MMO), or from the 20% Development Fund, duly re-aligned for the
purpose, if warranted.

SECTION 4. Submission of Output/Report. – The output or report of the committee

shall be submitted to the Municipal Mayor’s Office (MMO) and the Office of the Sangguniang
Bayan thru the Secretary to the Sangguniang Bayan simultaneously with the submission of the
2020 Local Expenditures Program or 2020 Annual Budget of the Municipality on or before
October 16, 2019.

SECTION 5. Effectivity. – This Executive Order shall take effect immediately.
