IN THE MATTER OF THE CONTRACTS ACT CAP .78.


AND
IN THE MATTER OF THE ESTATE OF THE LATE
YOKANA KIZZA

CONTRACT

THIS Contract made this 14th day November 2018 between MR. KASOZI CHARLES
LWANGA and MR. MULUUTA JOHN,MISS NABWETEME KIZZA MARGRET of
Kasiiso village,(Hereafter collectively referred to as the '1st party' ) and

MR. KASOZI CHARLES LWANGA of Nabuti Village , Central Division , Mukono


District ,Tel .0703365158 (Hereafter referred to as' 2rd party ') witnesseth as
follows;

WHEREAS the 1st party constitutes the administrators of the estate of the late
Yokana Kizza, the former owner and registered proprietor of the land comprised
in MRV 55/16, (Blue Page) at Kampala on sir Apollo lane( Makerere) whose
aggregate acreage is approximately 2 acres;

AND WHEREAS 1st party is desirous of surveying the said land and processing the
Certificate of Title thereof but lacks the funds to pursue the above processes;

AND WHEREAS the 2nd party is ready, willing and financially sound to finance the
said processes;

IT IS NOW EXPRESSLY AGREED BETWEEN THE PARTIES AS FOLLOWS:

1. That the 1st party were granted letters of administration for the estate of
the late Yokana Kizza and they execute this contract in that capacity.
2. That the 2nd party shall, at his own expense, survey the entire land
described herein, prepare deed plans and process the certificate of the title
thereof;
3. That the 1st party under takes to physically avail themselves during the
survey process and grant or secure any necessary written / oral consent(s)
for the successful completion of the above processes.
4. That in consideration of the 2nd party‘s services stated in clause 1 above the
1st party has irrevocably allocated and or assigned 23 decimals out of the
above described land to the 2nd party.
5. That the said land shall be shared with the 1st party
6. That the 2nd party shall be free to dispose of up to 50% of the land allocated
to him during the survey and the title processing processes.
7. That the 2nd party shall concurrently process the 1st party’s certificates of
title and his of 23 decimals. However, the 1st party shall execute transfer
forms in respect of 23 decimals upon the 2nd party’s discharge of his
contractual obligations.
8. The 1st party have availed the 2nd with all the requisite documents, to wit,
mutation forms, a copy of letters of administration, passport photos and
photocopies of their identity cards.
9. Both parties have set their usual unrehearsed signatures on to this contract
in confirmation on their agreement to the clauses herein.
