Laws and policies for protecting PWD’s in five chosen countries in Asia. There would

only be two laws or policies shown per countries but when comparing their similarities

all laws and policies that were not mentioned have been considered.

Countries: China, Japan, South Korea, Indonesia and Philippines.

China: Article 3. [Protection of Rights]

Disabled persons shall enjoy equal rights with other citizens in political, economic,

cultural and social fields, in family life and other aspects. The citizen’s rights and

personal dignity of disabled persons shall be protected by law. Discrimination against,

insult of and infringement upon disabled persons shall be prohibited.

Article 4. [Special Assistance]

The state shall provide disabled persons with special assistance by adopting

supplementary methods and supportive measures with a view to alleviating or

eliminating the effects of their disabilities and external barriers and ensuring the

realization of their rights.

Japan: Article 3 (Fundamental Principles):

The dignity of all disabled persons shall be respected. They shall have the right to be

treated accordingly. All disabled persons shall, as members of society, be provided with

opportunities to fully participate in such a manner.


Article 5 (Responsibilities of the Nation):

The nation shall, on the basis of the principle of social solidarity, endeavor to cooperate

in promoting the welfare of disabled persons.

South Korea: Article 3. (Human Dignity)

Paragraph 1. Persons with disabilities shall be guaranteed the rights of human dignity,

worth and just treatment.

Paragraph 2. No one who has a disability shall be subject to discrimination in the area of

political, economic, social and cultural life due to his/her disability.

Paragraph 3. All persons with disabilities shall be guaranteed the opportunity of

political, economic, social and cultural activities as a member of society.

Article 9. (Treatment and Protection)

Paragraph 1. The national and local governments shall provide treatment, necessary for

persons with disabilities to learn and recover the ability of living, and shall seek

measures necessary for providing rehabilitation aids appliances, and other equipment

needed to compensate for disabilities.

Paragraph 2. The national and local governments shall take measures necessary in the

performance of proper protection, treatment, advice, training for of function, referring

persons with disabilities to welfare institutions according to age, nature and extent of

disability.
Indonesia: Article 4, Paragraph 28, Law No. 43 of 1998 on Efforts to Improve the

Social Welfare of Persons with Disabilities

Article 4 in Law No. 43 of 1998 on Efforts to Improve the Social Welfare

of Persons with Disabilities

States that the government should provide equal opportunities, rehabilitation, social

assistance, and government assistance to improve the welfare of PWDs.

Philippines: SECTION 26. Mobility The State promote the mobility of disabled

persons.

Disabled persons shall be allowed to drive motor vehicles, subject to the rules and

regulations issued by the Land Transportation Office pertinent to the nature of their

disability and the appropriate adaptations or modifications made on such vehicles.

SECTION 19. Rehabilitation Centers

The Department of Health shall establish medical rehabilitation centers in government

provincial hospitals, and shall include it annual appropriation the necessary funds for

the operation of such centers. The Department of Health shall formulate and implement
a program to enable marginalized disabled persons to avail of free rehabilitation services

in government hospitals.
