Part 1 of 3: What is the major law regarding employment discrimination, and

who is protected by this law?


According to our textbook, The VII of the Civil Rights of 1964 and protects people base
don: race, color, national origin, religion and sex. (Stewart & Brown, 2014)

Part 2 of 3: Many people feel that there are simply too many laws and
regulations governing how companies may manage their employees. These
people believe everyone would be better off if we let the free market work
without so much government interference. Other people believe that
employees are not sufficiently protected against unfair treatment by
employers. They believe employers would treat employees poorly if our laws
did not forbid them from doing so. Which position do you agree with
more? Defend your opinion and please conduct research to support it, citing at
least one scholarly resource in APA format.

I agree with the second statement because we all now that nowadays there are many
companies that have their factories in Asia and the employees are under deplorable
work conditions even though we have the human rights and there are many laws that
protect employees. We have heard that companies such as Samsung, Panasonic,
Walmart, Nike and specially companies from the fashion industry like Levis or H&M
have been involved in work exploitation scandals. According to the Eastern Eye, “the
Asia Floor Wage Alliance (AFWA) found workers stitching clothes for H&M in
factories in Delhi and Phnom Penh faced problems such as low wages, fixed-term
contracts, forced overtime and loss of job if pregnant”. (2016) This company has
compromised with the Asian government to improve the work conditions pf their
employees and it has partnered with the International Labour Organisation, the
Swedish International Development Co-operation Agency as well as global and local
trade unions to seek out solutions.
Many companies look for these places to set their factories because they look for a
sustainable competitive advantage but they are forgetting that they are working with
humans and we all deserve a fair and respectful treatment anywhere we are.
As international HR managers we’ll have to operate in a very complex legal
environment. Bose and Biswas mentioned that at least three different legal systems
are active in different nations across the globe and these are common law systems,
civil code legal systems and religious legal system. These systems not only apply to
firms and their managers in their operational and management decisions, but also to
employees and their families in their everyday lives. (2018)
Despite having many international laws to protect labor rights or federal laws such as
OSHA or the ADEA, the ADA, the Equal Pay Act and the FMLA, there are many cases of
work exploitation so I believe that employees are not sufficiently protected or that
companies need more constantly to have audits to review their HR department.
