Sub: - GRANT OF BONUS MARKS TO CONTRAUTUAL NURSING OFFICER IN THE


ENSUING SELECTION VIDE RECRUITMENT OF NURSING OFFICER IN CENTRAL
GOVERNMENT HOSPITAL.

Dear Madam,

Greetings from All India Government Nurses Federation,

All India Government Nurses Federation (AIGNF) represents to all the registered Trade Union of
Nursing professionals all over India and these are our affiliated units i.e. Central &
State Government ,Union Territories /Administration, Railways/ ESIC (Under Ministry of Labor
& Employment, Government of India)/Municipal Corporation/ Autonomous
Bodies/Statutory Bodies (Financed by Central & State Govt.) Delhi State Contractual Employee
Association /Nurses organizations/Public Health Nursing Services and Nursing education across
the Country.
Presently Nursing officer are working on Contract basis in various hospitals under the Directorate
General of Health Services, Ministry of Health and Family Welfare in four hospitals in Delhi,
namely Dr RML Hospital Safdarjung Hospital, Lady Harding Medical College and Sucheta
Kriplani Hosp and Kalawati Saran Children’s Hospital.

In the first week of August 2019, an advertisement on the website for purposes of direct
recruitment to the post of nursing officer. Upon coming to know of the advertisement, the
employees approached their authorities at the respective hospitals where they are working.
That in the aforesaid advertisement, itself it has been stated that the recruitment process has been
initiated as per the demand of medical superintendents of central government hospital and letter
was issued on 25.07.2019. The said instructions clearly indicate that the nursing officer already in
employment on contract basis need to be given bonus marks for the services already rendered by
them. However no provision for bonus marks has been made in the letter dated 25.07.2019 or in
the advertisement no.01/2019

This is a case where the applicants, being fully qualified and having faced a regular selection
process were engaged on contract basis on a fixed remuneration and have rendered service for the
last many years are threatened with disengagement since the government has decided to hold the
recruitment vide recruitment notice dated 01.08.2019. Nursing officers who have been working to
the outmost satisfaction are now forced to compete with others who are younger and have qualified
lately, whereas who are qualified and have experience of a number of years are not being given
any weightage for the experience and services rendered by them.in your hospital. .

That the Jodhpur Bench of the Rajasthan High Court in Civil Writ Petitions No. 3622/2013 and
3290/2013 has held to the effect that the instructions of the said government not to give bonus
marks to those employees performing nursing work through outsourcing NGO/placement agency
are quashed and set aside.

That on 24.05.2018, necessary instructions have been issued by the Government of Rajasthan,
Health Department recognizing the right of the contractual nursing employees for bonus marks,
while competing with fresher and have directed that 10 bonus marks be given to the contractual
staff nurses for each completed year of service

Thus, it is submitted that in law, is has been crystallized, that the temporary /contractual
employees, when competing with fresher, are eligible for grant of bonus marks as a recognition
for the services rendered by them and this benefit is not restricted to those employed after facing
selection process rather the same is also for those employed through an NGO or even outsourcing
agency.

That recently BIHAR TECHNICAL SERVICES COMMISSION has issued a recruitment notice
No. 02/2019 whereby applications have been called for the post of Nurse Grade A. The terms and
conditions /scheme of selection provides that 5 bonus marks for each completed year, maximum
25 marks shall be granted to those candidates, who have been serving as nurses in any capacity in
hospitals in Bihar and have experience certificates for the said services.

Thus, it is submitted that the policy as has been crystallized, is that the contractual/temporary
employees can be replaced only by regular employees however, while competing for the said
regular posts, bonus marks in lieu of the service rendered by the said employees should be given
to provide a level playing field.

That the letter dated 25.07.2019 clearly indicates that contractual nursing officer have preferential
rights which can be imparted to them by giving bonus marks to level the playing field in the
ensuing selection process.
That even otherwise an assessment of the total number of posts in the cadre of nursing officer
keeping in mind the expansion of all the above said hospitals is pending. In the absence of the
assessment discontinuation of the contractual staff would be a great disadvantage and loss.
Further it is submitted that contractual staff is also willing for transfer to any other hospital
wherever the vacancies exist.
It is requested that the contractual staff has been serving the department with utmost diligence and
honesty and as such are deserving of regularization. It is requested that a suitable scheme of
regularization be formulated and the services of the contractual staff be regularized, as has been
done by the Governments of Bihar, Rajasthan and Himachal and West Bengal.
Therefore you are requested to grant bonus marks in lieu of the service rendered by the contractual
nursing officer during regular appointment
