Mining Concessions in Peru
1993 Political Constitution of Peru
Chapter II: The environment and natural resources - Article 66

▪ Natural, renewable and non renewable

resources are patrimony of the Nation.

▪ The State is sovereign in their use.

▪ An organic law regulates the conditions of

their use and its granting to private
individuals. The concession grants a real right
subject to those legal regulations.

This law establishes the following:

▪ The sustainable use of non renewable natural

resources consists in its efficient exploitation
according to the principle of the value
substitution or real benefits.

▪ The exploitation of natural resources must be

carried out avoiding and mitigating the negative
impact on the environment and other
resources.
Function of the Mining Activity

Concession not needed, however, there

are restrictions.

Concession, Environmental Studies and

permissions for the usage of Surface and
Water are needed.

Concession not needed but verification of

Restriction on the granting of mining Concessions and Mining Activity

▪ Art. 22, Mining Procedure Rules (S.D. N° 018-92-EM).

▪ Archeological Sites (Law N° 28296).
▪ Protected Natural Areas (Law N° 26834).

Mining Concessions in Peru

Restriction on the granting of mining Concessions and Mining Activity

▪ The mining concession in Peru does not grant in concession lands, water, forests , etc.
▪ For a mining concession, predesigned square grids in a Square Grid System are granted with regard to the areas
with legal restrictions.
▪ Only has as information a Square Grid System and constitutional rules that establish that mineral resources are
the heritage of the nation.
▪ Does not contain information about a mining project to form an opinion on any impact, because it does not exist
at that stage.
▪ The mining concession is irrevocable, while the concession holder fulfill its legal obligations in order to maintain
its validity.
▪ The audit institutions must be efficient in order to enforce standards in Peru.
Mining Concessions in Peru
Following permissions

After getting the tittle of the mining concession and sign it up at Public Register, the
mining holder, since that moment, can start the procedures relating to the
exploration and exploitation activities: permission for water usage, superficial and
environmental lands, among others.

Mining Resources in Peru

Peru: A country with mining tradition

Mining, as the same of agriculture and

fishing, is an ancestral activity
developed from Pre Inca, Inca,
Colonial and Republican cultures.

It belongs to our customs and religious

and cultural rituals.
Sustainable Use of Natural Resources
