I N T RO D U C T I O N

• Often people will describe a factual scenario and who will be held responsible for an incident in
such a case, the concern is necessary to know what type of liability is referred too.

• In law there are basically two types of liabilities, namely CRIMINAL (public) liability and CIVIL
(private) liability.

• The objective of criminal liability are multiple and debatable. It includes theories on reprisal, prevention,
reform and deterrence.

• The objective of civil liability is to compensate the injured party, and to put him/her in in the financial
situation that he would have been if it weren’t for the incident.
LIABILITIES
The legal principles that determine who is held responsible are different for criminal and civil liability. If there
is a workplace incident, the same person or institution is not necessarily liable both criminally and civil.

PURPOSE OF THE ACT
The Occupational Health and Safety Act 85 of 1993 is about rendering
workplaces and work practices safe for everybody employed or present in a
place of work, as well as anybody affected by the acts or omissions of any
person performing work at or on any site, plant, equipment or machinery. It
specifically seeks to reduce the risk of death, injury or illness as a
result of mal practice, incompetence, or negligence.

1.) DEFINITIONS

 “exercise general control”

A registered person shall exercise general control over all electrical


installation work being carried out, and no person may allow such
work without such control.

"general control" in relation to electrical installation, work that is


being carried out, includes instruction, guidance and supervision in
respect of that work;

1 . This sub-regulation emphasizes the point that no one may do installation work unless he or
she does the work under the general control of a registered person or himself or herself is a
registered person.

2. If the registered person does the work himself or herself, this general control will not be
necessary.

3. The intention of the regulation is to ensure that installation work is carried out under clear
instructions, guidance and proper supervision and that it complies with the health and safety
standard.

2.) RESPONSIBILITY

FLOW OF RESPONSIBILITY ON C.O.C
Designer Responsible for the electrical design of the installation, according
to required standards including all calculations, specification and
prescribe which equipment will be used.

The OEM manufactures the equipment exactly as per SANS standard and specifications.
He, the OEM, will send it for testing and marking at the SANS for the certification. He sells it
to the wholesalers with all the required marking and certification. The wholesalers ensure Supplier
that the certificate compares with the equipment. The wholesaler sells it to you, the
owner, who accepts the responsibility

Purchase the equipment ensure all markings and certifications are

valid and installs the equipment as per OEM specification.

Inspects all relevant documentation, and the installation in detail. If all is in


order continues with the required tests. Once all is in order he issues the Registered person
certificate of compliance. The owner signs on the C.o.C

Accepts the C.o.C and ensure future maintenance will be done with no
un-lawful modifications, which would effect the validity of the certificate

3.) CERTIFICATE OF COMPLIANCE

(1.) Subject to the provisions of sub-regulation


(3) every user or lessor of an electrical
installation, as the case may be, shall have a
valid certificate of compliance in the form of
annexure 4, which shall be accompanied by a
test report in the format approved by the chief
inspector, in respect of every such electrical
installation:

TEST 1 CONTINUITY OF ALL BONDING CONDUCTORS!
SANS 10142:
Test the continuity of the bonding conductors between the consumers earth terminal using a supply that that has
a no-load d.c. or a.c. voltage of 4V to 24V, and a current of at least 0,2A. In each case, the resistance shall not
exceed 0,2 

AIM
To ensure continuity between all earthing and bonding conductors (to ensure equal potential
bonding.)

INSTRUMENT
Meggar or low reading OHM meter with a display capable of showing up to three decimal points (200mA) and a
test lead to reach all exposed metallic parts.

UNIT of measure N/A (Beep!) or Ohm

METHOD
- Ensure the circuit is isolated (to protect the instrument)
- Measure the resistance of the meter probes (zero the instrument)
- Confirm earth on all exposed conductive parts:
Stove, geyser, gutters, pipes, motors, light fittings and aerials

- Measure from Main DB earth bar to each, and record each measurement
- Reading not to exceed 0,2 Ohm

There was a request by SAFA IS Committee and the SANS 10142-1 working group to

exclude Instrument loops below 50V DC are excluded from SANS 10142-1 as per the

Regulation and Standard to DOL

• 4-20mA Intrinsic safe Ex i (or Ex e, d, n, m, p etc..) loops into hazardous area (Zone 0, 1, 2, 20, 21 or 22) - No

COC required, but installation and documentation must be signed off by a person competent in Hazardous

locations.

• 4-20mA non-IS loops into safe area - No COC required.

• 24 VDC ( or any other lower than 50V) instrument loops (e.g. Solenoids) into hazardous area - No COC required,

but installation and documentation must be signed off by a person competent in Hazardous locations.
