SUBJECT : COMPLAINT FOR RECKLESS DRIVING

This letter is in relation to the written complaint we received from a certain James Lazatin
Gozun against the driver of your corporation, MR. ERNESTO DAVID RAMOS JR. for
reckless driving.

Allegedly, Ramos, who was operating a dump truck registered under your corporation, did not
observe reasonable care and extraordinary diligence as the spare tire attached to the motor
vehicle fell which was ran over by the complainant. As contended, this has resulted to an
irreparable damage to the complainant’s motor vehicle. Ramos was imprudent for travelling
without properly checking and equipping the dump truck which endangered the safety and
rights of a person and which caused excessive damage to other properties.

The act complained of against your employee is administratively penalized under JOINT
ADMINISTRATIVE ORDER NO. 2014 -01 (June 2, 2014) for Reckless Driving. Any
legitimate driver who is found to be operating his or her motor vehicle recklessly shall be
penalized for an amount of P2,000.00 for the first offense. Such administrative order which
has the force and effect of a law states:

No person shall operate a motor vehicle on any highway recklessly or

without any reasonable caution considering the width, traffic, grades,
crossing, curvatures, visibility, and other conditions of the highway and
the conditions of the atmosphere and weather, or so to endanger the
property of the safety or rights of any person or so as to cause excessive
or unreasonable damage to the highway.

If proven that your driver was negligent, he is required to pay the fine imposed by law for
reckless driving. Non-payment thereof by the said driver shall transfer such obligation to pay
to your corporation as the employer of the former. In case of non-compliance, our Operations
Division shall include the plate number of the subject motor vehicle in the alarm list in the
exercise of the law enforcement function of the LTO. If placed in the alarm list, any transaction
involving the subject motor vehicle shall be barred and the renewal of the registration of the
subject motor vehicle shall be adversely affected. This administrative penalty is without
prejudice to any criminal or civil case that may be filed in court by the complainant against you
and your employee.

In view of the foregoing, you are hereby ordered to instruct your employee complained of for
reckless driving to immediately explain personally within twenty four (24) hours from the
receipt of this letter in our office for us to determine whether or not we are going to impose the
administrative fine and put your motor vehicle in our alarm list.

Your immediate action on this matter is encouraged in order to ensure that you will be afforded
the due process of law.
