Let the affidavit of service filed in court today be kept


with the record.

On the almost identical cause of action, as pleaded


in this writ petition, an earlier petition was filed by the
same petitioner along with two others which was
dismissed. This petition, therefore, deserves no
consideration whatsoever.

As I was going to dismiss the writ petition Mr.


Bhattacharya, the learned advocate for the petitioners who
were also the petitioners in the earlier round of litigation,
exercised his discretion for not pressing the writ petition
any further.

In such view of it this writ petition is liable to be


dismissed as not pressed.

There shall, however, be no order as to costs.
