Regulatory Activity of Interest
USPTO: Request for Comments on Patenting Artificial Intelligence Inventions, Docket ID:
PTO-C-2019-0029, Comments Due: Oct. 11
The USPTO is interested in gathering information on patent-related issues regarding AI inventions for
purposes of evaluating whether further examination guidance is needed to promote the reliability and
predictability of patenting AI inventions. To assist in gathering this information, the USPTO is publishing
questions on AI inventions to obtain written comments from the public. The questions are designed to
cover a variety of topics from patent examination policy to whether new forms of IP protection are needed.

NIST: A Plan for Federal Engagement in Developing Technical Standards and Related Tools
The plan recommends the federal government “commit to deeper, consistent, long-term engagement in AI
standards development activities to help the United States to speed the pace of reliable, robust, and
trustworthy AI technology development.” It calls for federal agencies to bolster AI standards-related
knowledge, leadership and coordination among agencies that develop or use AI; promote focused
research on the trustworthiness of AI systems; support and expand public-private partnerships; and
engage with international parties.

On Friday, U.S. Secretary of Energy Rick Perry announced the establishment of the DOE Artificial
Intelligence and Technology Office (AITO). The Secretary has established the office to serve as the
coordinating hub for the work being done across the DOE enterprise in Artificial Intelligence. This action
has been taken as part of the President’s call for a national AI strategy to ensure AI technologies are
developed to positively impact the lives of Americans.
