ADMINISTRATIVE COMPLAINT OF EDWARD D. FRAYLON AGAINST PUNONG


BRGY. MARK QUINADAO GALVEZ AND BRGY. KGWD. QUIRUBEN DALISAY
PEPITO, BOTH OF BRGY. COMMUNAL, BUHANGIN DISTRICT, DAVAO CITY.

Committee Hearing Conducted: August 15, 2019, 1 o’ clock in the afternoon at the Violet Room
of the Sangguniang Panlungsod Building, San Pedro St., Davao City.

BACKGROUND:

This refers to the administrative complaint Edward D. Fraylon against Punong Brgy. Mark
Quinadao Galvez and Brgy. Kgwd. Quiruben Dalisay Pepito, both of Brgy. Communal,Buhangin
District, Davao City for alleged Malfeasance and Violation of COMELEC Gun Ban.

The complaint was first endorsed to the Committee on Ethics and Good Governance on February
29, 2016 and was assigned an Item Number on April 25, 2017. On January 12, 2018, a committee
hearing was conducted.

However, due to the adjournment of the 18th City Council and the election of the new Chairperson
of the Committee on Ethics and Good Governance for the 19th City Council, this case was endorsed
to the new Chairperson on July 16, 2019, who in turn scheduled a Committee Hearing on August
15, 2019.

HIGHLIGHTS OF THE COMMITTEE HEARING:


1. In a Complaint- Affidavit dated December 17, 2013 stated that the complainant Edward D.
Fraylon, is a caretaker of James Gaisano properties, alleging among other the Serious
Dishonesty, Grave Misconduct and Conduct Grossly Prejudicial to the Best Interest of the
Service. As stated in the Complaint-Affidavit, on October 23, 2013, the respondents
together with around fifty (50) persons or more, surreptitiously entered the private property
of James Gaisano located at Pag-Ibig Subdivision, Buhangin, without the knowledge of
herein complainant. He also alleged that while inside the premises, he approached and
offered a hand shake to the complainant. The respondent thereafter boxed him, hitting him
on the right forehead and then pushed him to the ground. Wherein four (4) police officers
entered the house and three (3) officers ordered him to board the patrol car, handcuffed and
brought to the police station without committing any infractions of the law.

2. In a Counter- Affidavit filed by the Respondent Punong Barangay (PB) Mark Quinao
Galvez dated March 2, 2015, he alleged that on October 23, 2013, his team were
campaigning with more than 100 supporters, mostly composed of women and children and
with no policeman, that the complainant was approached by the respondent PB, offered a
hand but the complainant pushed him and arrogantly said “What are you doing here?”
while pulling a gun tucked in his waist, wherein, respondent Kagawad immediately
disarmed him and was arrested later and brought to the Buhangin Police Station. Likewise,
in the Counter-Affidavit of respondent Kagawad Quiruben D. Pepito dated May 19, 2015,
he identified complainant Edward Fraylon as an ally of former Punong Barangay Maalat
and the wife of the latter was defeated by Punong Barangay Mark Galvez last election and
further alleged the same allegations with respondent PB Galvez. The following allegations
against the complainant was likewise testified by different Affidavit of Witnesses
submitted before this Committee.

3. An Information was filed before the RTC Branch 11 of Davao City dated October 25, 2013,
enitled “People of the Philippines vs. Edward D. Fraylon” for violation of COMELEC
Resolution No. 9561-A. Whereas, an Order from the same court dated February 22, 2019
stated that the “case be closed and terminated” since both parties as it is best that they
reconcile for the ultimate good of their Barangay community and that respondent PB
Galvez is willing to forget the said incident while the complainant- accused Fraylon seeks
for forgiveness.

4. On July 16, 2019, with the commencement of the 19th City Council, this case was again
endorsed to the Committee under the Chairmanship of the undersigned and a Committee
Hearing was then scheduled on August 15, 2019.

RECOMMENDATIONS

On August 15, 2019, the parties were able to settle their differences and entered into an
amicable settlement and manifested it before the Committee for their request for the dismissal of
the case. Thus, by reason of the amicable settlement between Complainant Edward D. Fraylon and
Respondents Punong Barangay Mark Quindao Galvez and Barangay Kagawad Quiruben Dalisay
Pepito the issue subject of investigation became moot and academic and the Committee is
constrained to recommend the dismissal of the Complaint.

Finally, the committee hereby recommends closing Item No. 132 which pertains to the
“Administrative Complaint of Edward D. Fraylon against Punong Brgy. Mark Quinadao Galvez
and Barangay Kagawad Quiruben Dalisay Pepito, both of Barangay Communal, Buhangin
District, Davao City.”

RESOLUTION CLOSING ITEM NO. 132 ADMINISTRATIVE COMPLAINT OF

AND BRGY. KGWD. QUIRUBEN DALISAY PEPITO, BOTH OF BRGY. COMMUNAL,

WHEREAS, the item refers to the Affidavit-Complaint dated December 17, 2013 stated
that the complainant Edward D. Fraylon, alleging the Serious Dishonesty, Grave Misconduct and

baseless. Furthermore, the respondents filed a criminal case before the RTC Branch 11 against the
complainant wherein both parties entered into an amicable settlement and thereafter was
dismissed;

WHEREAS, both parties agreed and entered into an amicable settlement for this
administrative case before this Committee

WHEREAS, with the amicable settlement entered by the parties, the issue subject of the
investigation became moot and academic, the Committee is constrained to recommend the
dismissal of this instant administrative complaint;

RESOLVED, to close the item no. 132 entitled Administrative Complaint of Edward D.
Fraylon against Punong Brgy. Mark Quinadao Galvez and Brgy. Kgwd. Quiruben Dalisay Pepito,
both of Brgy. Communal, Buhangin District, Davao City;

RESOLVED FURTHER, that the copies of this Resolution be furnished the Barangay
Council of Barangay Communal, Buhangin District, City Legal Office, City Administrator’s

LABRO AND KAGAWAD FRANCISCO I. LABRO JR. OF BARANGAY 15-B,
POBLACION DISTRICT, THIS CITY.

BACKGROUND

The Complaint was filed by Amparo Mahinay, Corazon V. Labajo, Aurea Sumingit And Elpedio
Villejo against Punong Barangay Fradilyn M. Labro And Kagawad Francisco I. Labro Jr. of
Barangay 15-b, Poblacion District, Davao City for Misconduct.

The Complaint was first endorsed on September 10, 2018 to the Committee on Ethics and Good
Governance and was assigned an item on September 18, 2018. However, due to the adjournment
of the 18th City Council and the election of the new Chairperson of the Committee on Ethics and
Good Governance for the 19th City Council, this case was endorsed to the new Chairperson on July
16, 2019, who in turn scheduled a Committee Hearing on August 1, 2019.

HIGHLIGHTS OF THE COMMITTEE HEARING

1. In the two-page Joint-Affidavit by the Complainants dated September 10, 2018, they
alleged that they are the officers of the Senior Citizen Chapter I, Barangay 1 of Barangay
15-B, Poblacion District. Wherein, anent to the allegations against respondent Kagawad
Labro, the complainants alleged that the incidents pertaining to the malicious and
threatening actions and words uttered by the respondent Kagawad on the two (2) separate
General Meeting of the Senior Citizens dated July 26, 2018 and on July 24, 2018 which
are first: threatening to kill them and calling them shameless (baga ug nawong), second:
not accepting new members without his approval, third: giving a metaphoric example
which is “Nagbuklad siya ug payong iyang gibukhad para dili daw kami mainitan. Pero
wala daw kami mupasilong sa payong. Ang buot niya pasabot, wala daw kami mangboto
nila. Nagkuha na pod siya ug balloon ug iyang gipaboto, parihason daw kami niya sa
balloon pabothon”. Moreover, anent to the allegations against respondent Punong
Barangay (PB) Fradilyn Labro, the complainants alleged that the respondent PB directed
the change of officers of the Senior Citizen Chapter I because the complainants disregarded
her authority, also the respondent PB directed the monthly dues and mortuary payment to
be remitted to the barangay wherein the complainants defended that they remit it to the
assigned kagawad and they cannot access it and it had gone missing. Furthermore, they
alleged, as regards to their IRA intended for the Senior Citizens, they alleged that no fund
was given for four (4) years since 2013 and to compensate, only t-shirts were given as

their uniforms. Also, as regards to their P4,000.00 fund (P10.00 monthly contribution per
member) under the custody of the treasurer, it was never released accordingly to their
agreement that it be allowed for the members to be used in such a way of loan for their
medicines nor can the complainants access it. The complainants also alleged that the
respondent PB created Chapter II and appointed the corresponding officers therewith and
stated that the said officers have no task because the responsibilities of the said office will
be assigned to the kagawads. Finally, the complainants alleged that there was a difficulty
of issuance of barangay certification to the non-supporters, like the herein complainants.

2. In the five-page Counter-Affidavit dated October 17, 2018, the respondent Kagawad Labro
alleged that the operation of the Senior Citizen was in order, however, because of the
mortuary payments collected by either officers namely, President Lucena Adajar, Vice-
President Corazon Labajo and/or Secretary Amparo Mahinay and transmitted directly to
the deceased member/s wherein no complete records of the payment and disbursement of
the fund was given. Also, in 2017, the herein respondent was informed that the above-
stated officers allegedly used the money for their personal use. On the same dated Counter-
Affidavit, the respondent PB Labro alleged that there was no General Meeting on July 21,
24, and 26, 2018 because the General Meeting is usually conducted every third Sunday of
the month and that the reason for the election of the new officers was because of deliberate
disobedience of the herein complainants to the procedure and bypassed her authority.
Likewise, the respondent alleged that the complainants failed to follow the proper
procedure in turning over the mortuary benefits to the bereaved family of the deceased
member. Also, the respondent alleged that the budget for the Senior Citizen should be in a
form of project of activity and not to be endorsed in cash to the officers. Finally, the
respondent alleged that the issuance of the barangay certification for the daughter of the
Senior Citizen’s President is impossible because she was not a registered voter nor a
resident of the barangay.

3. In a Committee Hearing dated November 14, 2018, the parties agreed to enter in an
amicable settlement. Likewise, in the Committee Hearing dated August 2, 2018 under the
new Chairperson of the Committee, both parties affirmed the said amicable settlement.

4. On July 16, 2019, with the commencement of the 19th City Council, this case was again
endorsed to the Committee under the Chairmanship of the undersigned and a Committee
Hearing was then scheduled on August 2, 2019.

RECOMMENDATIONS

On August 2, 2019, the parties were able to settle their differences and entered into an
amicable settlement and manifested it before the Committee for their request for the dismissal of
the case. Thus, by reason of the amicable settlement between Complainant Amparo Mahinay,
Corazon V. Labajo, Aurea Sumingit and Elpedio Villejo against Punong Brgy. Fradilyn M. Labro
and Brgy. Kgwd. Francisco Labro of Brgy. 15-B, Poblacion District the issue subject of
investigation became moot and academic and the Committee is constrained to recommend the
dismissal of the Complaint.

Finally, the committee hereby recommends closing Item No. 138 which pertains to the
“Verified Complaint of Amparo Mahinay, Corazon V. Labajo, Aurea Sumingit and Elpedio Villejo
against Punong Brgy. Fradilyn M. Labro and Brgy. Kgwd. Francisco Labro of Brgy. 15-B,
Poblacion District, Davao City”

WHEREAS, the complainants are the officers of the Senior Citizen Chapter I, Barangay
1 of Barangay 15-B, Poblacion District, alleging among others that the respondent Kagawad Labro
on two separate incidents dated July 24 and 26, 2018 had maliciously threatened to kill the
members of the said Senior Citizen Chapter through the respondent Kagawad’s uttered statements
and actions. Moreover, the complainants alleged that the respondent Punong Barangay maliciously
and deliberately caused the change of officers, and failed to deliver their agreement as to their loan
for their medicines using the monthly contribution.

WHEREAS, the respondents, denied the allegations against them are malicious and
alleged that it was baseless.

WHEREAS, both parties agreed and entered into an amicable settlement for this
administrative case before this Committee during the Committee Hearing dated November 14,
2018 and was further reaffirmed during the Committee Hearing dated August 2, 2018 under the
new Chairperson of the Committee although the parties confirmed that they only settled the matter
orally

WHEREAS, with the amicable settlement entered by the parties, the issue subject of the
investigation became moot and academic, the Committee is constrained to recommend the
dismissal of this instant administrative complaint;

BACKGROUND:

This refers to the letter of complaint of Isabel Furia Vda. De Danao against Brgy. Kgwd. Merilyn
Uayan of Brgy. Datu Salumay, Punong Brgy. Delfin Galecia and Brgy. Secretary Deding Apolona
of Brgy. Buda, Marilog District, Davao City for Conduct Prejudicial to the Best Interest of Service.

The complaint was first endorsed to the Committee on Ethics and Good Governance on September
24, 2018 and was assigned an Item Number on September 24, 2018. On January 24, 2019, a
committee hearing was conducted after it was previously cancelled on January 5, 2019.

However, due to the adjournment of the 18th City Council and the election of the new Chairperson
of the Committee on Ethics and Good Governance for the 19th City Council, this case was endorsed
to the new Chairperson on July 16, 2019, who in turn scheduled a Committee Hearing on August
15, 2019.

HIGHLIGHTS OF THE COMMITTEE HEARING:


1. In a Complaint Affidavit dated October 2, 2018, the complainant alleged that respondent
Kagawad Uayan illegally occupied her property in Purok 2 in front of the gate of Buda
National High School. Also, the complainant alleged that respondent Punong Barangay
Galecia did not give enough attention to the request of the complainant’s grievance and
dared the complainant to file an appropriate action instead. Lastly, the complainant alleged
that the respondent Barangay Secretary Apolona collected a filing fee without issuing a
receipt thereof.

2. The respondent Kagawad filed an Answer on November 26, 2018 alleging that he occupies
a one-hectare land in front of Buda National High School wherein the Right of Possession
to the subject property was acquired sometime in 2017 from Ma. Theresa Jardenico-
Delcano, the daughter of the late DILG Director XI Jardenico; that prior to the entry to the
subject property, no structures were built therein and that the fast food building was

constructed in the elevated area and during the levelling of the lot for one month, the
complainant never appeared nor opposed the activities and only raised the concern in the
year 2018 and claimed a portion of the lot; that he informed then PB Policious regarding
the claim of the complainant yet PB Policious said that the subject property was originally
owned by their family and sold such to Director Jardenico also the complainant built a
shanty in front of the subject land and within the road-right-of-way of the Bukidnon-Davao
National Highway; that PB Policious informed the respondent Kagawad that during the
Road Widening project of DPWH, the shanty of the complainant was demolished and the
complainant used the area in selling vegetables and did not live there; and finally that
respondent Galecia knew of the said facts and still refuses to entertain any complaint of the
complainant because it was all baseless and unsubstantiated and considered a nuisance to
the barangay.

3. The respondent PB Galecia likewise filed his Counter-Affidavit dated November 26, 2018
alleging that the statement of respondent kagawad was false and that the complaint filed
by the complainant was not verified thus shall be dismissed.

4. On the Committee Hearing conducted on January 29, 2019, this case was subject to the
referral to the National Commission on Indigenous People (NCIP) for the determination of
the ownership of the said subject property.

5. During the Committee Hearing on August 15, 2019, the parties agreed and confirmed that
they allowed the new Chairperson of this Committee to adopt the previous
recommendation.

RECOMMENDATIONS

On the Committee Hearing dated January 29, 2019, the issue involving the determination
of the subject property, the same was referred to the NCIP. Furthermore, during the Committee
Hearing on August 15, 2019, the parties confirmed that they allowed the newly constituted
Committee on Ethics and Governance to adopt the aforesaid recommendation made by the
previous Committee.

Thus, by reason of the said referral to the NCIP, the issue subject of investigation became
moot and academic and the Committee is constrained to recommend the dismissal of the
Complaint.

Finally, the committee hereby recommends closing Item No. 138 which pertains to the
“Verified Complaint of Isabel Furia Vda. De Danao against Brgy. Kgwd. Merilyn Uayan of Brgy.
Datu Salumay, Punong Brgy. Delfin Galecia and Brgy. Secretary Deding Apolona of Brgy. Buda,

WHEREAS, the complainant in her Complaint-Affidavit alleged that Barangay Kagawad
