31/ 2019 on Implementation of Law


No. 33/ 2014 on Halal Products Guarantee

 Government Regulation on implementing regulation for Halal Guarantee Product (JPH) has
been signed by President Joko Widodo on 29 April 2019 and promulgated on 3 May 2019.
 Products imported, distributed, and traded in Indonesian territory that are required to be Halal-
certified are products made of Halal ingredients and in accordance with Halal Products Process
(PPH).
 Businesses that produce non-Halal products are obliged to attach ‘non-Halal’ information on
their products in the form of image, sign, and/or writings.

I. Halal Implementing Agency


 In exercising its authority, The Agency of Halal Product Assurance (BPJPH) may cooperate with
related ministries and/or institutions, Halal Verification Agency (LPH), and Indonesian Council of
Ulama (MUI). Types of cooperation with Ministries/Agencies are stipulated as follows:

Ministry of Foreign Affairs Facilitation of international cooperation; socialisation,
education, publication, and promotion overseas

II. Certification Fee and Registration Procedure for Foreign Halal Certification
 Certification fee will be charged to companies that apply for Halal certification. However,
certification fee for micro and small enterprises may be facilitated by central/regional
government, company, social/religious institution, association, and community.
 Products with halal certification from foreign institution that has mutual recognition with BPJPH
only needs to register their certificate and does not need to apply for new halal certification but
must be registered by BPJPH prior to being circulated within Indonesia.
 The procedure for the registration of foreign halal certification is outlined in the following
flowchart:

Submission  Businesses submit their application to the BPJPH in writing either


of through its electronic system or manually, enclosing the following
Application documents: 1) Copy of relevant foreign halal certificates; 2) List
of imported goods; and 3) Statement letter confirming the
validity and accuracy of the submitted documents.

III. Stages for Types of Halal Products Certification
 Halal certified products comprises of both goods and services which include following products:
Scope Details
Goods 1. Food and beverages;
2. Medicines and cosmetics;
3. Chemical, biological and genetically engineered products;
(products that are related with food and beverages, medicines,
or cosmetics
4. Usable goods* that are:
Used (health supply and equipment for household, moslem
religious attributes, food and beverages packaging, stationery
and office supplies); wore (clothes, head covers, accessories);
utilized (medical devices)
*may be added by Ministry after coordination with relevant ministry,
agencies, and institution.
Services Services related to the following
1. Slaughtering;
2. Processing;
3. Storing;
4. Packaging;
5. Distribution;
6. Sales; and
7. Serving.
 The obligation of halal certification will be implemented gradually and starting with food and
beverages products followed with products other than food and beverages - which will be regulated
further on the Minister of Religious Affairs Regulation.
 Life-saving drugs, biological products, and medical devices that contains non-halal ingredients
and use non-halal process can be distributed until the halal ingredients are found and it can
fulfill the halal process. This will be regulated under Presidential Regulation (Perpres).

IV. Transitional Provision


 Before the regulation on certification fee amount is enforced, application and extension of halal
should follow current practice.
 Halal certificate issued before the enforcement of this regulation will remain valid until its
expiration date
